1 WF �REAS, The City Council of the City of Saint Paul, pursuant to Chapter 62 of the Administrative Code
2 did hold a public hearing on November 5, 2003, in the City Council Chambers for the purpose of
3 establishing the level of Right-of-Way maintenance to be performed in the City of Saint Paul and the amount
4 of service chazges to be levied against benefitted properties; and

6 WHEREAS, The Department of Public Works did perforxn the 2004 Right-of-Way maintenance services in
7 a manner as set forth and approved by the City Council and described in the report of the Department of
$ Public Works; and

10 w[��AS, Pursuant to Chapter 62 of the Administrative Code, the Department of Public Works has
11 submitted to the Department of Finance and Management Services a report showing the total cost of street
� 2 maintenance to be $22,712,431 a copy of such report has heretofore been delivered to the City Council;
13 now, therefore, be it

15 �SOLVED, That the City shall pay $8,564,394 of the cost of streets and alley maintenance by using
16 Municipal State Aid ($2,575,000), Trunk Highway Aid ($339,886) County Aid ($756,000), Miscellaneous
� 7 Receipts ($2,034,886), General Fund ($35,346), Fund Balance ($2,823,276); and be it fiu-ther

benefited properties to be collected in the same manner as other real property taxes in 2005, and the City
Clerk is hereby directed to publish notice of this Hearing pursuant to Minnesota Statute Chapter 429, and
the Department of Public Works, Real Estate Division is hereby directed to mail notices in accordance with
said Chapter 429.

NOTICE OF PUBLIC HEARING (A)
Notice is hereby given that a Public Hearing will be held on the 6"' day of October 2004 at
5:30 pm in the Saint Paul City Council Chambers, City Hall and Court House, Saint Paul,
Minnesota. The purpose of the Public Hearing is to consider the level of Right-of-Way
maintenance performed in the City of Saint Paul in 2004 and to ratify the cost of such service to be
charged against benefitted properties in accordance with Chapter 62 of the Administrative Code.
The particular service has been performed and the estimated costs as proposed by the Department
of Public Works are as follows:
CLASS I-A - DOWNTOWN STREETS
Description:
Class I-A service has been performed on all downtown streets (face of curb to face of curb) within
the following boundaries: Kellogg Boulevard on the south and west, Eleventh Street on the north,
and Broadway on the east (except streets listed in Class I-B, Downtown Streets (Brick)).
2004 Level of Services:
The downtown streets have been swept three times per week and flushed five times per week. All
routine maintenance, including patching and repairing of street surfaces, tree trimming, and snow
plowing has been performed on an as-needed basis.
Assessment:
All Class I-A service will be assessed at a rate of $7_95 per assessable foot.
CLASS I-B - DOWNTOWN STREETS BRICKI
Descrintion:
Class I-B service has been performed on all downtown brick streets (face of curb to face of curb):
St. Peter St., from Kellogg Blvd to Sixth St.; Wabasha, from Kellogg Blvd to Sixth St.; Fourth St.,
from St. Peter to Wabasha; Fifth St., from St. Peter to Wabasha; Sixth, from St. Peter to Wabasha;
Market St., Kellogg Blvd to Fourth St; Market St., Fifrh St. to Sixth St.; Washington St., Kellogg
to Fourth St.; Fourth St., St. Peter St. to Washington St.; Fifth St., Market to St. Peter St.; Sixth
St., Market to St. Peter St.; Kellogg Blvd., north side; Wabasha St, just west of Minnesota (Wild)
Club and adjacent to Xcel Arena; and Kellogg Blvd, south side: Seventh St to the RiverCentre
Pazking Ramp.
2004 Level of Services:
The downtown streets listed above have been swept three times per week and flushed five times
per week. All routine maintenance, including patching and repairing of the brick street surfaces,
tree trimming, and snow plowing has been performed on an as-needed basis.
Assessment:
All Class I-B service will be assessed at a rate of $9_95 per assessable foot.

CLASS II- OiJTLYING COMNIERCIAL AND ARTERIAI. STREETS
Description:
Class II service has been performed on all outlying commercial and arterial streets in the City.
These are the major arteries in the City and have both heavy volumes of vehicular and pedestrian
traffic and, in most cases, have 6usiness or commercial properties fronting on them. Typical
examples would be as follows: University Avenue, Snelling Avenue, West Seventh Street, East
Seventh Street, Rice Street, Payne Avenue, Arcade Street, Summit Avenue, Grand Avenue, and
others. All of these Class II streats are accurately defined on a map available for viewing in the
Department of Public Works, 900 City Hall Annex.
2004 Level of Service:
The Class II streets have been swept or cleaned approximately 13 times per season. All routine
maintenance, including patching and repairing of street surfaces, sidewalk maintenance, right-of-
way tree maintenance and trimming, and snow plowing has been done on an as-needed basis.
Assessment:
Under Class II service there are two assessment rates, one commercial and one residential. The
commercial property rate is $4_35 per assessable foot and the residential property rate is $1_87 per
assessable foot.
CLASS III - ALL RESIDENTIAL STREETS
Description:
Class III service has been performed on all residential streets including oiled streets, paved streets
and intermediate type streets.
2004 Level of Service:
Residential streets, including oiled, paved and intermediate streets, have received a thorough
cleaning in the spring which included sweeping and flushing. Patching, repair work, sidewalk
maintenance, right-of-way tree maintenance and trimming, and snow plowing has been done on an
as-needed basis. To further improve service and efficiency, a new chip sealing policy became
effective in 2000: All residential streets (oiled and paved) will be chip sealed on an 8 year
cycle. One-eighth of these residential streets (a total of 64 miles) will be chip sealed each
year. In the fall leaves will be picked up from these streets.
Assessment:
Under Class III service there aze two assessment rates. The commercial property rate is $3_30 per
assessable foot and the residential properiy rate is $1_87 per assessable foot.

CLASS IV - ALL OILED AND PAVED ALLEYS
Descriotion:
Class N service has been performed on all oiled, paved and intermediate type alleys within the
City.
2004 Level of Service:
All oiled, paved and intermediate alleys have been swept during the season. All routine
maintenance, including patching and repair of the alley surface, has been performed on an
as-needed basis. To further improve service and efficiency, a new chip sealing policy became
effective in 2000: All alleys (oiled and paved) will be chip sealed on an 8 year cycle.
One-eighth of the total number of alleys (approximately 254 alleys) will be chip sealed each
year.
Assessment:
Under Class IV service, there are two assessment rates. The commercial property rate is $0_78 per
assessable foot and the residential property rate is $0_50 per assessable foot.
CLASS V - UNIMPROVED STREETS
Description:
Service has been performed on all unimproved streets.. By unimproved, we mean those streets
that have not been developed for one reason or another. They are platted CiTy rights-of-way;
however, the abutting residents have never petitioned for their improvement nor have there been
any assessments levied. Because they are City rights-of-way, the City has the responsibility to
perform minimal repairs and maintenance work on them to reduce any hazards or potential
hazards.
2004 Level of Services:
The maintenance and repair of these streets has consisted of patching, minor blading, placing of
crushed rock and other stabilized material, right-of-way tree maintenance and trimming, and snow
plowing in order to make them passable and reduce hazazds.
Assessment:
The assessment rate on unimproved streets is $1.92 per assessable foot for commercial
property and $1_14 per assessable foot for residential property.

CLASS VI - UNIMPROVED ALLEYS
Description:
Service was performed on unimproved alieys. By unimproved we mean those
alleys that have not been developed for one reason or another. They are platted City
rights-of-way; however, the abutting residents have never petitioned for their improvement
nor have there been any assessments levied. Because they aze City rights-of-way, the City
has the responsibility to perform minimal repairs and maintenance work re reduce hazards.

Points of Information
Residential property on corner lots will only be assessed for the normal assessment
for the front of the lot.
Residential properties on outlying commercial and arterial streets will be assessed at
the residential rate ($1.87 per front foot), commercial properties on residential streets
would be assessed at $3_30 per front foot.
Churches and church property would be assessed at the residential rate.
The assessment will be included on your property tax statement in 2005.
