2 Whereas, the District 6 Planning Council filed an appeal to the City Council from a decision of
3 the planning commission granting a conditional use permit to construct a cluster development at
4 1070 Burgess Street (Zoning File No. 04-019-969); and
Adoption Certified by Council
Whereas, the City was precluded from acting upon the appeal by operation of law under Minn.
Stat. § 15.99, Subd. 2; and

Whereas, the District 6 Planning Council paid the appropriate fee for zoning appeals when it
filed its appeai on or about MazcA 18, 2004; and
Whereas, because the City was unable to act upon the said planning counciPs appeal, the Council
finds that it is appropriate and proper in this instance to refund �F *hP four hundred
fifteen dollaz fee ($415.00) paid by the District 6 Planning Council when filing its appeal; NOW,
THEREFORE,
BE TT RESOLVED, that the appropriate city officials are hereby directed to refund to the District
