WHEREAS, the City of Saint Paul ("City") is constructing new facilities on city-owned park
land known as Como Regional Park, including Como: Zoo, Conservatory, and VisitorBducation
Center, and legally described in E�ibit "A," a copy of which is attached and incorporated herein
by this reference; and
WHEREAS, in order to comply with a Metropolitan Council grant, the City needs to impose
certain restrictions on said property; now, therefore be it
9 RESOLVED, that the Saint Paul City Council hereby authorizes the proper city officials to
10 record this resolution with Ramsey County Property Records and Revenue Department imposing
11 the following restrictions on said properiy:

13 The fee title to, lease of, or easement on Real property is bond financed property within
14 the meaning of Minn. 5tat. 16A.695, as amended from time to time, is subject to the
15 encumbrance created and requirements imposed thereby, and cannot be sold or otherwise
16 disposed of by public officer or.agency which has jurisdiction over it or owns it without
17 approval of the Minnesota Commissioner of Finance, which approval must be evidenced
18 by a written statement signed by the Commissioner of Finance and attached to the deed or
19 instrument used to sell or otherwise dispose of the fee title to, lease of, or easement on

Real Properry.
The fee title to, lease of, or easement on the Real Properiy shall remain subject to this
restriction until; (i) the restriction has been fully complied with as evidenced by a written
approval from the Minnesota Commissioner of Finance, or (ii) a written release, releasing
the fee title to, lease of, ar easement on the Real Property from the restriction, signed by
the Minnesota Commissioner of Finance, is recorded in the real estate records relating to
the Real Properiy.

Initiating Problem, Issues, OppoRUnity (Who, What, When, Where, Why):
The Meuopolitan Council - Metro Pazks & Open Space prograiu has provided a grant for the construction of the Educational Resource
Center and other improvements to the Conservatory in Como Park. The grant requires that a deed restriction be placed on the property
indicating it is property improved with state bond proceeds.
