2 WHEREAS, Anvil Properties, Ina, d!b(a The Foundry Pub, located at 1201 Jackson Street, in Saint Paul,
3 has requested a waiver of the 45-day waiting notice requirement for issuance of Gambling I,ocation, Liquor On
4 Sale, Sunday Liquor On Sale, Restaurant B and Alann Permit licenses; and
6 WHEREAS, the District 6 Plamiiiig Council, Land Use Task Force voted nna�nimously to approve waiver
7 of the 45 day waiting period for The Foundry Pub; and

9 WHEREAS, the City Council finds that the application is in order and there are no grounds for denial of
10 the license and that failure to grant the waiver arAd the consequent delay in approving the license would cause
11 exceptional and unusual hardship to the license applicant; and

WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of the 45-
day period and the complaint provides a basis for adverse action against the license, the Office of License,
Inspections and Environmental Protection may direct the licensee to immediately discontinue all operations unril
a public hearing is scheduled, and that the licensee shall comply with said directive; now, therefore, be it
RESOLVED, that the 45-day notice requirement of Section 409.06 of the Saint Paul Legislative Code is
hereby waived and the of Gambling Location, Liquor On Sale, Sunday Liquor On Sale, Restaurant B and Alarm
Perrnit licenses are hereby issued to Anvil Properties, Inc. d/b/a The Foundry Pub, located at 1201 Jackson Street, subject
to the agreement stated a6ove.

Chapter 409 of the Saint Paul Legislative Code requires all property owners witliln 300 feet to be notified of new liquor related license
applications: Chaptez 409 also allows the City Council to waive this iequirement if the dishict council approves of the waivez. In tlus
instance, ffie Distdct 6 Planuing Council Las agreed to the waiver of the notice requirements.

Dear License, Inspections, and Environmental Protection [LIEP]/BZA:
On September 22, 2004, the District 6 Planning Council Land Use Taskforce met and
voted unanimously to approve waiver of the 45-day waiting period for liquor license for
Foundry Pub, requested due to change in ownership.
