In the Matter of a hazardous building being
� that one and one-half story frame dwelling known
and deseribed as 908 Selby Avenue in the City of
Saint Paul and situated upon those premises
' legallp described as Lot �, Block 3� Brown' s
First Addition to the aitp of St. Paul Ramsey
Co. Minnesota� accarding to the plat on file
and of record in the office of �he Register of
Deeds in and for the Co�nty of Ramsey� State of
Minnesota.
WAEREAS, P�rsuant to resolution� C. F. 233195, aPProved
April 26, i967, a public hearing was duly held on Wednesday� May
10, 1967, before the Council of the City of Saint Paul, said
hearing pertaining to the condition of the structure loeated at
908 Se1by�Avenue, Sain� Paul, Minnesota; and
� 'ir7FiEREAS, Upon the facts presented at the said hearing�
consisting of photographs� inspection reports and the recommenda-
� tion of the City Architeet, it is found and determined by the
� City Council that aecording to tY�e records and files in the
� offi�e of the Register of Deeds, the last record owner of the .
a ove-described property is Michael J. Kelly and tha�G there are
� � no othe� lien holders of reeord; that aceording to the records �
° o on file with the Clerk of Probate Court in and for Ramsey County�
o < Miehael J. Kelly is deeeased Donald L. Lais being administrator
� o� for the� estate and John R. �'erson being attorney for said estate
�� of Michael J. Kelly; and said records further disclosing that the
following persons are the living children of said Michael J. Kelly:
Ann L. Kelly� Marie Kelly� Mrs. Eileen Manton� Michael J. Kellp, J'r. ,
rs. Margaret Dowling� Marian Kelly� Mrs. Lorraine Gillespie and
John P. ISelly; egamination of the records of the Ramsey �ounty �
� � uditor discloses that the real estate taxes for the years 1961
�� through� 1967__are delinquent; the Couneil further finding that the
above-described building constitutes a hazardous building within
the definition of Minnesota Statutes Section 463.15, �or tYi�

a. The building is standing vacant, open and
is apparently abandoned;
b. The wood siding is deteriorated� the front
porch supports have been removed, t�e wood sill
supporting the rear of the building is rotted,
there is water standing in the basement floor,
wood �oists bearing on the limestone foundation
is rotted, the floors in the first and second
floor have heaved� plaster is cracked and
falling, plumbing broken out and windows are
broken and rotting;
c. The interior of the building is littered
with combustible material;
d. The building is unfit for human.habitation
in its present condition; �"�`�-�-
e. The building in the above condition is
beyond reasonable repair; '
' f. The building constitutes a nuisance and a
hazard to the public health, safety and welfare
because of its physical damage, dilapidation and
inadequate maintenance;
now� therefore� be it .
RESOLVED� That in accordance with Minnesota Statutes Section
463.15 to 463.26, and based upon the foregoing findings of the
Citp Council� the Council of the City of 'Saint Paul does hereby
make the following Order:
ORDER ,

• 1. The owners of the above-described building, or any person�
t having an interest therein� shall make the same safe and not detri-
mental to the public health, safety and welfare by having the said
building razed and t�e materials therefrom removed from the premises
` withir� twenty (20) days from the date of the service of this Order,
or, in the alternative, begin to correct the above-descri�ed hazard-
ous conditions within twenty (20) days from the date of the serviee
, of this Order. _
