LETTERS OF DEFICIENCY, CORRECTION NOTICES, AND CORRECTION ORDERS

The hearing was called to order at 1:31 pm.
STAFF PRESENT: Lisa Martin, Neighborhood Housing and Properry Improvement (NHPI);
Phillip Owens, Division of Fire Protection; Rich Singerhouse, NHPI
1682 Grand Avenue; appellant: Beth Bergman. (Laid over from 7-13-04)

Phillip Owens reported this was regazding door locks and a tank in the basement. They have
looked at the tank. The tank is abandoned and disconnected. It does not appear to have liquid in
it, although it may have sludge. It will have to be removed under permit with a licensed
contractor. There are not many alternatives. It should have been removed when the heating was
done, but they were the ones that converted the heating plant.
Fire Prevenfion has reached an agreement for an altemate method of compliance with the exiting.
Beth Bergman is requixed to have two means of egress from the building and she has three. One
was not being utilized. The agreement is that she could leave the slide bolts--noncomplying
exiting hardware--on the rear door. If that door is taken out of service, they can use it for stock.
The remaining door in the mercantile area would be the second required means of egress. They
discussed the required exiting hardwaze for the second door. She will relocate the exiting
signage from the reaz door to the front door, leave the exit locks on the back door, and provide
the proper hazdware for the new second door. The siide bolts on the existing main enh will
have to be removed. The door has three locks on it now. Part of the problem is the doors and
frame are original to the building from probably the 1920's. She has to slide bolt it because it
does not fit into the frame. It will lock and secure with the single dead bolt, which makes it
compliant. Over the next few years, she will probably be looking at replacing the door and
frame.
(Mr. Owens submitted a copy of the document that was sent to Ms. Bergman extending
compliance for the locks and tank for 90 days.)
Ms. Moermond denied the appeal as accommodation has been reached on the lock issue; the tank
will be removed with a compliance date of October 13, 2004 on the Deficiency List dated May
12, 2004.

Phil Owens reported Mr. Goossen has been on vacation. Mr. Owens will try to schedule the
inspection for nea�t week, and he will arrange to have Ms. Moermond accompany him at a time
convenient.
Ms. Moermond laid over to the August 10 legislative Hearing.
946 Earl Street; owner: Ginger Cheney.

Rich Singerhouse reported that there was a work order sent for the tall grass/weeds, securing the
garage, removing refuse. That was done. Mr. Singerhouse inspected the building, made it a
Category I, and the owner filed an appeal. It was explained to the owner that all she had to do
was move right in. She may have filed the appeal before she talked to Mr. Singerhouse.
Ms. Moermond denied the appeal on the Vacant Building Registration Notice dated July 1, 2004.
292 Forbes Avenue; appellants: Kevin Jotuison and Steven Johnson for Mazket Group and
Properties.
Marcia Moermond stated the ownership has changed and the order has been retracted and
reissued to the correct owner, who is now responsible.
Lisa Martin reported the order was sent July 12. The ownership shows up as Steven Johnson and
the rental registered owner as Mary Mazgaret Gorman. As of yesterday, the ownership still was
not posted.
Steven Johnson, Market Group and Properties 576 Bay Street, appeared and stated he sent copies
of the warranty deed (with his appeal application). He sold the building in two weeks and got
cited selectively over a little plaque. Directly across from his property, there aze garage doors
falling down, weeds up to three feet high, and garbage everywhere. He ran the citizen reports
and nothing was cited. He has pictures. The plaque could have fallen off ar kids could have
taken it. The inspectors should go around the same alley and cite others as well. He understands
they are doing their job. He told the new owner to show ownership. The City should give an
owner time to get a handle on the buiiding. He would like the City to be fair with him.
Ms. Moermond granted the appeal on the Correction Notice dated 3uly 12, 2004. The order has
been reissued to the new owner, who still has appeal rights.
540 Charles Avenue; appellants: Kevin Johnson and Steve Joluison for Market Group and
Properties.
Steven Johnson stated the issue is done: it was painted two days later. The whole alley is a
disaster. They took pictures. If he is going to be cited, the others should be cited as weil.

Mazcia Moermond responded it has been taken caze of; therefore, it is a moot issue. They aze in
a unique situation, and he can withdraw his appeal.
Mr. Johnson stated he does not want to get fines on each one. If he is getting fines, he would like
the neighbors to get them a1so.
Lisa Martin reported the eaves aze painted on the garage. She only handles problem properties.
If there are violations, Mr. Johnson should continue to use Citizen Service or call Andy Dawkins
(NI�PI Director). Ms. Martin and Mr. Johnson used to have a working relationship: she would
call Mr. Johnson to say what is going on, and they would never go through the Correction
Notices. At this point, Mr. 3ohnson has chosen the route of getting Correction Notices. Mr.
Johnson responded he never said that Mr. Martin could not contact him. They had some
differences but not to the point of being unworkable.
Ms. Moermond denied the appeal on the Correction Notice dated July 13, 2004, as the situation
has been conected. The City was right to issue a Correction Order, as there was a violation.

Phil Owens reported that Michael Urmann is detained elsewhere. He has met with
representatives.
(Ms. Moermond took a one minute recess and then resumed this issue.)
Mr. Owens continued: Mr. Urmann met with the representatives and explained the violations.
They agreed it needed to be corrected and expressed they would. Mr. Urmann was of the opinion
they withdrew the appeal, which is why he did not appear today.
Ms. Moerxnond denied the appeal on the Deficiency List dated July 6, 2004.
The hearing was adjourned at 1:53 p.m.
