1 WHEREAS, the owner of 437 Shepard Road, Island Station, LLC ("Island Station"), proposes that the
2 City of Saint Paul Division of Parks and Recreation ("Parks") grant access for the construction of a
3 sanitary sewer across abutting city pazk land known as the "Samuel H. Morgan Trail," as shown on the
4 drawing (Exhibit "A"), a copy of which is attached hereto and on file in the Department of Public
5 Works, Real Estate Division, File Number 40A-2004; and

WHEREAS, Patks has given permission to Island Station, in partnership with the Sa3nt Paul Port
Authority, to conshuct, operate and maintain a private sanitary sewer under and across said ciry-owned
pazk land, as stated in the Saint Paul Parks and Recreation Commission's Resolution Numbered OS-02,
adopted Februaiy 9, 2005, a copy of which is attached hereto; and
WFIEREAS, Island Station must enter into a license agreement with the City of Saint Paul for the
construction and use of said sanitary sewer and pay just compensation to Parks as determined by an
independent appraisai pursuant to Section 13.01.1 of the Saint Paul City Charter; and
WHEREAS, pursuant to Section 13.01.1 of the Saint Paul City Charter and in aceordance with Chapter
51 of the Saint Paul Administrative Code, Island Station proposes to dedicate a permanent easement far
trail purposes on its abutting property in exchange for the vehicle and utiliry access license, as shown on
the attached drawing (E�ibit "B"); and
WHEREAS, the Division of Parks and Recreafion has reviewed and supports the dedication of the
proposed easement; and
24 WHEREAS, the City's Valuation & Assessment Engineer has declared the proposed easement to be of
25 equal or greater value to said park land to be diverted; and

27 WHEREAS, any existing trails, trees or other landscaping disturbed as a resuk of the sewer construction
28 will be restored at Island Station's expense and in a manner acceptable to the Division of Parks and
29 Recreation; now, therefore be it

31 RESOLVED, that the Saint Paul City Council hereby accepts the proposed traii easement on Island
S2 Station property, subject to final design, review and approval by Parks, in exchange for the diversion of
�3 park land on the Samuei H. Morgan Trail; and be it further

Initiating Problem, Issues, Opportunity (Who, What, When, Where, Why):
A private developer of the Island Station properry would like to conskuct and maintain a sanitary sewer line under tkie abutting Samuel
H. Morgan Trail. Per City Charter requiretnents (Ch. 13.01.1), ffie City may dispose of the properiy. As compensation, Island Station
will dedicate a new trail on its property for public use. The trail will connect to the existing city trail.
Advantages If Approved:
The City can assist a new housing development by providing needed sanitary sewer access acruss park land. In exchange, addifional
trail with access to the Mississippi River will be dedicated.

RESOLUTION 05-02
WE�REAS, the Saint Paul Pazks and Recreation Commission ("Commission") is an
appointed body established to advise the Mayor and Ciry Council on long-range and city-wide
matters related to Parks and Recreation; and
4VIIEREAS, Section 13AL1 ofthe City Charter requires that the Commission review any
diversion or disposal of pazk property and present a recommendarion to the City Council; and
WEIEREAS, Island Station, LLC ("Island Station") proposes that the City of Saint Paul,
through its Parks and Recrearion Division, issue a license to Island Station for the construcrion,
operation and maintenance of a sanitary sewer under and across city park land abutting Island
Station's property at 437 Shepard Road {as shown on the attached Exhibit "A"}; and
WHEREAS, the Commiss3on and City Council have previously approved the issuance of a
driveway and urility license on city park land in exchange for a permanent trail easement to be
dedicated on the abutting Island Station property (as shown on the attached Exhibit "B"); and
WHEREAS, the appraised market value of the trail easement exceeds the combined
appraised market value of park land diverted for the driveway and utility license and the proposed
sewer license; and
WFiEREAS, any exisring trails, trees or other landscaping disturbed as a result of the
driveway construction will be restored at Island Station's expense and in a manner acceptable to the
Division of Parks and Recrearion; now, therefare be it
BE IT RESOLVED, that the Saint Paul Parks and Recreation Commission concurs with the
proposed exchange of a sanitary sewer license on city park land abutting 437 Shepard Road for a
permanent park trail easement on Island Starion property at 437 Shepard Road, and in accordance
with City Charter Secrion 13Ai.1 recommends approval by the Saint Paul City Council.

WHEREAS, the Saint Paul Parks and Recrearion Commission ("Commission") is an
appointed body established to advise the Mayor and City Council on long-range and city-wide
matters related to Parks and Recrearion; and
WHEREAS, Section 13.011 of the City Charter requires that the Commission review any
diversion or disposal of pazk properry and present a recommendation to the City Council; and
WHEREAS, Island Station, LLC ("Island Station") proposes that the City of Saint Paul,
through its Pazks and Recreafion Division, issue a license to Island Station for the construction,
operarion and maintenance of a sanitary sewer under and across city park land abutting Island
Starion's properry at 437 Shepard Road (as shown on the attached Exhibit "A"); and
WHEREAS, the Commission and City Council have previously approved the issuance of a
driveway and utility license on city park land in exchange for a permanent trail easement to be
dedicated on the abutting Tsland Station property (as shown on the attached Exhibit "B"); and
WHEREAS, the appraised market value of the trail easement exceeds the combined
appraised market value of park land diverted for the driveway and utility license and the proposed
sewer license; and
WI�EREAS, any existing trails, trees or other landscaping disturbed as a result of the
driveway construction will be restared at Island Station's expense and in a manner acceptable to the
Division of Parks and Recrearion; now, therefore be it
BE IT RESOLVED, that the Saint Paul Parks and Recreation Commission concurs with the
proposed exchange of a sanitary sewer license on city park land abutting 437 Shepard Road for a
permanent park trail easement on Island Station property at 437 Shepard Road, and in accordance
with City Charter Section 13.011 recommends approval by the Saint Paul City Council.
