Dear Mr. Huber:
The Office of License, Inspection and Environmental Protection has recommended denial
of the taxicab driver's license renewal application you submitted. The basis for the
recommendation is as follows:
Your criminal history check 5hows a conviction for Possession
of a Pistol Without a Permit from June 22, 2004. The police
report indicates that the initial stop was made after a police
office observed a possible narcotics transaction, and officers
found two bags of suspected marijuana on the floor of the cab
you were driving, as well as a gun underneath the driver's seat.
Saint Paul Legislative Code §310.06 permit adverse action
against an applicant if there is evidence of lack of good
character or fitness for the occupation for which a license is
sought.
At this time you have three options on how to proceed:
If you do not dispute the above facts and do not wish to challenge the denial, you can
withdraw your application for renewal of your license. If this is your choice, you shou]d
send the le[ter directly to the Office of License, Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The le[ter should be directed to Reid Soley.
2. A�ternatively, if you do not dispute the above facts, but wish to have a public hearing

before the Saint Paul City Council to dispute that your license should be denied, you will
need to send me a letter with a statement admitting the facts and requesting a public
hearing. We will need to receive your letter by Friday, Au�ust 13, 2004. The matter will
then be scheduled before the City Council for a public hearin� to determine what penalty,
if any, to impose. You will have an opportunity to appear before the Council and make a
statement on your own behalf.
If you do dispute the above facts, a hearin� will be scheduled before an Administrative
Law Judge. At that hearin� both you and the City will be able to appear and presen[
witnesses, evidence and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. If this is your choice, please advise me by letter and I
will take the necessary steps to schedule the administrative hearing. I can be reached at
266-8710.
IF we have not heard from you by Friday, August 13, 2004, we will assume that you do
not contest the facts and will schedule this matter for the St. Paul City Council and have it placed
on the Consent Agenda during which no public discussion is allowed and the recommended
penalty wil] be imposed.

another emall baggie of auspected marijnana.

vehicle. As I went to recrieve the suepected bage oP maiijuana on the floor that �+as near
AP1, I obsarved a handgun .1s+side a bxovn holeter vnderneath AB1�8 aeat. 2 aeked AP1 1£ he
had a permit to carxy a handgua and he atated no. I took photographa fxom a diaposablg
camera of a haaflgun underneath the seat and tha euapected marijuana undexneath the floor. Z
ratxiavad tha handgun veariag latex glovea. I tcek the clip out oE the handgun and S racked
back the slide and thera rne not a round in the chamber- xhe handgua along with the two
suapected bags of marijuana, cell phona, $85.00 3n aaah, diagoaable camara along with APl�s
