2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and
4
5 WIIEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
6§293.09, upon a fmding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, Blessed Sacrament Church, represented by Peggy Hennagir, Secretary, who has been
10 designated as the responsible person on the application, has applied for a variance to allow live music at 1801
11 Lacrosse Ave., on September 25, 2004; and
12
13 WHEREAS, applicant is seeking a variance for the hours of 5:00 p.m. to midnight on September 25, 2004;
14 and
15
16 WHEREAS, if appiicant is not granted a variance it will not be able to present the live music ; and
17
18 WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the application
19 and has made recommendations regarding conditions for the variance; now, therefare, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Blessed Sacrament
22 Church, subject to the following conditions:

24 1) The variance shall be for the hours of 5:00 p.m. to midnight on September 25, 2004

27 2) All electronicaliy powered equipment used in conjunction with this event shall not
28 exceed 90 dBa as measured from 50 feet.

2 � 3) The applicant shall provide personnel and equipment who shall provide continuous sound level
"s monitoring between 5:00 p.m. and midnight on the date to ensure compliance with Condition #2.

5 4) All electronically powered equipment, PA systems, loud speakers or similar devices shall be tumed
6 off no later than midnight on the date.
