Plat Correction for 233 Smith Avenue North
WHEREAS, David Claypool, Zoning File 05-178-232, has submitted for City Council approval the attached
plat correction for the property at the northwest corner of Chestnut and Smith, to be designated as LOTS 12,
13, & 14, BLOCK 65, IRVINE'S ENLARGEMENT OF RICE AND IRVINE'S AD�SCTION TO THE TOWN OF
SAINT PAUL.
WHEREAS, the appropriate City departments have reviewed the plat correction and found, subject to the
recommended conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and
WHEREAS, notice of a pubiic hearing before the City Council was duly published in the o�ciai newspaper
of the City and notices were mailed to each owner of affected property inciuding all property situated within
350 feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat correction on November 16, 2005
where all interested parties were given the opportunity to be heard and the Council considered aIl the facts
and recommendations concerning the plat correction;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached plat
correction for David Claypool at the 233 Smith Avenue North subject to the following condition that the
applicant shall file a copy of the Councii Resolution approving the plat correction with the Ramsey County
Recorders Office.

or disapproving the plat. A staff report will be prepared and provided to the Council the week
prior to the public hearing.

public hearing request wifl appear on the agenda for the November 16, 2005, City Council

B. PARCEL SIZE: Irregular parce(: approximately 135 ft. of frontage on Smith and 135 ft. of frontage
on Chestnut.
C. EXISTING LAND USE: Nasseff Specialty Center (under construction)
D. SURROUNDING LAND USE:
North: Commercial buildings and a parking lot (B5)
East: Parking lot and an apartment building (B5)
South: Parking garage and commercial buiidings (P1)
West: Future site of the Nasseff Specialty Center (B5)
E. ZONING CODE CITATION: §69.301 states thaf platting is required when a.subdivision (1)
creates five or more lots or parcels each of which is 2Y2 acres or less in size, or (2) requires
paved streets, aileys and other public improvements, or (3) is previously unplatted land. §69.406
provides criteria for review of subdivision appiications. These criteria are covered below under
"Required Findings."
F. H(STORY/DISGUSSION: The property at the comer of Chestnut and Smith was platted in the
1851. However, the northeast corner of fhe block was not included on the original plat map, and
the surveyor did not label block 65 or show its interior lot lines. The Ramsey Counfy Surveyor has
appiied for a plat correction to amend the former plat map and clarify the legal description of the
property.
G. DISTRICT GOUNCft RECOMMENDATION: The District 9 Community Councif had not
commented at the time this staff report was prepared.
H. REQUIRED FINDINGS: §69.406 of the Zoning Code requires that al{ of the following findings
shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legisfative Code are complied with. This finding is met.
City staff have reviewed the proposed piat correction and have determined that all applicabie
provisions of city codes are met.
2. The proposed subdivision will not be detrimental to the present and potentia/ surrounding
land uses. The proposed plat correction is consistent with the surrounding land uses, and will
not be detrimental to present and future use of surrounding {and. A new medical facility wi{t
� be built at this site that will work in conjunction with the United Hospitals and Allina Health
Services.

3. The area sur�oundrng the subdivision can be planned and developed in coordrnation arrd
compatibility with the proposed subdivision. The area surrounding the plat correction is
aiready developed and compatible with the proposed plat. Currently, this site is being

4. The subdivision is in conformance with the Comprehensive Plan. The subdivision and
redevelopment of this site is in conformance with the generai polices outlined in the
Comprehensive Plan that call for a safe and vibranf downtown with a mix of uses a�d
services. If aiso conforms with West Seventh/ Chestnut Small Area Plan and Forty Acre
Study (1990) redevelopment plans which encourage the redevelopment of underutilized
parceis (pg. 4).
5. The subdivision preserves and incorporates the site's importanf exisfing nafura/ features
whenever possible. This finding is met. The site is in a fully-developed part of St. Paul with
no remaining natural feafures.
6. Af! land infended for building sites can be used safely without endangering residents by peril
from floods, erosion, continuously high water table; severe soil conditions or other menace.
This finding is met. The site is a flat, fully developed area with no flooding, erosion, high
water tabie or soil condition problems.
7. The subdivision can be economica!!y served with pub/ic facilities and services. This finding is
met. The subdivision can be economically served with pu6fic facilities and services from
surrounding streets. The sife is currenfty under construction and is afready served by pubfic
facilities and services. �
STAFF RECOMMENDATtON: Based on required findings 1 through 7, staff recommends
approval of fhe plat correction to Block 65, Irvine's Enlargement of Rice and frvine's Addition,
subject to the condition that the appiicant shail file a copy of the Council Reso(ution approving
the piat with fhe Ramsey County Recorder's Office.

2. The preparer of the piat of irvines' Enlargement of Rice and Irvine's Addition to the
Town of St. Paui, dated the 19th day of July A.D. 1851 and filed in Book A of Plats, Page
15, did not label 81ock 65 or show its interior tot lines.
3. The plat of Irvines' Eniargement of Rice and Irvine's Addition to the Town of St. Paul
created Blocks �7, 58, 59, 60, 61, 62, 63, 64 and 66. Block 65 was not included in this
sequence.
4. The plaf of Dayton and Irvine's Addition fo Saint Pauf, dated the 23rd day of �
November A.D. 1854 and filed in Book B of Plats, Page 20, which adjoins Irvines'
Enfargement of Rice and Irvine's Addition to the Town of Sf. Paul on the west side, was
also prepared by John T. Halsted, deceased.
5. The numbering and fhe -configuration of the blocks as established in fhe plat of
Irvines' Enlargement of Rice and Irvine's Addition to the Town of St. Paui, extend west of
the Township Line into the plat of Dayton and irvine's Addifion to Saint Paul.
6. Blocks numbered 59 and 64, on each of the two respective plats, adjoin one another.
7. The interior lot lines in Blocks 61, 63 and 64 in the plat of Irvines' Enlargement of
Rice and lrvine's Addition to the Town of St. Paul, extend westerly across the Township
Line, into the adjoining Biocks of the ptat of Dayton and irvine's Addition to Saint Paul.
