That a permanent right-of-way easement sha11 be retained by the petitioner (City), on, over, under 28 and across that portion of the vacated area as described in Exhibit "A", on behalf of the City of 29 Saint Paul, Department of Public Works. 30 31 2. That, on behalf of the Board of Water Commissioners, a permanent utility easement shall be 32 retained on, over, under and across that portion of the vacated with any existing water utility 33 facilities, reserving the right of the Boazd of Water Conunissioners to maintain and operate its 34 said existing water facilities in, on or under said easement, and to enter upon said easement or 35 any portion thereof at any time, and from time to time, for the purposes of future reconstruction, D�f- 9I� 2 3 inspecting, maintaining or repairing the same or any part thereo£ Any development or use of the 4 property within the said utility easement shall be subject to the following restrictions stated in the 5 attached Exhibit "B". 7 3. That, at the recommendation of the City of St. Paul, Department of Planning and Economic 8 Development, the properiy being released of its Ciry interest should be conveyed to the Aousing 9 and Redevelopment Authority of St. Paul for future development. 10 11 4. 12 13 14 15 5. 16 17 18 19 20 21 22 23 That the petitioner, its successors or assigns, shall by this resolution and any future conveyances of this property, allow said properry to be included in any new re-platting process being presentiy worked on by the Ciry of St. Paul. That with any conveyance of the vacated property, the grantee, their successors and assigns, agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter brought as a result of injuries or damages received or sustained by any person, persons or property on account of this vacation or grantee's use of this property, including but not limited to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising from any violation of any law or regulation made in accordance with the law, whether by the grantee or any of their agents or employees. 24 6. The survey shows the property line going through the sidewalk. The survey should be revised to reflect this change. 2) We need a street easement document dedicating the Eagle Parkway right-of-way, including ihe entire width of the sidewalk. 3) This proper(y was supposed to be platted and Eagle Parkway was to be dedicated on the plat. The plat has not been approved yet. We still want this parcel included in the plat and the abutting portion of Eagle Parkway dedicated on the plat. Therefore the City needs an agreement with the new/proposed property owner that they will agree to include their parcel in the plat that the City is working on, and they will sign the plat.
