The final rates that will be billed for 2004 services based on actual costs will be heard and ratified after the public hearing is held on October 6, 2004 at 530 pm. WHEREAS, on September 10, 2004 the Real Estate Division mailed to all Saint Paul property owners a Public Hearing Notice for the 2004 Right-of-Way Maintenance Program; with the public hearing to be held before the City Council on October 6, 2004. (A copy of the public hearing notice is attached for reference.) Each notice included an estimate of what the property's special assessment for 2004 Right-of-Way Maintenance work was proposed to be; and WHEREAS, The Department of Public Works has now completed its updated estimate of 2004 expenditures for right-of-way maintenance based on actual spending through September and projections for the last quarter of the year. The purpose of the Public Hearing is to consider the level of Right of Way maintenance performed in the City of Saint Paul in 2004 and to ratify the cost of such service to be charged against benefitted properties in accordance with Chapter 62 of the Administrative Code. The particular service has been performed and the estimated costs as proposed by the appropriate City departments are as follows: CLASS I-A - DOWNTOWN STREETS Description: Class I-A service has been performed on all downtown streets (face of curb to face of curb) within the following boundaries: Kellogg Boulevard on the south and west, Eleventh Street on the north, and Broadway on the east (except streets listed in Class I-B, Downtown Streets (Brick)). 2004 Level of Services: The downtown streets have been swept three times per �veek and flushed five times per week All routine maintenance, including patching, repairing of street surfaces, tree trimming, streetlight maintenance, and snow plowing has been perforxned on an as-needed basis. CLASS I-B - DOWNTOWN STREETS — B( RICK) Description: Class I-B service has been performed on all dowutown brick streets (face of curb to face of curb): St. Peter St., from Kellogg Blvd to Sixth St.; Wabasha, from Kellogg Blvd to Sixth St.; Fourth St, from St. Peter to Wabasha; Fifth 5t., from St. Peter to Wabasha; Sixth, from St. Peter to Wabasha; Mazket St., Kellogg Blvd to Fourth St.; Market St., Fifth St. to Sixth St.; Washington St., Kellogg to Fourth St.; Fourth St, St. Peter St to Washington St.; Fifth St, Market to St. Peter St.; Sixth St., Market to St. Peter St.; Kellogg Blvd., noxth side; Wabasha St, just west of Minnesota (Wild) Club and adjacent to Xcel Arena; and Kellogg Blvd., south side: Seventh St to the RiverCentre Parking Ramp. 2004 Level of Services: The above listed downtown brick streets have been swept three times per week and flushed five times per week. Page 1 of 5 ��+- 9�`� CLASS II- OUTLYING COMMERCIAL AND ARTERIAL STREETS Description: Class II service has been perf'ormed on all outlying commercia] and arterial streets in the City. These are the major arteries in the City and have both heavy volumes of vehicular and pedestrian traffic and have frequent business or commercial properties fronting on them. Typical examples would be as follows University Avenue, Snelling Avenue, West Seventh Street, East Seventh Street, Rice Street, Payne Avenue, Arcade Street, Summit Avenue, Grand Avenue and others. All of these Class II streets are accurately defined on a map available for viewing in the Department of Public Works, 900 City Hall Annex. 2004 Level of Service: The Class II streets have been cleaned approximately 13 times per season. All routine maintenance including patching, repairing of street surfaces, sidewalk maintevance, right of way tree maintenance and trimming, streetlight maintenance, and snow plowing has been done on an as-needed basis. Assessment: Under Class II service there will be two assessment rates, one commercial and one residential. The commercial property rate will be $4.30 per assessable foot and the residential property rate will be $1_81 per assessable foot. CLASS III - ALL RESIDENTIAL STREETS Descrintion: Class III service has been performed on all residential streets including oiled streets, paved streets and intermediate type streets. 2004 Level of Seroice: Residential streets, including oiled, paved and intermediate streets, have received a thorough cleaning in the spring which includes sweeping and fluslung. Patching, repair work, sidewalk maintenance, right of way tree maintenance and trimming, streetlight maintenance, and snow plowing has been done on an as-needed basis. To further improve service and efficiency, a new chip sealing policy became effective in 2000: All residential streets (oiled and paved) will be chip sealed on an 8 year cycle. One-eighth of these residential streets (a total of 64 miles) will be chip sealed each year. In the fall leaves will be picked up from these sireets. Assessment: Under Class III service to residential streets, there are two assessment categories. The commercial wil] be $3_25 per assessable foot and the residential property rate will be $1_Sl per assessable foot. Page 2 of 5 ��-q��f CLASS N- ALL OILED AND PAVED ALLEYS Descrietion: Class IV service has been performed on all oiled, paved and intermediate type alleys within the City. 2�04 Level of Service: All oiled, paved and intermediate alleys have been swept during the season. All routine maintenance, including patching and repair of the alley surface, has been performed on an as-needed basis. They are platted City rights-of-way; however, the abutting residents have never petitioned for their improvement nor have there been any assessments levied. Because they are City rights-of-way, the City has the responsibility to perform minimal repairs and maintenance work on them to reduce any hazards or potential hazards.. 2004 Level of Services: The maintenance and repair of these streets consists of patching, minor blading, placing of crushed rock and other stabilized material, right of way tree maintenance and trimming, streetlight maintenance, and snow plowing in order to make them passable and reduce hazazds. Assessment: The assessment rate on unimproved streets is $1 per assessable foot for commercial property and $1_09 per assessable foot for residential property. By unimproved, we mean those alleys that have not been developed for one reason or another. How is the right-of-way maintenance assessment different from the former street mairrtenance assessment? In the past only summer street and alley mainienance services were funded through the street maintenance assessment. In 2003 the City added winter street maintenance (including snow plowing), sidewaik maintenance and boulevard tree maint� nance to the right-0f-way assessment. This action helped avoid a city property tax increase. It also ensured that every property benefitting from rightvf-way maintenance services—whether a taxpaying or tax-exempt property—would pay its fair share of the maintenance costs. Why are the 2005 proposed rates higher than 2004? For 2005, the Mayor has proposed adding another service– street lighting maintenance–to the right-of-way assessment. The City spends about $3 million each year to repair, replace and maintain lts standard Ilghting systems. How much does it cost the City to provide rightof-way maintenance services? In 2004 the total cost will be about $22.7 million. Of this amount, the City expects to collect $14.2 miilion in assess- ments. The remainder comes from Municipal State Aid, Trunk Highway Aid, County Aid, General Fund contributions and miscellaneous receipts. Can I appeal my right-of-way assessme�rt? Property owners may appeal to the District Court. A notice staYing the grounds for the appeal must be filed with the City Clerk within 20 days of the order adopting the assessment. The same notice also mast be filetl with the Clerk of District Court within 10 days of filing with the City Clerk. NOTE: Failure to file the notices within the specified time forever prohibits an appeal from the assessment. While the assessment is under appeal, Section 64.06 of the Saint Paui Administrative Code requires that regular payments be made. It the appeal is successful, the payments will be refunded. CLASS II- OUTLYING COMN�RCIAL AND ARTERIAL STREETS Descri�rion: Class II service has been performed on all outlying commercial and arterial streets in the City. These aze the major arteries in the City and have bofh heavy volumes of vehiculaz and pedestrian traffic and, in most cases, have business or commercial properties fronting on them. Typical examples would be as follows: University Avenue, Snelling Avenue, West Seventh Street, East Seventh Street, Rice Street, Payne Avenue, Arcade Street, Summit Avenue, Grand Avenue, and others. All of these Class II streets aze accurately defined on a map available for viewing in the Aepartment of Public Works, 900 City Hall Annex. 2004 Level of 5ervice: The Class II streets have been swept or cleaned approximately 13 times per season. All routine maintenance, including patching and repairing of street surfaces, sidewalk maintenance, right-of- way tree maintenance and trimming, and snow plowing has been done on an as-needed basis. Assessment: Under Class II service there are two assessment rates, one commercial and one residential. The commercial properry rate is $4_35 per assessable foot and the residential property rate is $1_87 per assessable foot. CLASS III - ALL RESIDENTIAL STREETS Description: Class III service has been performed on all residential streets including oiled streets, paved streets and intermediate type streets. 2004 Level of Service: Residential streets, including oiled, paved aad intermediate streets, have received a thorough cleaning in the spring which included sweeping and flusAing. Patching, repair work, sidewalk maintenance, right-of-way tree maintenance and trimming, and snow plowing has been done on an as-needed basis. To further improve service and efficiency, a new chip sealing policy became effective in 2000: All residenfial streets (oiled and paved) will be chip sealed on an 8 year cycle. One-eighth of these residential streets (a total of 64 miles) will be chip sealed each year. In the fa111eaues will be picked up from these streets. CLASS IV - ALL OILED AND PAVED ALLEYS Description: Class N service has been performed on all oiled, paved and intermediate type alleys within the City. 2004 Level of Service: All oiled, paved and intermediate alleys have been swept during the season. All routine maintenance, including patching and repair of the alley surface, has been performed on an as-needed basis. To further improve service and efficiency, a new chip sealing policy became effective in 2000: All alleys (oiled and paved) will be chip sealed on an 8 year cycle. One-eighth of the total number of alleys (approximately 254 alleys) will be chip sealed each year. Assessment: Under Class 1V service, there aze two assessment rates. The commercial properry rate is $0_78 per assessable foot and the residential property rate is $0_50 per assessable foot. CLAS5 V - UNIMPROVED STREETS Description: Service has been perFormed on all ununproved streets.. By unimproved, we mean those streets that ha've not been developed for one reason or another. They aze platted City rights-of-way; however, the abutting residents have never pefitioned for their improvement nor have there been any assessments levied. Because they are City rights-of-way, the City has the responsibility to perform minimal repairs and maintenance work on them to reduce any hazazds or potential hazards. 2004 Level of Services: The maintenance and repair of these streets has consisted of patching, minor blading, placing of crushed rock and other stabilized material, right-of-way tree maintenance and trunming, and snow plowing in order to make them passable and reduce hazards.
