In the Matter of a hazardous building being
that one and one-half story wood frame dwelling
known and deseribed as 53 Lyton Place in the City
of Saint Paul and situated�upon those premises
legally described as Lot 8, Block l, Lytons
Addition to St. Paul� Minn. , aecording to the
plat on file and of record in the office of the
Aegister of Deeds in and for the County of
Ramsey� S�ate of Minnesota.
WHEREAS� Pursuant to resolution� C. F. 232969, approved
April 12, 1967� a public hearing was duly held on Thursday�
April 27� 1967� before the Council of the City of Saint Pa�l�
said hearing pertaining to the con4dition of the s�ructure
loeated at 53 Lyton Place, Saint Paul, Minnesota� and
WHEREAS� IIpon the facts presented at the said hearing�
consisting of photographs, inspection reports and the recommenda-
tion of the �ity Architec�G� it is found and determined by the
City Council that according to the records and files in the office
of the Register of Deeds� the last record owner of the above-
described propertp is Eugene J. Schway; that Minneapolis Savings
and Loan Association is the mortgagee; and that there are no other
lien holders of record; that it is further determined that the
above-deseribed building constitutes a hazardous building within
the definition of Minriesota Statutes Section 463.15 for the
following reasons: -
a. The building is standing vacant� open
, and readily aecessible to unauthorized people;
b. The egterior of the building is out of
plumb, composition siding is in r�eed of repair,
the cornice is rotted all windows are broken
out, the rear porch p�latform is hazardous� the

roof sags, chimney brieks are missing, and
the pard is littered with debris;
c. The first floor �oists and posts
are rotted, the floors and ceilings sag,
the plaster is cracked, the pl�mbing �
fixtures are missing, and there are holes
in the f loors;
d. The interior of the building is
littered with combustible material;
e. The building is unfit for hwnan
habitation in its present condition, and
the above corrections must be made in � �� � -� t
compliance with the B�.ilding Code and the
Housing Code of the City of Saint Paul in
order that the same be habitable;
' - f. The building constitutes a
� nuisanee and a hazard to the public health�
safety and welfare because of its physical
damage� dilapidation and inadequate mainten-
ance;
g. The building in the above condition
is beyond reasonable repair;
now, therefore� be it '
RESOLVED, That in accordance with Minnesota Statutes Sections
463.15 through 463.26 and based upon the foregoing finding�� the
Council of the City of Saint Paul does hereby make the following
Order:

ORDER
1. The owner of the above-described building shall make
the same safe and not detrimental to the pablic health, safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order� or, in the alternative� _
begin to correct the above hazardo�s conditions within thirty
(30) daps from the receipt of this Order by doing the following:
a. Remove all paper and other combustible
materials from the building and securely close
and keep closed all doors, �indows or other
openings in the building;
b. If the building is to be used for human
habitation, all of the ab�ove- d-efeetive conditions
m�.st be corrected and the wiring, plumbing and
���..�_ _ heating systems brought up to comply with the
�aint Paul Housing Code and the Saint Paul
B uilding Code requirem�nts, and that the owner
submit a list of intended corrections regarding
the structural condition of the building
. eleetrical and heating spstem� togeth�er with a
schedule for the completion of the rehabilitation
program and that the owner apply fcir the neeessary
permit in the offi�e of the City Architect within
the thirty (30) daps imposed herein.
2. Unless such Eorrective action is taken to comply with
this Order or an answer served npon the City of Saint Paul and
filed in the office of the Clerk of the District Court of Ramsey
County� Minnesota� within twenty (20) days from the date of the
service of tY�is Order� a Motion for Summary Enf'orcement of this
Order to raze and remove the said building will be made to the
Ramsey County District Court.
3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all personal property or fixtures which may unreasonably

interfere with the razing and removal of this building shall
be removed within ten (10) days from the entry of �udgment;
and if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and fixtures as provided by
law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above-described real estate
and collected as other taxes;
and be it '
FURT$ER RESOLVED� That a certified copy of this resolution
and incorporated Order herein be sereed apon the last record
owner of the above-described property in the manner provided
by law and a7:� upon other interested parties in the manner
provided by law.
