2 WfIEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and
4
WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
§293.Q9, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
unreasonable hardship on an applicant, other persons or on the community; and
9 WHEREAS, Gabe's by the Puk, represented by Matt Long, OwnerlPresident, who has been designated as
10 the responsible person on the application, has applied for a variance to allow amplified music at 991 Lexington
11 Pkwy N., on Mazch 17, 18 and 19, 2005; and

13 WHEREAS, applicant is seeking a variance far the hours of 5:00 p.m. to 12:00 midnight on the night of
14 March 17, and from 7:00 P.M. to 12:00 midnight. on March 18 and 19; and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to present the ampiified music ; and
17
18 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
19 and has made recommendations regarding condirions for the vaziance; now, therefare, be it

RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Gabe's by the Park,
subject to the following conditions:
1) The Office of LIEP recommends that the variance shall be for the hours of 5:00 P.M.
to midnight on March 17, for the hours of 7:00 to midnight on March 18 and 19.
2) All electronicaliy powered equipment used in conjunction with the event shali not
exceed 95 dBa as measured from the wall opposite the stage.

2 3) The applicant shall provide personnei and equipment who shall provide continuous
3 sound level monitoring between 5:00 p.m. and midnight on March 17, and between
4 7:00 and midnight on Mazch 18 and 19.

6 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be tumed
7 off no later than the set time on each of the dates.
