2 Estate Division File Number 22-2004, the City's interest in public property hereinafter described is
hereby vacated and discontinued as pubiic property:

Lots 5, 19, 20 and 21, Block 26, Rice and Irvine's Addition;
Subject to an easement for right of way purposes retained on, over, under
and across those parts of Lots 5,19, 20 and 21, Block 26, Rice and
Irvine's Addition to St. Paul, according to the recorded plat thereof,
Ramsey County, Minnesota, which lie northeasterly of a line
drawn from a point on the southeasterly line of said Lot 21
distant 38.34 feet southwesterly of the most easterly corner of said
Lot 21 to a point on the northwesterly line of said Lot 5 distant
17.40 feet southwesterly of the most northerly corner of said Lot 5
and said line there terminating; and
Subject to a permanent encroachment and maintenance easement
retained on, over, under and across that part of Lot 5, Block 26,
Rice and Irvine's Addition lying northwesterly of a line 5.00 feet
southeasterly of and parallel to the northwest line of said Lot 5.
24 This vacation shall be subject to the terms and condition of Chapter 13Q codified March 1, 1981, of the
25 Saint Paul L,egislative Code as amended, and to the following conditions:

27 1. That a permanent right-of-way easement sha11 be retained by the petitioner (City), on, over, under
28 and across that portion of the vacated area as described in Exhibit "A", on behalf of the City of
29 Saint Paul, Department of Public Works.

31 2. That, on behalf of the Board of Water Commissioners, a permanent utility easement shall be
32 retained on, over, under and across that portion of the vacated with any existing water utility
33 facilities, reserving the right of the Boazd of Water Conunissioners to maintain and operate its
34 said existing water facilities in, on or under said easement, and to enter upon said easement or
35 any portion thereof at any time, and from time to time, for the purposes of future reconstruction,

3 inspecting, maintaining or repairing the same or any part thereo£ Any development or use of the
4 property within the said utility easement shall be subject to the following restrictions stated in the
5 attached Exhibit "B".
7 3. That, at the recommendation of the City of St. Paul, Department of Planning and Economic
8 Development, the properiy being released of its Ciry interest should be conveyed to the Aousing
9 and Redevelopment Authority of St. Paul for future development.

That the petitioner, its successors or assigns, shall by this resolution and any future conveyances
of this property, allow said properry to be included in any new re-platting process being
presentiy worked on by the Ciry of St. Paul.
That with any conveyance of the vacated property, the grantee, their successors and assigns,
agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees
from all suits, actions or claims of any chazacter brought as a result of injuries or damages
received or sustained by any person, persons or property on account of this vacation or grantee's
use of this property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from any
violation of any law or regulation made in accordance with the law, whether by the grantee or
any of their agents or employees.
24 6. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
25 resolution, file with the City of St. Paul, Department of Public Works, an acceptance in wriUng
26 of the conditions of this resolution and shall, within the period(s) specified in the terms and
27 conditions of this resolution, comply in all respects with these terms and conditions.

The Department of Public Works has completed a review of the above referenced
request and has no objections to the vacation subject to the following:
1) We want the new property line to be the back edge of the sidewalk. The survey
shows the property line going through the sidewalk. The survey should be revised to
reflect this change.
2) We need a street easement document dedicating the Eagle Parkway right-of-way,
including ihe entire width of the sidewalk.
3) This proper(y was supposed to be platted and Eagle Parkway was to be dedicated
on the plat. The plat has not been approved yet. We still want this parcel included in
the plat and the abutting portion of Eagle Parkway dedicated on the plat. Therefore the
City needs an agreement with the new/proposed property owner that they will agree to
include their parcel in the plat that the City is working on, and they will sign the plat.

That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the
Board to maintain and operate any water facility in or upon said easement and to enter upon said
easement, or any portion thereof, at any time and from time to ume, for the purposes of future
construction, reconstruction, inspection, maintenance or repair of the same, or any part thereof.
Said utility easement shali be subject to the following requirements:
a. No buildings, structures, trees or any temporary structure, material storage, fixture,
or any other objects which may prohibit normal access to water facilities for
maintenance purposes wall be permitted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the Board
from exercising its reserved rights may be allowed by obtaining written permission
from Saint Paul Regional Water Services with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the Board exercises its reserved easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be bome solely by the petitioner.
d. No change from the existing grade within the easement azea shall be permitted
without written pernussion from Saint Paul Regional Water Services.
e. No change in surfacing within the easement area shall be perm3tted without written
permission from Saint Paul Regional Water Services.
f. The petitioner, its successors and assigns shall fully indemnify, defend, and save
harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
agents, employees, and servants from all suits, actions or claims which shall arise
from any injunes or damages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, arising out of or resulting from
any action or negligence of the petitioner, its employees, agents or, business invitees.

Notice is hereby given that the petition of the City of St. Paul to vacate and release City interest
in Lots 5, 19, 20 and 21, Block 26, Rice and Irvine's Addition, as more fully described on file
and on record in the office of the City Clerk of Saint Paul, Minnesota, will be heard and
considered by the Saint Paul City Council at a meeting to be held in the Council Chambers on the
3rd floor of City Hall and Court House on the 22nd day of September, 2004 at 530 P.M.
