05-1088Council File # ' �V 0 2 4 5 6 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 Green Sheet # /,' Presented RESOLUTION CiTf OF SAtNT PAUL, MINNESOTA 3028766 �5 Referred To `� � Committee_ Date November 9, 2005 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City Council to hold public hearings to consider the advisability ofrevoking the rental registration certificate for a duplex rental property located at 44 MANITOBA AVE and registered to Charnell A Hudson; and WHEREAS, on August 29, 2005, NHPI conducted an inspection of said property and found this to be the third violation within a 12 month period; and WHEREAS, on August 31, 2005, NHPI sent the hoider ofthe rental registration certificate for the subject property, Chamell A Hudson, a$50 excessive consumption bill, addressed to 865 Van Dyke St, St Paul MN 55119-3406, the address on said certificate; and WHEREAS, as ofNovember 9, 2005, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on August 31, 2005, NHPI notified Chameli A Hudson ofthe need to arrange an interior inspection ofthe subject property; and WHEREAS, as ofNovember 9, 2005, an interior inspection has not been ananged, and Legislative Code §51.07 (a) (ui) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on October 14, 2005, NHPI sent Charnell A Hudson the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Charnell A Hudson has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order conceming the subject property at 44 MANITOBA AVE . That said certificate holder has been billed for excessive consumption of code inspection services, wluch Y�as not been paid. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, ofthe City's intent to revoke the registration certificate for 44 MANITOBA AVE based on the following; 2. 3. 4. 5. On August 29, 2005, this department conducted an inspection of said property and found this to be your third violation within a 12 month period. On August 31, 2005, this department sent you a$50.00 bill for the cost of said reinspection. As of today this $50.00 has not been paid. On August 31, 2005, this department notified you by mail of the need to azrange an interior inspection of said rental property. As of today this interior inspection has not been arranged. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeal maybe filed pursuant to legislative Code §18.02, by appearing in person between the hours of 8:00 a.m and 4:30 p.m on any business day at the City Clerk's Office, Room 110, City Hall, 15 W. Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line. Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2) the Director ofNHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor.
