The building and garage constitute ' a nuisance and a hazard to the public health, � safety and welfare because of the damage, � dilapidation and inadequate maintenance; ; now, therefore� be it RESOLVED, That in accordanee with Minnesota Statutes Section 463.15 through 463.26, and based upon the foregoing findings of ' the City Council� the Council of the City of Saint Paul does hereby make the following Order: � ORDER , 1. The owners of the above-described building and garage shall make the same safe and not detrimental to the public health� ,safety and welfare by having the said building and garage razed and the materials therefrom _removed from the premises within thirty (30� days from the date of the service of this Order� or� in the alternative, begin to correct the hazardous conditions within , . thirty (30) days from` the date of the service of this Order by co`rrecting the following conditions: s +. , • ' r .; I5.... • " ' i , ; "� � , j ,, '. � . , 1-.,� � . � ��3°7�� � , � i � f � � � � i ' i Page 4. � a. If the building is to be used for human i habitation, all of the above defective conditions must be corrected; and the wiring, plumbing and � � heating systems must be brought up to standard to comply with the Saint Paul Housing Code and the � � Saint Paul Building Code requirements; and further � that the owners submit a list of intended corYections � ��K� .. , regarding tYie structural condition of the building, - the electrical and. ,the heating system, together with � � � a sched�.le for the completion of the rehabilitation - � program and that the owners apply for the necessary � permit in the office of the City Architect within � thirty (30)� days �from the date of the service of this Order. 2. IInless such corrective aetion is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the office of the Clerk of the District Court of � Ramsey County, Minnesota� within twenty (20) days from the date � of� the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court. � 3. In the event that the building and garage are to be ra�zed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of �udgment; and if not so removed� the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law. , rr . Kelly � County Auditor � 132 City Hall . Saint Paul, Minnesota 55102 Legal description of the property is Lot 27, Block 8, ' Mackubin and Marshall�"s Addition to Saint Paul. The property . � consists of a single-family frame dwelling approximately 20 ft. wide �- _ f and 45 ft. deep, 18 ft. high with an adjacent but detached garage � � { of clay tile constructi.on, 12 ft. wide and 18 ft. long. The properties � are vacant, standing open, and have been subjected to extensive ; � vandalism. The condition of the properties is as follows : � � EXTERIOR � � • The parts of the cornice boards are missing, the gutters ' � have rusted through and are hanging loose, the windowsills are rotted � � ! � - I � � w � Hon. Byrne, Mayor and Members of the City Council -2- May 23, 1967 ; and deteriorated, the siding is rotting and deteriorating, the exterior trim boards below the siding are rotting, the tront brick I and concrete steps and a retaining wall at the front of the property have deteriorated. B�►S EMENT The stairway to the basement is in a hazardous conditian. There is an open sewer in the basement. The foundation walls are in a dilapidated condition with the mortar joints eroding and some of the foundation stones have fallen from the wall. The first floor joists, where they rest on the foundation, are rotted, and there is evidence that the subfloor is also rotting. The supporting posts and beams are rotting, the basement has only a partial concrete floor with most of it just dirt. The portion that is concrete is badly broken. FIRST FLOOR The first floor consists of six rooms and bathroom with a brick- enclosed porch. The flooring has buckled, and there is a large hole in the p�.astered ceiling above the kitchen sink. The flooring in the bathroom has rotted and the ceiling tile is falling from the front bedroom. ATTIC The stairway skirt has been pulled from the wall and the s-tair treads are loose from the rough stair horses, creating a hazardous � condition. The window frames are coming apart and some time ago • there was a fire that did the damage to the attic and was never repafred. PLUMBING The plumbing has been shut off. There is an uncapped pipe in the kitchen and there are exposed gas pipings in the bedrooms. ELECTRI�� The outl'et boxes have been pulled from the wall. The meter has been broken. The conduits feeding the basement stair light have been partly pulled away. � ACCESSORY BUILDING � The 12x18 clay tile garage has the front and rear 8 ft. wide doors ' broken and dilapidated and the garage is littered with debris. i � If it is the opinion of the owners of this property that it can be rehabilitated, it will be necessary that they submit the list of the corrections that they propose to make regarding the structural condition of the building, electrical, plumbing and heating systems, with a schedule for the completion of the rehabili- tatio,n program along with the application f or the permits. In the meantime, it will be necessary that the property be properly secured so as to prevent entrance by unauthorized persons and all combustible materials removed from the interiors of the structures. Byrne, Mayor � _ • and Members of the City Council -3- May 23, 1967 alternative is not taken, it is the conclusion of the Bureau of Public Buildings that by reason of inadequate maintenance, dilapidation, physical damage, unsanitary condition and abandonment that this building constitutes a hazard to public health, safety � and welfare. It is the further recommendation of the City p►rchitect ! that the Council concur in this conclusion and refer the matter to , the City Attorney�s office for preparation and submission of this E condemnation to the District Court and the completion of the � condemnation proceedings.
