- In the Matter of a hazardous building being `
that two story frame dwelling known and described -
as 114 Lyton Place in the City of Saint Paul and '
situated upon those premises legally described as '�
, Lot 9, Block 3, Lytons Addition to St. Paul, Minn. , �
according to the plat on file and of record in
the office of the Register of Deeds in and for '
the County of Ramsey� State of Minnesota.

WHEREAS� Pursuant to resolution� C. F. 233323, approved
May 3� 1967� a public hearing was duly held on Tuesday� May 23, i
1967, before the Council of the City of Saint Paul� said hearing
pertaining to the condition of the structure located at 114 Lyton
Place� Saint Paul� Minnesota� and �
WHEREAS� Upon the facts presented at the said hearing� ,
consisting of photographs� inspection reports and the recommenda- ,
tion� of the City Architect� it is found and determined by the
• City Council that according to the records and files in the
office of the Register of Deeds, the last record owners of the
' above-described property are Eugene R. Shields and Joan M. Shields,�
and that there are no other- lien holders of record� that it is
further determined that the above-described building eonstitutes
. a hazardous building within the definition of Minnesota Statutes" �
. Section 463.15 for the following reasons: �
a. The building is standing vacant and
open and is sub�ect to vandalism;
b. The exterior of the building is in
poor condition in that the siding is partially '
missing� the rear porch has been removed and a ,
1x14 foot square hole remains in the foundation�
and the �ear �.doors and the windows are missing�

c. The wood joists supporting the first
floor are rotted where they bear on the founda-
tion walls, the limestone foundation is badly
eroded and the mortar is deteriorated in the •
�oints� the plumbing fixtures are missing
throughout the building, the floors sag and ,
buckle� all the windows are missing, there are
holes in the plaster, the interior doors and . �
interior trim have been removed� the plaster in
the stairwell has fallen down� the stairway �
railing is missing� the stairway to the attic is
� partially torn out, the electrical fixtures and
the heating system have been removed from the
building, and the building is littered with
combustible debris;

d. The rear yard is littered with a con-
siderable amount of debris;
� e. The building is unfit for human habita-
tion in- its present condition� and the above
corrections must be made in compliance with the �
Building and the Housing Codes of the City of
Saint Paul in order to make the building habitable;
f. The building in the above eondition
constitutes a nuisance and a hazard to the public
health, safety and welfare because of its physical
damage� dilapidation and inadequate maintenanee;
now, therefore� be it
RESOLVED, That in accordance with Minnesota Statutes� Section
463.15 through 463.26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby make
the following Order:

ORDER
1,. The owners of the above-described building shall make
the same safe and not detrimental to the public health� safety .
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order� or, in the alternative�
begin to correct the hazardous conditions with�n thirty (30) days
from the date of the service o this Order by correcting the
following hazardous conditions:
a. � Remove all paper and other combustible
materials from the b uilding and outside of the
, . building, and securely elose and keep closed all
. . doors, windows or other ipenings in the building;
� ���T b. If the building is to be used for human
�. . •�,
t`"� habitation, all of the above defective conditions
�, ;
__- must be corrected and the wiring, plumbing and �
heating systems brought� up '�o comply with��the � � �
Saint Paul Housing Code and the Saint Paul
Building Code requi'rements, and that the owners
submit a list of intended _corrections regarding
the structural condition of the building
., electrical and heating system, together with a
schedule for the completion of the rehabilitation
program and that the owners apply for the necessary
permit or permits in the office of the City
. Architect within thirty (30) days from the date
of the service of this Order.
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the office of the Clerk of the District Court of Ramsey
County, Minnesota� within twenty (20) days from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said bu.ilding will be made to the
Ramsey County District Court. ' r

3. In the event that the building is to be razed by the
Citp of Saint Paul pursuant to �udgment of the District Court� '
all personal property or fixtures which may unreasonably
interfere with the razing and removal of this building shall
be removed within ten (10) days from the entry of �udgment�
and if not so remo�red, the City of Saint Paul shall remove and �
dispose of such personal property and fixtures as provided by
law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs �expended by the
. City will be assessed against the above-described real estate
and collected as other taxes;

Gentlemen: �
Following is the report of the Building Department on - �
the condition of the property known as 114 Lyton Place. The owners i
of record are Eugene R. and Joan M. Shields, 1834 Dodd Road. The �
legal description of the property is Lot 9, Block 3, Lytonts Addition j
to Saint Paul. The condition of the property is as follows: i
The building is a two-story dwelling of wood frame con- �
struction, approximately 30 ft. wide, 54 ft. long and 22 ft. high.
The building is vacant, standing open, and has been subjected to �
extensive vandalism. i
. �
THE EXTERIOR ',
The side is in very poor condition and has approximately i
. � 175 sq. ft. missing. The rear porch has been removed and has left �
a 1x14-ft. square hole in the foundation. Two rear doors have
been removed and all the windows are missing. !
THE BASEMENT ' I
There is only a half excavation for basement, and it �
has a dirt floor. The windows are broken out and removed. The access '
to the basement area is through a trap door in the basement stairs. r
The stairs are in poor condition. There is evidence that the wood �
joists supporting the first floor are rotted where they bear on the '
foundation walls. The limestone foundation is badly eroded with the �
mortar deteriorated in the joints. � �
THE FIRST FLOOR �
The first floor contains £our rooms and bath. There are �
no plumbing fixtures in the bathroom. All the floors have sagged and '
buckled. All windows are missing. There are large holes in the .
plaster throughout the entire floor. The interior doors and all the !
interior trim have been removed. I

THE SECOND FLOOR
• The second floor contains five rooms��and b�th. Approx- ;
imately 50 sq. ft. of .plaster has fallen down in the stairwell. The �
windows, doors and the trim have all been removed. The floors are �
sagging. There is approximately 160 sq. ft. of plaster fallen in the
other rooms. The remaining plaster is in a badly cracked and loose �
condition. The stairway railing has been removed.
THE ATTIC �
The attic contains just a crawl space. The stairway
to the attic is approximately one�fourth torn out.
PLUMBING
There are no plumbing fixtures on the first or second ,
floors. They have all been removed. j
ELECTRICAL i
There are no electrical fixtures remaining on the first ,
or second floors and there is no heating system in the building. ;
The rear yard is also littered with considerable debris. i
If it is the opinion of the owners of this property that ,
it can be rehabilitated, it will be necessary that they submit a list
of the corrections that they propose to make regarding the structural ,
condition of the building, and the electrical, plumbing and heating
systems, plus a schedule for the completion of the rehabilitation ,
program and an application for the permits. '
In the meantime it will be necessary that the property ;
• be secured in such a fashion so as to prevent entrance by unauthorized'
persons and all combus�ible materials be removed from the interior
of the structure. If this alternative is not taken, it is the !
conclusion of the Bureau of Public Buildings that by reason of ;
inadequate maintenance, dilapidation, physical damage and unsanitary '
conditions and abandonment, this building constitutes a hazard to '
public health, safety and welfare. It is the further recommendation
of the City Architect that the Council concur in this conclusion,
refer the matter to the City Attorney�'s office for preparation for I
submission of this condemnation to the District Court and the completion
of the condemnation proceedings. I
