2 BE IT RESOLVED, that, upon the petition of Miller & Holmes, Inc., as documented in Real Estate
3 Division File Number 26-2004, public properties hereinafter described are hereby vacated and
4 discontinued as public pzoperty:

That the petitionei s, their successors and assigns shali pay $1,200 as an administrative fee for
this vacation which is due and payabie within 60 days of the effective date of this resolution.
That any portion of the alleys opened a conveyance of property rights, shall be conveyed to the
current owner of record having interest in said alley.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Comcast of St. Paul.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communications.
That a permanent utility easement shall be retained within the vacated uea to protect the interest
of Xcel Energy.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or clauns of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or rea lation made in
accordance with the law, whether by the petitioners or any of their agents or employees.

This petition is to vacate the norkh-south alley and the rest of the ease-west alley in Block 59,

The purpose of this vacation is to remove un-improved alieys and combine commonly owned
properties.

3 Division File Number 26-2004, public properties hereinafter described are hereby vacated and

That the petitioner's, their successors and assigns shall pay $1,200 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That any portion of the alleys opened a conveyance of property rights, sha11 be conveyed to the
current owner of record having interest in said alley.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Comcast of St. Paul.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communications.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Xcel Energy.
29 6. That the peti6oners, their successors and assigns agree to indemnify, defend and save harmless
30 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
31 brought as a result of injuries or damages received or sustained by any person, persons or
32 properiy on account of this vacation or petitioners' use of this property, including but not limited
