WHEREAS, Pursuant to resolution, C. F. No. 239897, approved
August 20, 1968, a public hearing was duly held on Tuesday,
September 3, 1g68, before the Coun.cil of the City of Saint Paul, '
said hearing pertaining to the condition of the structure located
at 28 East' Sycamore Street, Saint Pau1, Minnesota; and
• WHEREAS, IIpon the �acts presented at the said hearing
- �onsisting of photographs, inspection reports and the recommenda–
� tion of the Gity Architect, it is found and determined by the
� City Council �hat according to the records and files in the office
o� the Register. of Deeds, the last record owners of the above–
described property are Mary Kinney, Ann Kinney, Michael Kinney,
Mathew Kinney, Margaret Kinney, Irene Jamison. and Mary Trowbridge;
that there are no other lien holders of record; that according to
the records of the County Auditor' s Office, the ta.xes for the years
1965 to the present are delinquent; and that it is further deter–
mined that the above�described building constitutes a hazardous
building within the definition of Minnesota Statutes Section
463.15 for the followin.g reasons:

a. The building is standing vacant, abandoned
and is subject to being entered by unauthorized .
persons;
b. The exterior condition of the building is
as follows : Most of the windows and portions of the win-
dow sash are broken, the windowsills and the window
casings are rottin.g, sections of the imitation brick '
siding are loose and falling from the building, the
front and rear stoops are wood floors and are badly
rotted and deteriorated, and the main roof has a
distinet sag at its ridge line;, ,
c. The interior condition of the building is
as follows : The basement stairs are worn, very
steep and considered dangerous , there are no hand-
� rails , there is only a dirt floor in the basement and
the beams supporting the joists are rotted, as are
the ends of the joists where they bear on the fou.nda-
tion, the mortar joists and limestone foundation are
eroded away, causing stones to be loose, on the first
floor the bathroom plaster is falling from the ceiling, ,
the kitchen plaster has fallen from the section ;
- adj acent to the chimney, the floors are sagging, the ='�'�
dining room and living room floors are very badly `
sagged due to deterioration of the floor joists and
' supporting beam, , the rooms on the second floor are ,
in a deteriorated condition, the plumbing system is ,
�; inoperative, the stool has been torn from the floor, .
causing an open sewer in.to the bathroom, and the ��y,.l.,+��t
� kitchen heater has been vandalized and is lying on ';f::: '
its side; � "
d. There is a 14 x 16 foot accessory building
,on the rear of the lot which has a dirt floor, and the
rafter ends are rotted and 'stancTing open. The inside
is littered with debris and oil storage drums ; �• �

beyond reasonable repair;
f. The building is unfit for human habitation
in its present condition and the above corrections
must be made in compliance with the Building Code
and the Housing Code of the City of Saint Paul in

RESOLVED, That in accordance with Minneso a Statutes Sections
463, 15 through 463. 26, and based upon the for�oing find�ngs of the
City Coun.cil, the Coun.cil of the City of Saint Paul does hereby
make the following Order:
: 1�� ORDER
� l. The owners of the above-described building shall make the � '
same safe and not detrimental to the public peace, health, safety �
and welfare by having the said building razed and the materials
ti therefrom removed from the premises within thirty (30) days from •
the date of the service of this Order.
2. Unless such corrective action is taken to comply with this -
Order or an answer served upon the City of Saint Paul and filed in ��
the Office of the Qerk of the District Court of Ramsey County, ,�;
Minnesota, within twenty, (20) days from the date of the service of - '
this Order, a Motion ;for Summary Enforcement of this Order to raze , '
and remove the said building will be made to the Ramsey County �
District Court.

3. In the event that the building is to be razed by the City
of Saint Paul pursuant to judgment of the District Court, all
personal property or fixtures which may unreasonably interfere with
the razing an.d removal of this buildin.g shall be removed within
ten (10) days from the entry of judgment; and if not so removed,
the City of Saint Paul shall remove and dispose of such personal
property and fixtures as provided by law.
4. If the City of Saint Paul is compelled to take any correc–
tive action herein, all necessary costs expended by the City will
be assessed against the above–described real estate and collected
as other taxes; and be it
FURTHER RESOLVED, That a_ certified copy of this resolution and
_ incorporated Order herein be served upon the last record owners of
the above described property in the manner provid:ed by law and also
upon other interested parties in the manner provided by law.

�' Gentlemen: �
- The Building Department is hereby submitting its report on the condition of
the property known as 28 E. Sycamore, a single family dwelling of frame construc-
tion, one and one-half stories in height, containing a partial basement. The building
' is approximately 20 ft. wide,40 ft, long and 26 ft. ,high. At the present time, the
property is vacant, not properly secured and has been extensively damaged by
vandals. There is a shed at the rear of the property which is also vacant and open.
The owner of record is the deceased Margaret Kinney, et al, and the legal
description of'the property is Lot 9, Block 3, Drakets 2nd Addition to the City of
� 5aint Paul. A recent description of the property discloses the following:

FIRS T FLOOR � `
Contains four rooms and bath. The bathroom plaster is falling from the ceiling,
the kitchen plaster has fallen from the section adjacent to the chimney. The floors
are also sagging. The dining room floor is very badly sagged, d.ue to deterioration
of the floor joists and supporting beam. This condition is the sarne in the living room.

5ECOND FLOOR
Contains two rooms, which are also in a deteriorated condition.
The plumbing system is inoperative, as the stool has been torn from the
floor and is piled in the kitchen. This causes an open sewer into the bathroom.
The heating system was by gas space heater in the dining room and a small oil
heater in the kitchen. The kitchen heater has been vandalized and is lying on its
side.
ACCE5SORY BUILDING
There is a frame 14' x 16' accessory building on the rear of the lot. It has a
cl.irt floor, and the rafter ends are rotted and standing open. The inside is littered
with debris and oil storage druins. .
If it is the opinion of the owners of this property that it can be rehabilitated, it
will be necessary that they submit the list of corrections which they propose regarding
the structural condition of the building, as well as the electrical, plumbing and heating
systems, with a schedule for the completion of the rehabilitation program, along with the
application for permits, .
If the aforementioned schedule is not submitted by the owners, it is the conclusion

of the Bureau of Public Building"s that by reason of iriad.-equate maintenance, dilapidation,

physical damage, unsanitary condition and abandonment, the above structures
constitute a hazard:to public health, safety and welfare. It is the further recomYrienda-
tion of the City Architect that the Council concur in this conclusion and refer the
matter to the City Attor,ney's office for submission of t'his condemnation to the
District Court. � .
