04-838z Presented By: Referred to: RESOLUTION AINT PAUL, MINNESOTA COUNCILFILE#: D��U�lJ GItEENSHEET#: �A� ��f�j Z7 I WHEREAS, the yeaz of 2004 has seen a marked increase in the number of elm trees, both public and private, that have been 2 idenrified as being infected by Dutch Elm Disease; and 4 WHEREAS, removal of diseased tress from private property is not funded by any City sources, and can prove to be a 5 substanrial expense to the effected property owner; and 7 WIIEREAS, Chapter 175 of the Saint Paul Legislative Code defines Dutch Elm Disease affected trees and their by-products as 8 a public nuisance, and said nuisance, if not removed by the property owner wiUtin twenty (20) days of notification by the City's 9 Foreshy Section, may be abated through anan�emenu made by the Forestay Section and assessed to the property owner; and 10 I I WI IEREAS, for elm trees abated under the terms set forth in Chapter 175; the Foresuy Section will report to the Real Estate 12 division of the Public Works department before September 1 of each year for all work done for which assessments aze to be 13 made, stating and certifying the description of the lots and parcels involved and the amount chazgeable to each lot and pazcel; and 14 15 WHEREAS, the Real Estate division of the Public Works department will assess against the affected property the total cost of 16 the abatement, including the adminish�ative costs of processing said abatement; and 17 18 WHEREAS, assessments made under the provisions of Chapter 175 of the Saint Paul Legislavve shall be payable in not to 19 exceed five (5) annual installments; and 20 21 WHEREAS, Pazks and Recreation requesu that $100,000 in spending authority be added to Foreshy Special Fund 375 22 for dealing with assessable removals, said spending to be supported by assessments; and 23 24 WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City of Saim Paul, does certify that there are 2S available for appropriation, funds of $ l OQ000 in excess of those estimated in the 2004 budget; and 26 29 WHEREAS, the Mayor recommends that the following addiuons be made to the 2004 budget: 28 29 30 CURRENT AMENDED 31 FINANCING PLAN: $UDGET CHANGES B UDGET 32 375 - Farestry Special Fund 33 33124 - Assessable Removals 34 6001 - Current Year Assessments 35 36 SPENDING PLAN: 37 375 - Forestry Special Fund 38 ;3124 - Assessable Removals 0 100,000.00 100,000.00 0 100,000.00 100,000.00 39 0273 - Grounds Maintenance Sexvice 0 100,000.00 100,000.00 40 0 100,000.00 100,000.00 4I 42 THEREFORE BE IT RESOLVED, that the Council of the City of Saint Paul appxoves these changes to the 2004 budget G.IFMIQ71WirkalResolutions, AOs, Green SheetslResolutron5lDutch Elm Resolution xls Page: 1 of2 , }. Tlus proposal is a way to cover the removal of these trees as authorized by the Sairn Paul Legislarive Code.
