WHEREAS, Pursuant to resolution, C. F: No. 240290, approved
September 20, 1968, a public hearing was duly held on Tuesday,
October 8, 1g68, before the Council of the' City of Saint Paul, said
hearing pertaining to the condition of thejstructure located at
537 West Central Avenue, Saint Paul, Minneso.t.a; and

W�REAS, Upon the facts presented at the said hearing consisting
of photographs, ,inspection reports and the� recommendation of the City
� Architect, it is foun.d and determined by the City Council that
according to the records and files in the office of the Register of
' Deeds, the last record own.er is Donald W. R. Allen; that Midwest
Federal Savings and Loan Association is the mortgagee and purchaser
at mortgage foreclosure; and that there are no other lien holders
of record; and that it is further•J�determined that the above—described
building constitutes a hazardous ,building within the definition of �
Minnesota Statutes Section 463. 1•5 for the following reasons:

a. The building is standing vacant, has been
severely damaged by fire and abandone�;
b. The exterior condition of the. building is in
a dilapidated condition in that the ch�imn.ey mortar
• joints and brick are eroded, the exter,ior imitation
asphalt brick siding is falling from the walls , the
limestone foundation is eroded, the windows and
window frames are rotted and broken, and the exterior
porches and steps are badly rotted; �
c. The interior condition of thetbuilding is as
_ =• follows : Fire damage has destroyed a great portion
`� of the interior of the building, the interior foun.da-
tion is eroding, plaster is missing from the walls,
plumbing and electrical systems have b�een vandalized
' and�or damaged by fire and are no longer functional ,
and the gravity warm air heating system was destroyed
by fire; � -
d. The building in its present condition is
unfit for human habitation; �
e. The building is beyond reasonable repair and
constitutes a nuisance and a hazardto �the public peace,
health, safety and welfare because of its fire damage,
dil`apidation, abandonment and inadequate maintenance;

now, therefore, be it � �
RESOLVED, That in accordance with Minnesota Statutes Section.s
463. 15 through 463. 26, and based upon the foregoing findings of� the .
City Council , the Council of the City of Saint Paul does hereby make
the following Order: ! ,

ORDER �
l. That the own.ers of the above-described hazardous building
shall make the same safe and not detrimental to the public peace, �
health, safety and welfare by having the said building razed and
the materials therefrom removed from the premises within thirty (30)
days from the date of the service of this Order.

. 2. Unless such corrective action is t�aken. to comply with this
Order or an answer served upon. the City of Saint Paul and filed in
the Office .of the Clerk of the District Court of Ramsey County,
Minnesota, within twenty (20) days from the; date of the service of
�his Order, a Motion for Summary Enforcement of this Order to raze
an.d remove the said building will be made to the Ramsey County -
District Court. i `

3. In the event that the building is to be razed by the Gity
of Sain.t Paul pursuant to judgment of the District Court, all personal �
property or figtures which may unreasonably� interfere with the razing
an.d removal of this building shall be removed within ten. (10) days
from the entry of judgment; and if not so removed, the City of Saint
Paul shall remove and dispose of such personal property and fixtures
as provided by law.
_,,,�.�� 4. If the City of Saint Paul is compelled to take any corrective
���-action herein, all necessary costs expended. by the City will be
assessed against the above–described real estate and collected as
other taxes; and be it

incorporated Order herein be served upon the last record owner of the
above described pr.operty in the manner provided by law and also upon
other interested parties in the manner provided by law.

The Building Department is he reby s-ubmitting its report on the
cond.ition of the property known as 537 W. Central Avenue, a duplex of frame
construction, two stories in height, 24 ft. wide, 42 ft. long and 26 ft. high.
The building at the pres ent time is vacant, has been damaged by fire and
vandalized. We were unable to have the record owners of the property secure
the building and therefore requested the Public Works Department to temporarily
secure it. f

The chimney mortar joints and the brick are badly eroded to the point
where the chimney, which projects approximately 10 feet above the roof,
is in danger of collapse. The exterior is covered with asphalt imitation brick
siding which has deteriorated and in some places is� falling from the walls. The
exterior of the limestone foundation has the mortar reroding from the stone
joints, causing the stones to be loose. Most of the window glass is broken and the
frames are rotted and broken. Both side and rear porches and steps are bac]ly
rotted or the concrete is eroded.

BASEMENT. There is evidence that fire has destroyed approximately
seven of the supporting floor joists. The i.nterior foundation also shows extensive
mortar erosion. �

FIR5T FLOOR. Contains four rooms and bath. Fire damage was
done to three of the rooms, and a section of the second floor joists was also
damaged by the fire. A large per cent of the plaster is missing from the walls
or ceiling.

SECOND FLOOR. Contai.ns four rooms and fbath. Fire has damaged
the rear portion of floors, walls, and ceiling. } : ��

The plumbing and electrical systems have been vandalized or
damaged by the fire to the extent that they are no longer functionaL A
gravity warm air heating system was also destroyed by the fire.
�
Inasmuch as a rehabilitation schedule has not been submitted by t�he
owners, it is the conclusion of the Bureau of Public Buildirigs that by reason
of inadequate maintenance, dilapidation, physical damage, unsanitary
condition and abandonment, the above structure constitutes a hazard to
public health, safety and welfare. It is the further recommendation of the
City Arc'hitect that the Council concur in this conclusion and refer the matter
to the City Attorney's office for submission of this condemnation to the District
Court.

The legal description of the subject property is Lot 21, Bl:ock 9,
Mackubin & Marshall's Addition, and the record owner is Donald W. R. Allen.
