05-1154Council File # L'� �` �+� Green Sheet # RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented 3028965 � Referred To U � Committee: Date December 1, 2005 1 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a duplex rental property located at 356 COMO AVE and registered to Juan Rojas; and 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, on June 14, 2005, NHPI conducted an inspection of said properiy and issued a Coaection Order with a compliance deadline of August 1, 2005; and WHEREAS, on October 7, 2005, NHPI conducted a reinspection of said property and found lack of compliance with the previous order; and WHEREAS, on October 10, 2005, NHPI sent the holder of the rental registration certificate for the subject property, Juan Rojas, a$50 excessive consumption bill, addressed to 1396 Midway Pkwy, St Paul MN 55108-2417, the address on said certificate; and WHEREAS, as ofDecember 1, 2005, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on Octoer 10, 2005, NHPI notified Juan Rojas of the need to arrange an interior inspection ofthe subject property; and WHEREAS, as of December 1, 2005, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (rii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on November 17, 2005, NHPI sent Juan Rojas the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Juan Ro}as has not apgealed said notice and the time for filing an appeal has exgired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject properiy at 356 COMO AVE. 1. That the holder of the Rental Registration Certificate for the subject property is Juan Rojas. That said certificate holder has been billed for excessive consumption of code inspection sezvices, which has not been paid. 3. That said certificate holder has been requested to allow an interior inspection of the subject property, wluch has not been arranged. CQ That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal t�as expited without an appeal being made. 5. •�� � The Saint Paul City Council hereby makes the following order: 1. I am writing to you in your capacity as the holder of a rental registration certificate for 356 COMO AVE , St. Paul MN. You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 356 COMO AVE based on the following: 1. 2. 3. 4. 5. 6. On September 28, 2005, this department conducted an inspection of said property and issued a Correction Notice with a compliance deadline of October 3, 2005. On October 3, 2005, this department conducted a reinspection of said property and found lack of compliance with the previous order. On October 4, 2005, this department sent you a$50.00 bill for the cost ofsaid reinspection. As of today this $50.00 has not been paid. On October 4, 2005, this department notified you by mail of the need to arrange an interior inspection of said rental property. As of today this interior inspection has not been arranged. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeai may be filed pursuant to legislative Code § 18.02, by appearing in person between the hours of 8:00 am and 430 p.m on any business day at the City Clerk's Office, Room 110, City Hall, 15 W. Kellogg Boulevazd, St. Paui, MN or you may appeal by mail within the same 13 day time line. a ;;�r�r �:;.�:..�::,z� 05 > ; � Once the City Council has revoked the rental registration certificate, occupancy ofthe property is not allowed until (1) an inspection by Neighborhood Housing and Property Improvement (1VHPI) has been conducted, (2) tne Director ofNHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possble to arrange a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City CouncIl.
