and the Commissioner of Public Works of the City of Saint Paul, has secured ( ;;,
an agreement for the purchase of those certain easements, as described belo
which are necessary for the relocation and reconstruction of the existing � �
sewer in Arundel Street, and the price at which the easements may be purchas d�_
is in the total amount of $5,000.00, as negotiated with the owners by the R
Committee on Lands, and
WI-IEREAS, Said Committee has recommended the purchase of the said easements at '
the price stated above as evidenced by the letter of said Committee submitte�d L
herewith; now, therefore, be it II ;[
RESOLVED, That, pursuant to Section 303 of the Charter of the City of Saint EaLtt,
the Council of the City of Saint Paul does hereby authorize the purchase of �
those certain easements described as: �

A permanent easement on a strip of land 30 feet in wzith along the
east side of Arundel Street for the purpose of constructing and ���
maintaining a public sewer on, under, across, and through the wes-
terly 30 feet (except the south 240 feet) of that part of Lot 41, �
Cottage Homes, lying north of West Maryland Avenue, and on, under, "
across, and through that portion of the westerly 30 fe� of Lot 28,
Cottage Homes lying south of the existing sewer easement. ,

And, a temporary slope easement for sewer cover and lateral support �
to permit construction of a partial embanlvnent to a maximum elevation
of 160.0 (City datum) on a strip of land 15 feet in width on the east �
side of the above easement located on Lots 41 and 28, Cottage Homes, ��
the temporary slope easement to terminate at such a time as the
entire easement area is filled to a minimum elevation of 160.0. `
Also, the above described permanent easement includes the restriction o� :
all future building construction on the westerly 21.0 feet of said ease��
, � ment, building construction on the easterly 9.0 feet of the said easeme��t �
� to be subject to the approval of the Department of Public Works of the -
City of Saint Pau1.

Bernard A. Merkl, vendors of said easements, the sum of $5,G100.00, said sum ��'
to be paid to the aforesaid vendors from Budget Fund 0920-701, upon their �"
furnishing an abstract of title continued to date evidencing good and mar- �
ketable title in Anthony E. Merkl, John I. Merk1, Joseph G. Merk1; and �
Bernard A. Merkl, and the total payment to be made upon tender by said
parties of an appropriate warranty deed conveying title to said easements "
to the City of Saint Paul,

The City of Saint Paul, acting through its Valuation Engineer, has ��
negotiated to purchase certain easements described as follows: '

The owners of the lands affected by the above described �easements, �

$5,000.00, as compensation for the sale of the said easements to �'

the City. �E,
These easements are required by the City of Saint Pau1 to facilitate � �
the relocation and reconstruction of the existing sewer in Arundel '
Street adjacent to the said easements. In view of the immediate � �
need to acquire the easements on this property for the relocation � ,
of the sewer in Arundel Street, and in view of the compensation
