In the matter of changing the grade of the East-West alley in Block 4, Ruth Livingston
' Secorid Addition from Dunlap Street to the North-South alley in said Block 4 to conform
to the grade as shown on the profile on file in the Department of Public Works.
, Also condemning and taking an easement in the land necessary for the slopes,
cuts and fills, dncluding right of removal of lateral support from subject land or
remainder thereof, occasioned by excavations thereof or construction of slopes in the
grading and surfacing with bitimminous material the 'EasC-West alley in Block 4, Ruth
Livingston Second Addition from Dunlap Street to the North-South alley in said Block 4,

under Preliminary Order 236201 , approved December 19, 1967 ,
Intermediary Order 239457 ` , approved .7u1� 16, 1968 ,
Final Order , 2.�qR��. , approved Au,gust 13-, 196$ .
The Commissioner of Finance having submitted his report in the above matter as to the amount
of damages awarded for the taking of the land or easements therein appropriated for the above im-
l�i•ovement and to whom payable; and also having submitted his assessment of benefits to property
from the making of said improvement, therefore be it - ,
F�esolved, That tlie said assessment of benefits be and the same is hereby approved.
Resolved further, That a public hearing be had before the Council upon said report and for a con-�
firmation of the award of damages made by the Commissioner of Finance, �and also upon the said as- �,
sessment of benefits; at the Council Chamber, in the Cotirt House in the City of St. Paul on the
._�+�_i�tea�nt�n day of October, 1968 , �t ten o'clock A.M. aud that the Commis-
sioner of Finance be and he is directed to give notice of said hearing as prescribed by the Charter. .
