05-105Council File # l)�� `� RESOLUTION Green Sheet # OF SAlIVT PAUL, MINNESOTA Presented Re£erred To 1� Committee: Date January 24, 2005 1 WF�REAS, Neighborhood Housing and Properiy Improvement (NHPI) has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 far a duplex rental properry located at 507 MINNEHAHA AVE E and registered to Aluned Elyamani; 4 and WHEREAS, on October 25, 2004, NHPI conducted an inspection of said property and issued a Correction Notice with a compliance deadline of November 15, 2004; and WHEREAS, on December 8, 2004, NHPI conducted a reinspection of said properiy and found 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 lack of compliance with the previous order; and WHEREAS, on Decemer 14, 2004, NHPI sent the holder of the rental registration certificate for the subject properiy, Ahmed Elyamani, a$75 excessive consumption bill, addressed to 7845 East River Road, Fridley MN 55432, the address on said certificate; and WHEREAS, as of January 24, 2005, said $75.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on December 14, 2004, NHPI notified Aluned Elyamani of the need to arrange an interior inspection of the subject property; and WHEREAS, as of January 24, 2005, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (aii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, as of January 24, 2005, code violations remain uncorrected and by Legislative Code §51.06 (a) vi provides that non-compliance with the code is grounds for certificate revocation; and WHEREAS, on January 7, 2005, NHPI sent Ahined Elyamani the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Aluned Elyamani has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject properry at 507 MIl�NEHAHA AVE E. 3024997 � z 3 4 5 6 7 S 9 10 il 12 13 14 15 16 17 18 19 20 21 22 23 24 25 2. 05-1�5 That the subject properry is a duplex rental property that is required to be registered with the City's Rentai Registration Program. That the holder of the Rentai Registration Certificate for the subject property is Ahmed Elyamani. That said certificate holder has been billed for excessive consumption of code inspection services, which has not been paid. That said certificate holder has been requested to a11ow an interior inspection of the subject property, which has not been arranged. That code violations remain uncorrected at the properry. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 507 MINNEHAHA AVE E based on the following: On October 25, 2004, this department conducted an inspection of said property and issued a Correction Nofice with a compliance deadline of November 15, 2004. 2. 3. 4. 5. 6. 7. 8. On December 8, 2004, this departrnent conducted a reinspection of said property and found lack of compliance with the previous order. On December 14, 2004, this department sent you a$75.00 bill for the cost of said reinspection. As of today this $75.00 has not been paid. On December 14, 2004, this department notified you by mail of the need to arrange an interior inspection of said rental property. As of today this interior inspection has not been arranged. On January 3, 2005, this department conducted a reinspecdon of said properry and found lack of compliance with the previous order. On January 4, 2005, this department sent you a$150.00 bill for the cost of said reinspection, notifying you of the next scheduled reinspection on January 24, 2005. AA-ADA-EEO Employer 9. As of today there aze still outstanding code violations that have not been conected. �,-tos I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person beiween the hours of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W. Kellogg Boulevazd, St. Paul, NIN or you may appeal by mail withiu the same 13 day time line. Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed until (1) an inspection by Neighborhood Housing and Properry Improvement (NHPn has been conducted, (2) the Director of NHPI has determined the properiy to be in compliance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to conect this situation before the City Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocafion be withdrawn from consideration by the City Council.
