05-1153Council File # � 'S - 1\53 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 Green Sheet # RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented 3028969 2y Referred To � � Coimnittee: Date December 1, 2005 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City Council to hold public hearings to consider the advisability of revoking the rental registration certificate for a duplex rental property located at 666 CENTRAL AVE W and registered to New Vision Investments; and WHEREAS, on May 17, 2005, NHPI conducted an inspection of said properiy and issued a Conection Notice with a compliance deadline ofJuly 31, 2005; and WHEREAS, on September 30, 2005, NHPI conducted a reinspection of said property and found lack of compliance with the previous order; and WHEREAS, on October 3, 2005, NHPI sent the holder of the rental registration certificate for the subject property, New Vision Investments, a$50 excessive consumption bil1, addressed to 863 6th St E, St Paul MN 55106-4542, the address on said certificate; and WHEREAS, as ofDecember 1, 2005, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consuxnption is grounds for certificate revocation; and WHEREAS, on October 3, 2005, NHPI notified New Vision Investments of the need to arrange an interior inspection of the subject property; and WHEREAS, as ofDecember 1, 2005, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the irnposition of an c�cessive consumption fee is grounds for an interior inspection; and WHEREAS, on November 11, 2005, NHPI sent New Vision Investments the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, New Vision Investments has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order conceming the subject property at 666 CENTRAL AVE W. That the holder of the Rental Registration Certificate for the subject property is New Vision Investments. 3. � � 1'hat said certificate holdet has been billed for excessive consumption of code inspection services, wlrich has not been paid. That said certificate holder has been requested to allow an interior inspection ofthe subject property, which has not been arranged. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. � �i� 7 The Saint Paul City Council hereby makes the following order: 1. The above-referenced Rental Registration Certificate issued to New Vision Investments for the duplex rental property at 666 CENTRAL AVE W, Saint Paul, MN is hereby revoked. 2. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 666 CENTRAL AVE W hased on the following: On May 17, 2005, this department conducted an inspection of said property and issued a Correction Notice with a compliance deadline ofJuly 31, 2005 2. 3. 4. 5. 6. On September 30, 2005, this department conducted a reinspection ofsaid property and found lack of compliance with the previous order. On October 3, 2005, this department sent you a$50.00 bill for the cost ofsaid reinspection. As of today this $50.00 has not been paid. On October 3, 2005, this department notified you by mail ofthe need to arrange an interior inspection of said rental property. As oftoday this interior inspection has not been arranged. I have refene3 this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date o f this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the hours of 8:00 am and 4:30 p.m on any business day at the City Clerk's Office, Room 110, City Hall, I S W. Kellogg Boulevard, St. Paul, ?vt!�1 or you may appeal by mail within the same 13 day time line. "���" �-It53 � i Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed ' until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2) the Director ofNHPI has detemvned the property to be in compliance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possbie to arrange a meeting to discuss how to correct this situation before the Citv Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
