1 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental property located at 382 LAFOND AVE and registered to Glenda Spry; and

5 WHEREAS, on July 5, 2005, NHPI conducted an inspection of said property and issued a
6 Correction Notice with a compliance deadline of Ju1y 15, 2005; and

WHEREAS, on August 25, 2005, NHPI conducted a reinspection of said property and found lack
of compliance with the previous order; and
WHEREAS, on August 25, 2005, NHPI sent the holder ofthe rental registration certificate for
the subject property, Glenda Spry, a$50 excessive consumption bi]], addressed to 2215 Como Ave, St
Paul MN 55108-1812, the address on said certificate; and
WHEREAS, as ofNovember 10, 2005, said $50.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate
revocation; and
WfIEREAS, on August 25, 2005, NHPI notified Glenda Spry of the need to arrange an interior
inspection of the subject property, and
WHEREAS, as ofNovemer 10, 2005, an interior inspection has not been arranged, and
Legislative Code §51.07 (a) (rii) provides that the imposition of an excessive consumption fee is grounds
far an interior inspection; and
WHEREAS, on October 14, 2005, NHPI sent Glenda Spry the proper Notice of Intent to Revoke
Rental Registration (copy attached); and
WHEREAS, Glenda Spry has not appealed said notice and the time for filing an appeal has
eapired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order conceming the subject property at 382 LAFOND AVE .
That the subject property is a dupl� rental property that is required to be registered with
the City's Rental Registration Program

2. That the holder of the Rental Registration Certificate for the subject property is Glenda
Spry.

The Saint Paul City Council hereby makes the following order:

That said certificate holder has been billed for excessive consumption of code inspection
services, wluch has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject property, wluch has not been arranged.
That the notification requirements of Chapter 51 have been fulfilled and the tune for an
appeal has expired without an appeal being made.
The above-referenced Rental Registration Certificate issued to Glenda Spry for the duplex
rental property at 382 LAFOND AVE, Saint Paul, MN is hereby revoked.
It is further ordered that a copy of this resolution be mailed to Glenda Spry .

I am writing to you in your capacity as the holder of a rental registration certificate for 382 LAFOND AVE,
St. Paul MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 382 LAFOND AVE based on the following:
On July 5, 2005, this department conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of July 15, 2005

On August 25, 2005, this depaztment conducted a reinspection ofsaid property and found lack of
compliance with the previous order.
On August 25, 2005, this department sent you a$50.00 bill for the cost of said reinspection.
As oftoday this $50.00 has not been paid.
On August 25, 2005, this department notified you by mail of the need to arrange an interior
inspection ofsaid rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeat is filed in the ne�R thirteen (13) days from the date of
tlus notice. An appeal may be filed pursuant to legisiative Code § 18.02, by appearing in person between the
hours of 8:00 a.m and 4:30 p.m on any business day at the City Clerk's Office, Room I 10, City Hall, 15 W.
Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line.

Once the City Council has revoked the rentai registration certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2) the
Director of NHPI has detemvned the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possble to arrange a meeting to discuss how to conect this situation before the City
Council acts to revoke this certificate. If all assues are addressed, I will recommend that the revocation be
withdrawn from wnsideration by the City CounciL
