That permission and authority are hereb.y granted to Meldrum Manufacturing & Engineering Co. to pave a ten foot wide strip on the north side of Gilbert Avenue from Cleveland Avenue west for approximately 450 feet. Section 2. That the Commissioner of Publie Works is hereby � authorized to issue a permit to Meldrum Manufacturing & Eng3.neering Co. for the paving of the ten foot wide strip on the north side of ', Gilbert Avenue from Cleveland Avenue west for approximately 450 feet� subject to its compliance with the following terms and conditions: , . � a. Said permittee shall pave said ten foot wide , � strip on the north side of Gilbert Avenue entirely � at its own expense� under the supervision and to the satisfaction of the Commissioner of Publie Works and � in accordance with the plans and specifications of ; the Department of Public Works. � � b. The_engineering department of the City of � I Saint Paul shall establish the necessary elevations • and profiles for said street. c. Said permittee expressly agrees and under- takes to fully indemnify and hold harmless the City of Saint Paul, its agents� officers and �employees, from any and all damages, claims, losses, jndgments, suits or egpenses arising out of or occasioned by the performance of the work contemplated by this permission and authority. , g. Said permittee shall not proceed to pave said ten foot wide strip on the north side of Gilbert Avenue unless and until said permittee has fully complied with 'the provisions regarding insurance and indemnification contained in the Citp of Saint Paul, Department of Public Works Speeifica- • tions for Street and �ewer �onstruction, dated April ' 1, 1959, as amended, Seetion 1.4r+� and found on - pages 1-13 through 1-17 of said specifications applicable to contractor. For the purposes of this , ordinance, the aforesaid Section of said specifica- , tions numbered 1.4f+ shall be read as though the � word "permittee" were substituted for the word "eontractor�� wherever the same appears in the afore- said Section 1.44. Said. Section 1.�+ of the • Specifications for Street and Sewer Construction in � the City of Saint Paul is hereby incorporated herein by reference as fully and as completely as if set forth herein verbatim. Proof of compliance with the provisions of the aforesaid Section 1.44 shall be in such form as the Corporation Counsel of the City of Saint Paul may direct, and the documents required by _ the aforesaid Section 1.44 shall� lafter submission. to the Corporation Counsel, be filed in the office �r�- of the Comptroller of the City of Saint Paul. h.
