WHEREAS, on September 21, 2005, the Saint Paul City Council adopted Council File 05-881, Ratification of Assessments
for Property Cleanup during April, May, June 2005 (File No. J0503A, Assessment No. 8071);
WHEREAS, on October 19, 2005, the Saint Paul City Council adopted Council File OS-979, Rafificafion of Assessments
for Property Cleanup during June and July 2005 (File No. 70504A, Assessment No. 8115);
WI�REAS, the properry at 476 Minnehaha Avenue East being described as Subdivision of and Addition to Irvine's
Addition of Out Lots to Saint Paul, West 48 Feet of Lot 1 Block 1, with the Properry Identification Number 32-29-22-21-
0063, was assessed amounts of $521 and $220 respectively;
WIIEREAS, the former owner died on June 30, 2004, and minor children inherited the properry; and
WHEREAS, there were difficukies in providing proper legal notification of the nuisance conditions leading to the
abatements due to the death of the former owner;
THEREFORE, SE IT RESOLVED, that the Legislative Heazing Officer recommends deleting the amount of these two
assessments; and
BE IT FiJKTHER RESOLVED, that the reduction of $741 be funded by the Exempt Assessment Fund.

Per our telephone conversation on Thursday, September 29�`, I am writing you to appeai the two
sununary abatements far the property located at: 476 E. Minnehaha Ave, Saint Paul, MN 55101.
I was not even aware of such notices from the city, until the house was cleaned up prior to the
sale of the home on September 26th. As you (City of St. Paul) may or may not know, the
property owner, Seng Yang, had deceased on June 30, 2004.
There has been a tenant, Ye Her that resided in the property after his death. It has been a very
long struggle to obtain any kind of cooperation from this individual to secure rental payments.
There is a probate case registered with the county of Ramsey, court file #62-PR-04-5752,
effective September 21, 2004. Due to the sensitivity of this matter, I was not able to neither
maintain the property nor obtain mailings that were sent to the property owner. I was able to add
a forwarding address for all of the creditors and vendors. However, I wasn't able to setup the
forwarding for all entities, due to the ownership condition of the property.
Since Ye Her had some minor children of Seng living in the home, there were many legal steps
and procedures that needed to be taken before I could force them out of the home. She was
finally evicted to move out of the property by the end of Monday, September 19 It was shortly
after that time, I was able to hire some workers to clean the interior and exterior of the home. It
is also a result of the cleaning, that I was able to gather these 2 summary abatements for the City
of St. Paul.
Consequenfly, the Estate of Seng Yang, as a result of the property sale, is paying these fees.
Some of these uncontrollable circumstances prevented me from ever seeing these notices. If
these notices were able to reach me prior to the performed service/acrions, these fees most
defmitely wouid have been avoided. In conclusion, I am asking you to waive these fees, as it
will cause a financial hardship far Seng's surviving minor children.
