In the Matter of a hazardous buildi.ng being •
that two story frame dwelling and frame garage known
and describe'd as 461 Dayton Avenue in the City of
Saint Paul and situat�d upon those premises legally '
described as Lot 24� Block 1� "Selby, McClung and
Vanmeter' s°° Addition to Saint Paul� according to
the plat on file and of record in the office of the
Register of Deeds in and for the County of Ramsey�
State of Minnesota. �
WHEREAS� Pursuant to resolution� C. F. 2331.96, approved
April 26, 1967, a public hearing was duly held on Friday� May 12,
1967� before the Council of the City of Saint Paul� said hearing
pertaining to the eondition of the structure located at 461
Dayton Avenue� Saint Paul, Minnesota; and
WHEREAS� IIpon the facts presented at the said hearing� con-
- sisting of photographs� inspection reports and the recommendation
of the City Architect� it is found and determined by the City
Council that according to the records and files in the office of
the Regis�Ger of Deeds, the last record owners of the above-
described property are George L. Berglin and Dorothy R. Bergli�.;
that Northern Federal Savings and Loan Association is the
mortgagee; and that there are no other lien holders of record; .
that it is further determined that the above-described building
constitutes a hazardous building within the definition of
. Mirin.esota Statutes Seetion 463.15 for the following reasons:
a. The building is standing vacant and open
and is vandalized;
� b. The exterior of the building is dilapidated in
that the chimney mortar �oints are rotted� chimney
bricks are loose, the asphalt siding is hanging loose,
cornice members are rotten and in danger of falling
. and the porches and steps are rotten;

tion are badly eroded windows are broken, and the
basement stairway is �n a dangerous condition; �
floors are rotting, plaster is cracked and fallen
-,� off; the plumbing is ripped from the walls and
removed from the premises� radiators are missing,
and the electrical wiring throughout the building
is unusable�
d. The garage roof is rotten and sagging, '
the walls are bulging out, the siding is rotten, • � '
and is beyond reasonable repair; '
e. The building is unfit for human habitation � �
in its present condition, _and the�,above corrections - i
. ,,,,_ ,. must be made -in comp7:iance with the Building Code '
� �� and the Housing Code of the City of Saint Paul in
order to make the building habitable;
f. The building and garage constitute a � ,
nuisance and a hazard to the public health� safety .
and welfare because of their physical damage, -
dilapidation and inadequate maintenance; .
now, therefore� be it '
RESOLVED� That in accordance with Minnesota Statutes Sections
463.15 to 463.26� and based upon the foregoing findings of the City�
Council, the Council of the City of Saint Paul does hereby make the �
following Order:

ORDER
1. The owners of the above-described building shall make the�
same safe and not detrimental to the public health, safety and �
welfare by having the said building razed and the materials there- _
from removed from the premises within thirty (30) days from the
date of the service of this Order, or, in the alternative, begin � �
to correct the hazardous conditions and conEet the hazardous
conditions by _doing the following: �'!� `

a. Remove all paper and other combustible
materials 'from the building and securely close
and keep elosed all doors� windows or other
openings in the building;
b. If the building is to be used for human
habitation, all of the above defective conditions
must be eorrected and the wiring, plumbing and
heat�.ng systems brought up to comply with the •
Saint Paul Housing Code and the Saint Paul
Building Code requirements, and that the owners .
submit a list of intended corrections regarding � �
the structural condition of the building -
electrical and heating system, together with a
schedulefbr the completion of the rehabilitation
program and��that the owners applp- for the°�necessary �
permit in the office of the City Architect within
the thirty (30) days imposed herein;
c. WreEk and remove the garage within thirty �
(30) days from the date of the service of this � �
Order. . ;
2. Unless such eorrective action is taken to comply with this
Order or an answer served upon the City of Saint Paul and filed in'
the office of the Clerk of the District Court of Ramsey County, ;
Minnesota, ��within twenty (20) days from the date of the service of
this Order, a Motion for Summary Enforcement of this Order to raze �
and remove the said building will be made to the Ramsey County �
District Court. �

, 3. In the event that the building is to be razed by the ; �
City of Saint Paul pursuant to �udgment of the District Court, �
all personal property or fixtures whieh may unreasonably
interfere with the razing and removal of this building shall f '
` be removed within ten (10) daps from the entry of judgment; '
and if not so removed, the City of Saint Paul shall remove and
disgose of such personal property and fixtures as provided by
law. ,

Gentlemen: .
The following is a report of the Building Department on the �
condition of the property known as 461 Dayton Avenue. The owner
of record is George L, and Dorothy R. Berglin, and the following .
appears to have an interest: Northern Federal Savings and Loan -
Association, mortgagee:
The legal description of the property is Lot 24, Block 1, Selby,
McClung and Van Meter' s Addition to Saint Paul.
Our inspectors have reported that this property is a three-family
residence building of frame construction, two stori�s in height,
approximately 20 feet wide, 48 feet long and 28 feet high; is
vacant, is standing open, has been extensively damaged by vandalism,
and is presently in a dilapidated condition. A three-car frame
garage at the rear of this property also is in a dilapidated -
condition.
The fo�llowing speciaT items were reported by the inspector:
EXTERIOR
The chimney mortar joints have deteriorated and there are loose
bricks in the chimney. The asphalt siding is hanging loose in
places, the cornice members are rotten, hanging loose and are in
danger of falling. All of the porches are rotten, as are the steps.�
BASEMENT
The mortar joints in the limestone foundation are badly eroded, the •
windows are broken and the stairway is in a dilapidated and dangerous
condition.
FIRST FLOOR
The first floor contains four rooms and bath. All of �'tl�e floors have

been damaged by the elements and are rotting. The windows are
broken out, the plaster is cracked and has fallen off in many areas7
SECOND �LOOR
The second floor contains five rooms and two baths. Al1 of the
floors have been damaged by water and are buckling. Th.e plaster
is loose and falling, and the windows are broken. �
The pl�zmbing has been stripped from the'_walls and removed from
the premises. The electrical system is unusable -- much of it
has been torn from the walls. The heating was by hot water with �
radiators, and the radiators have been removed from the builditig.
ACCESSORY BUILDiNG
The accessory building consists of �.an 18 foot by 28 foot garage_. �
The roof of this building is rotten and sagging. The walls are
bulging out, the siding is -rotten, and the building is beyond
reasonable repair.
If it is the opinion of the owners of this property that it can
be rehabilitated, it will be necessary that they submit the list
of the corrections they propose to= make regarding the structural
condition of the building, electrical, plumbing and heating
systems, with a schedule for the completion of the rehabilitation
program, along with the application for the permits. In the meantime,
:it will be necessary that the property be properly secured so as
to prevent entrance by unauthorized persons, and that all combustible
materials be removed from the interior of the structures.
If this alternative is not 'taken, it is the conclusion of the Bureau,
of Public Buildings that by reason of inadequate maintenance,
dilapidation, physical damage, unsanitary condition and abandonment
that these buildings constitute a hazard to public health, safety
and welfare. It is the further recommendation of the City Architect
that the Council concur in this conclusion and refer this matter to
the City Attorney' s office for preparation for submission of this �
condemnation to, .the District Court, and the completion of the
condemnation proceedings.
