' This is written in response to the appeal of Arthur S. Jurgenson
� to relax certain density requirements of the Zoning Code as they
' apply to his property on the south side of Front Avenue between Dale
' and St. Albans Streets. This property is described as Lots 4 thru 9,
� Block l, Butterfield Syndicate Addition #2.
� The site is zoned Comlercial and has an area of 29,200 square
� feet. The appellant proposes to convert commercial space in a 28 dwelling
{unit apartment structure to a 29th unit. The Zoning Code requires 30,300
� square feet for this use. �

� In 1965 the appellant requested a similar variance to allow a 29
�unit structure and after the matter� was con.sidered by the Zoning Board
�he amended his request to allow a variance of 160 square feet so that he
-might construct a 28 unit apartraent building. This appeal for 28 units
' with a permit for a 35-car 'parking lot was granted by Council in July of
� 1965. I

a This matter was considered by the Board of Zoning at a public hearing
�held on October 17, 1968. �It was the finding of the Board that this
request to approve an additional variance over the appeal a]seady granted
�Ifor a 29th unit, which the applicant indicated had been roughed in at the
time of construction, was not warranted.
� '
' Consequently, the Board of Zoning recommends denial of this appeal to
relax density requirements �in this matter.
