Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the appeal of Sam Winnick to relax the building line setback on property located at the IdE corner of Clarence Street and Maryland Avenue and described as Lot 5, Block 1, Brenner Add.ition. The appellant wishes to install a 26 foot high, 10 foot by 12 foot, non-flashing advertising sign at the property line. (A request to relax the setbaek to allow a flashing sign on the property was denied by the City Council in April of 1968.) This matter was considered by the Board of Zoning at a publ�c �?earing on August 15, 1968. The staff reported that the area zoning includes "C" Residence to the west, "C-1" Residence to the north, "B" Residence to the east, and Commercial to the south. Existing area uses include ' residential to the north of Maryland Avenue and commercial uses to the south of Maryland Avenue. The residential development to the west observes a setback of approximately 30' to 35' from Maryland Avenue. The residential development to the east observes a setback of at least 20' . Mr. Richard Garmaker, an owner of the apartments to the west, spoke i.n opposition to the relaxation. - It was the findings of the Boar,d_ that it would be reasonable to grant the relaxation. The property is zoned for co�ercial usage and is presently improved with a commercial type building, including a.n off-sale liquor store owned by application, and a dry gleaning establishment. � Applicant wishes to erect a separate standing advertising sign at the south�west corner of the sub�ect premises, as the building is set back a considerable distance from the street so as to provide off-street paxking, and identification is needed, as this is a newly constructed co�ercial area. It is difficult for east-west traffic on Maryland to be�aware of the commercial building without identification through the median of an advertising sign located on the Maryland side of the premises. This application is similiar to an application previously 'filed with �our Honorab�e Body, but differs in that the previous application was for a flashing sign and that this application is for a non-flashing type of sign. This appeal is necessitated by reason of the fact that the premises to the east of the subject premises are zoned and used for single family residential purposes, although the area is predominately multi-residences an.d commercial in its development. This appeal is under St. Paul Legislative Code Chapter 64.03, Paxagraph J.
