a BE IT THEREFORE RESOLVED, that, with the accompanying Utility Certificate of Intended Non-Use, by

a BE IT FURTHER RESOLVED, the City of Saint Paul, on behalf of its Department of Pazks and Recreation,

WI�REAS, the Saint Paul Parks and Recrearion Commission is an appointed body established
to ad�ise the Mayor and City Council on long-range and city-wide matters related to Pazks and
Recreation; and
WI�REAS, the Division of Parks and Recreation and Neighborhood House aze partners in a
project to cons�uct the Paul and Sheila Wellstone Center on the site of the BI Rio Vista Recreafion
Center and adjacent properties owned by Neighborhood House; and
WHEREAS, the Saint Pau] Regional Water Services has an existing 16" water main across Pazks
properiy and said water main must be relocated to aiTow construction of, and provide water service to, the
new Wellstone Center, and
WHEREAS, the exisring water utility easement will be released and a permanent easement for
the new water main must be granted to the Saint Paul Regional Water Services for construction and
maintenance purposes; and
WHEREAS, the Division of Pazks and Recreation has reviewed and supports the reiocarion of
the water main and the proposed easesent on the El RRo Vista Recreztion Center site:
BE TT RESOLVED, that the Saint Paul Parks and Recreation Commission concurs with the
proposed new permanenT water main easement across the El Rio Vista Recreation Center site and
recommends approval by the Saint Paul Cit}s Council; and
BE IT FURTHER RESOLVED, that the Saint Paul Parks and Recreafion Commission
recommends authorizing proper City officials to negotiate the terms of and grant said easement.

BEDICATION OF EASEMENT
FOR WATER UTTI.TTY PURPOSE� � �_ �
the Department of Parks and Recreafion o€ the Cityof Saint Paul Grantor,
for good and valuable considerarion, to them in hand paid and the receipt of which is hereby
acknowledged, does hereby grant, bargain, sell and corivey to the Saint Paul Regional Water
Services, a municipal corporation of the State of Minnesota, its successors, and assigns, as
Grantee, a permanent easement for public water utilify piuposes on, over, under and across tt�e
following tract of land being in the Counry of Ramsey, State of Minnesota, described as foliows:
A 30.00 foot wide easement, over; under and across the foilowing described property:
Lots 1, 2, 3_and 4, Block 69, West St. Paul Proper;
Lots 5, 6 and 7, B1o�k,b8,. West St. Paul Propex; �
Lot 4, Block 3, Bell's Second Addition to West St. Paul; ~
all according to the recorded plats thereof, Ramsey County, Minnesota;
Vacated Winifred Street;:and
Vacated State Street:
The centerline of said easement is de `scribed as commencing at the intersection of the
northwesterly eXtension of the�riortheasterly right-of-way line of vacated Winifred�Stree� �viYh the
centerfine of vacated State Street; thence on an assumed bearing of South 25 degrees 34 minutes
29 seconds West, along said centerline of vacated State Street, a distance of 18.59 feet; thence
North 64 degrees 30 minutes 13 seconds VJest a distance of 12.71 feet to the point of beginning
of the centerline to be described; thence c.onYiriuing North 64 degrees 30 minutes 13 seconds
West a distance of 78.45 feet; thence South 24 degrees 45 minutes 51 seconds West a distance of
314.01 feet to the northeaster�y'right-of-way line of Clinton Robie Connection and said centerline
there terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at said northeasterly
right-of-way of Clinton Robie Connection.
To have and to hold the same forever. The Grantor does covenant that it is well seized in
fee of the land and premises aforesaid, and has good right to sell and convey the same free of all
encumbrances.
That Grantor also covenants that the above granted easement is in the quiet and peaceable
possession of the Grantee. The Grantor will warrant and defend against a11 persons lawfully
claiming the whole or any part thereof, subject to encumbrances, if any, hereinbefore menrioned.
It is intended and agreed that this agreement shall be a covenant running with the land and shall
be binding to the fullest extent of the law and equity for the benefit of the public. It is further
intended and agreed that this agreement and covenant sha11 remain in effect without limitation as
to time.
