that the provisions of said Zoning Code hereby are determined
and varied as and to the egtent necessary therefor and the

Dear Sir:
This is written in response to an application of Joseph W.
and Kathryn A. Schultz to relax the frontage and area require-
' ments under Chapter 64.03;.`Sec.tio�.��, of the Zoning Code. The
property is located on the south side of Nebraska Avenue between
White Bear Avenue and Hazel Street and is described Lot 21,
Block 3, Hayden Height"s Addition. The zoning is "A" residence.
This matter was considered at_ the October 3, 1968 Board of
Zoning meeting. The staff reported that the property has the
same visual character of surrounding single-family homes and
that two parking;spaces are provided.
The Board of Zoning returns this application to the Council with
no reco�endation.

own at 1832 E. Nebraska Avenue; ZQcated on the
� � south side of the street between White Bear Avenue
- and Hazel st�eets. On �"une 14, 1�68, we received
a Zetter stating that our property c�escribed as
Lot 21, �lock 3 of Hayden Heights Addition is only
40 feet u�i=de� and 5000.�"�'e�t square. �e haue been
informed tha.t under the Ordinance Legislative Code,
Section 64.03, Paragraph 0, 5ubdivision 2, we
are to maintain at Zeast a 50 foot frontage, since
our lot was pr.ior to 1922, in an "A" residential
area. ,
Our house was purchased by us two year,s a - o with
the understanding that it was a duplex. �he;�former
owner has told us that this house has been used as -
a duplex for at least twelue t�ears, that he has proof
, of. After Zooking through:��he city records, tie have
found that the only building permit taken out was in
1926, and therefore this information has led us �o
believe that it was at this time that it was
converted into a duplex.
The �`wo apartments �n our buila►ing ach have
� separate�gas and electric meters. �he upstairs
apartmei2t�zs comz�letely separate from the downstairs
. - ` anc� witliout major reconstruction �t could not possibty
� be used as a single farriily dwelltng.
• I unc�erstand that the inspection ot our property
�as a result of a compZaint. It does not seem fair
that a formor distraught tenant ( whom forced us
�i into asking her to Zeaue because of her •intolerab.le
Ziving habits ) has the right to subject us to this
confus�on and grief. After all these years have
past, why a.re we nom being heZd responsible, when
r�e are not the ones who changed this house in�o
. a duplex?

We are a young couple, both of us are under twenty-
five years of age and Zihe the majority of young
marrieds we haue our share of financiaZ problems.
If we were to lose this income from our apart�nent
, because of this zoning ordinance, we would be unable
to make our house payments and therefore probably
Zose our home.
Our house has always been well kept up. We haue
� never neglected to paint, clean or fix any part
of it. Our yard is always tri7nmed, mowed or
shovelea►, and always looks presentable. 1'here ar�
so many duplexes in S't. raul, that Zook like disaster
areas, and yet no one ever sc�erics to botl�e�:.them.
1✓e have put mu�h time effort� and m,oney into our
home and we hope it has not been done in vain.
When renting our apartment we haue always tried
to interueiw all prospective tenants carefully so
we can be sure that they will try to keep our
home a clean, pleasant ana' quiet place in which
to Zive. �

� At the present time we are renting to one person
and we aurseZves have only one child. I think
you would agree that a house with only for�r people
cannot cause much, if any, disturbance to neighbors
or citizens of the community.
These are a few of the many reasons we are asking
•. you to waiue the front footage and square footage
requirement and allow our home to z�;xsist as a du,�Zex.
