1 BE IT RESOLVED, that, upon the petition of the City of Saint Paul (City), as documented in Real
2 Estate Division File Number 14-2004, the City's interest in public property hereinafter described is
3 hereby vacated and discontinued as public property:

7 Commencing at a point on the south line of Maryland Avenue, in the
8 City of St. Paul, said point being 255.6 feet west from the intersection
9 of the west line of White Bear Avenue and the South line of said
10 Maryland Avenue; thence South at right angles to South Line of Maryland
11 Avenue 156.19 feet; thence West parallel with the South line of said
12 Maryland Avenue 40 feet; thence North 156.19 feet to the South line of
13 Maryland Avenue; thence East along said South line of Maryland Avenue

Subject to an easement for a public pedestrian walkway retained on, over,
under and across the west 15 Feet of the above described property.
19 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
20 Saint Paul I.egislative Code as amended, and to the following conditions:

22 1. That a permanent easement sha11 be retained for a pedestrian walkway by the City on, over, under
23 and across the west 15 feet of the above-mentioned property to be vacated, on behalf of the
24 Department of Public Works. The grantee, its successors or assigns to this property shall be
25 responsible for the relocation of the existing public walkway, into the new easement area, to the
26 satisfaction of the Department of Public Works.

At the recommendation of the City of St. Paul, Department of Planning and Economic
Development, the property being released of its City interest should be conveyed to the Housing
and Redevelopment Authority of St. Paul for future development.
That the grantee, its successors or assigns, shall dedicate, to the City a permanent right of way
easement on, over, under and across the east 10 £eet of L,ot 1, Edgar's Addition.

That with any conveyance of this vacated property, the grantee, their successors and assigns,
agree to indemnify, defend and save hannless the City of Saint Paul, its o�cers and employees
from all suits, actions or claims of any chazacter brought as a result of injuries or damages
received or sustained by any person, persons or property on account of this vacation or grantee's
use of this property, including but not limited to, a claun brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from any
violation of any law or regulation made in accordance with the law, whether by the grantee or
any of their agents or employees.
5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City of St. Paul, Department of Pubiic Works, an acceptance in writing
of the conditions of this resolution and shall, within the period(s) specified in the terms and
conditions of this resolution, comply in all respects with these terms and conditions.

pedestrian walkway running through this pazcel as public access from Breen Stzeet to Maryland
along with a number of trees.
A permanent easement for public walkway purpose, in favor of the City of Saint Paul,
Department of Public Works, shall be dedicated over the west 15 feet of this pazcel.
The petitioner shail be xesponsibie for the zelocacion of thc public walkway within the new
easement, to the satisfac6on of the Department of Public Works.
