WHEREAS, the City of Saint Paul ("City") owns properiy located northeasterly of the intersection of
Broadway Street and Fifth Street in Saint Paul, for use as park land, specifically, a nuuiing area for pets
of downtown residents; and

5 WHEREAS, the Parks and Recreation Division ("Parks") finds that disposal of a portion of said park
6 property is in the best interest of the public in order to provide additional parking for downtown
7 residents, and fiuther, that replacement land is available immediately adjacent to said park property; and

9 WHEREAS, Chapter 13 of the Saint Paul City Charter requires that land acquired for park purposes
10 cannot be diverted to other uses or disposed of except in accordance with the provisions of Chapter
11 13A1.1; and

13 WHEREAS, in accordance with said Chapter 13, the Saint Paul Parks Commission has reviewed the
14 proposed disposal of said property and has recommended that the City Council approve such disposal
15 (via Resolution Numbered 04-20, adopted September 8, 2004, a copy of which is attached hereto); and

17 WHEREAS, an appraisal of said property has been performed by a qualified independent appraiser and
18 an appraised market value of the property has been determined; and

WHEREAS, in accordance with Chapter 51 of the Saint Paul Administrative Code, the Saint Paul
Housing and Redevelopment Authority ("HRA") has submitted to the City a proposal to exchange said
park properiy with HRA-owned property located immediately adjacent to and southeasterly of said park
property, and determined by the City's Valuation & Assessment Engineer to be of equal value to said
park property; now, therefore be it
RESOLVED, that the Saint Paul City Council hereby accepts the adjacent HRA property as replacement
for said park property and authorizes the proper city officials to dispose of said park property to the I�RA
upon final transfer of said HRA property to the City.

RESOLUTION 04-20
WHEREAS, the Saint Paul Pazks and Recrearion Commission is an appointed body established to advise
the Mayor and City Council on long-range and city-wide matters related to Parks and Recreation; and
WHEREAS, Section 13.01.1 of the City Charter requires that the Commission review any diversion ar
disposal of park property and present a recommendarion to the City Council, and
WFIEREAS, the City of Saint Paul owns certain park property in the vicinity of Sth Street and
Broadway Street, as shown on the attached exhibit "A", and said property is under the
jurisdiction of the Parks and Recreation Division, and
WHEREAS, the Housing And Redevelopment Authority( HRA) the owner ofproperty
immediately adjacent to the City Park Property proposes a trade which will result in more
usable shaped pazcels as shown on the attached e�ibit "A", and
WHEREAS, the areas to be traded are approximately equal in size and equivalent in value as
determined by an independent appraisal, and
WHEREAS, the property to be traded to Parks and Recreation will be sodded and fenced by the
I�2A in a condition acceptable to Parks and Recreation, and
WI�EREAS, the City Parks and Recreation staff recommend the approval of the proposed trade,
and
NOW THEREFORE BE IT RESOLVED, The Saint Paul Parks and Recreation Commission,
under the provisions of Section 13.01.1 of the 5aint Paul City Charter, recommends to the City
Council the approval of the proposed property trade.
