WHEREAS, In the matter of Comptroller's Contract L-7030, for the painting
of the Reserve Street Bridge over the North Road. o� Waxner Road a.nd the right- �
of-ways a.nd tracks ofl the Chica�o, Burlington and Quincy Railroad Company; the
Chicago, Milwaukee, St. Paul and Pacific Ra,ilroad Company and the Chicago and
North Western Railway Company (formerly Chicago Great Western Railway Co�pany)
in the City of St. Paul, g. Shel�en & Son, Inc., Contractor, the specified
d.a.te of staxting was to be not later than June 15,- 1968, and the specified
d.a.te of completion wa.s October l, 1968; and � `�
W�RF�AS, The contract was not countersi�ned by the City of St. Paul until
August 12, 1g68; and
WFIEREAS, The Contractor has prosecuted the work d3ligently, but it wa,s not
possible to complete the pro�ect; and
WHEREAS, The weather conditions between October 15th and April 15th are .
generally.adverse to painting; and , . �

no force or ef�ect unless the sureties on the Contractor's bond consent thereto '
and file such consent in writing w1.th the City Comptroller; and be it
� FI1RT£�ER RESOLVED, That the City of S`t. Paul hereby waives all cla3m for ;
liquidated damages and that no Engineering and�Inspection costs�on th�.s pro�ect ,
will be chaxged to the Contractor for such extended period:�� ;
