WHEREAS, the City of Saint Paui ("City") has property interests for benefit of the Board of
Water Commissioners (`Boazd") over the following described real property situated in Ramsey
County, Minnesota (the "Premises"):
That part of the East half of the Southeast quarter of Sec6on 6, Township 29 North,
Range 22 West, as shown on Exhibit "A", attached hereto and incorporated herein; and
WHEREAS, the State of Minnesota, acting though its Departrnent of Transportation
("MnDOT") desires to construct certain highway and utility improvements to Tnu�k Highway
No. 35E within the Premises; and
WEiEREAS, the Boazd is willing to grant permission for said 'unprovements; and
WHEREAS, MnDOT has prepared a Temporary Permit to Construct, which grants such City
and Boazd permission to MnDOT, and which shall expire upon completion of said
improvements; and
WHEREAS, the Board did adopt Resolution No. 4979 approving said Temporary Permit to
Construct, authorizing execution of same, and requesting that the Honorable Council of the City
of Saint Paul likewise approve and authorize execution of said Permit on behalf of the City; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby approve said Temporary
Permit to Construct over the above described Premises and does hereby authorize the proper
officers of the City of Saint Paul to execute said Permit on behalf of the City.

Similar to temp permits to inirially conshuct Hwy No. 35, the State now requires execution of this Temp Permit to Consiruct (TPC) in
order to begin construction of its Unweave the Weave project. 11�is TPC will eap'ue upon project complerion, by which time a
permanent Highway Easement will be executed between the City, the Board and the State.
Title to the BWC Vadnais Conduit right-of-way is held in the name of the City for the benefit of the BWC, thereby requiring City
approval of the TPC.

l"he State of Minnesota has by its Commissioner of Transportation established and
designated the route of Trunk Highway No. 35E in Ramsey County, Minnesota.
It is necessary that the State of Minnesota use for highway purposes reai property situated in
Ramsey County, Minnesota, described as foilows:
That part of the East half of the Southeast quarter af Section 6, Township 29 North, Range
22 West as shown colored in red on Exhibit "A" attached hereto.
The undersigned, having an interest in the above described real property, understand that
they are not required to surrender possession of real property until the purchase price has
been made available and are not required to surrender lawfully occupied real property
without at least 90 days notice. By this instrument, the undersigned waive these rights and
give the State of Minnesota an immediate right of entry and permit to construct, maintain and
operate the trunk highway.
The State of Minnesota agrees to proceed as soon as possible to acquire the necessary right
of way for said highway as provided by law.
It is necessary that the actual construction of said highway be commenced immediately and
completed without interruption.
For a valuable consideration, the undersigned hereby grant to the State of Minnesota, the
right to go upon said real property and constrtact said highway immediate4y and to continue to
work the same untii fully completed, and to travel the same when completed. The
undersigned waive ail right of finai payment prior to the State of Minnesota taking possession
of the land as required by U.S. Public Law 91-646, Yitle iII, Section 301(4) with the
knowledge that such act in no way jeopardizes or compromises the damages to which the
undersigned may be entitled pursuant to the eminent domain action.
