04-848Council File # D — (Z Resolution # Green Sheet # 3021663 Presented By Referred To RESOLUTION CITY OF SAINT PAUL, MINNESOTA 33 Committee: Date 2 WHEREAS, Chapter 293 of the Saint Paul Legislarive Code was enacted to regulate the subject of noise in 3 the City of Saint Paul; and 4 5 WIIEREAS, §293.11 provides for the granring of variances from the sound level lunitations contained in 6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an 7 unreasonable hardship on an applicant, other persons or on the community; and 9 WHEREAS, Schwietz Saloon, represented by Scott Dornfeld, orvner, who has been designated as the 10 responsible person on the application, has applied for a variance to allow live music at 956 Payne Ave.; and 11 12 WHEREAS, applicant is seeking a variance for the hours of 830 p.m. to midnight the night of September 13 16, 2004 and 830 p.m. to 12:30 a.m. the nights of September 17 and 18, 2004; and 14 15 WHEREAS, if applicant is not granted a variance it will not be able to present live music; and 16 17 WHEREAS, the Office of License, Inspecrions, and Environmental Protection has reviewed the application 18 and has made recommendations regarding conditions for the variance; now, therefore, be it 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Schwietz Saloon, subject to the following condirions: 1) The variance shall be for the hours of 8:30 pm. to midnight the night of September 16, 2004 and for the hours of 8:30 p.m. to 12;30 a.m. the nights of September 17 and 18, 2004 2) All electronically powered equipment used in conjuncrion with the event shall not exceed 85 dBa the night of September 16, 2004 and shall not exceed 90 dBa from 8:30 p.m. to midnight the nights of September 17 and I8, 2004 and sha11 not exceed 85 dBa from midnight unril 12:30 a.m. on the nights of September 17 and 18, 2004.
