2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WIIEREAS, §29311 provides for the granting of variances from the sound level limitarions contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WF3EREAS, the Dubliner Pub Inc., represented by Tom Scanlon, President, who has been designated as the
10 responsible person on the application, has applied for a variance to allow live music at 2162 University Ave. W., on
11 September 18, 2004; and

13 WHEREAS, applicant is seeking a variance for the hours of 6:00 p.m. to midnight on September 18, 2004;
14 and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to present the live music ; and

18 WHEREAS, the Office of License, Inspecfions, and Environmental Protection has reviewed the application
19 and has made recommendations regarding conditions for the variance; now, therefore, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The Dubliner Pub,
22 subject to the following condirions:

24 1) The varianca shall be for the hours of 6:00 p.m. to midnight on September 18, 2004

27 2) All electronically powered equipment used in conjuncrion with this event shall not
28 exceed95 dBa as measured from the closer of 50 feet or the sound mix.

,2 .' 3) The applicant shall provide personnel and equipment who shall provide continuous sound level
3 monitoring between 6:00 p.m. and midnight on the date to ensure compliance with Condition #2.

5 4) All electronically powered equipment, PA systems, loud speakers or similar devices shall be turned
6 off no later than midnight on the date.

Attached is a sound level variance application from Tom Scanlon, owner, representing
The Dubliner Pub, 2162 University Avenue West, Saint Paul, MN 55114, to allow live
music. A variance is requested far the hours of 6:00 p.m. to midnight the night of
September 18, 2004.
Enclosed is the copy of the Public Hearing Norice sent to property owners within 200 feet
of 2162 University Avenue West.
