WHEREAS, Mazk Gergen, (Zoning File # 03-325-408) has submitted for City Council approval the attached
preliminary and final plat for subdivision of property at 766 Hall to create ten twinhome lots and 2 single-family lots to
provide for five rivinhome buildings and two singl�fanuly houses; and
WHEREAS, the appropriate City departments haue reviewed the plat and found, subject to the recommended conditions,
that it meets the requirements of Chapter 67 of the Zoning Code; and
��REAS, notice of a public hearing before the City Council was duly published in the official newspaper of the City
and nofices were mailed to each owner of affected property including all properiy situated within 350 feet of the subject
property;and
WHEREAS, the City Council held a public hearing on the proposed plat on July 7, 2004, where all interested parties
were given the opportunity to be heazd and the Council considered all the facts and recommendations concerning the plat;
NOW, TF�REFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for ten twinhome lots and 2 single-family lotsat 766 Hall Avenue subject to the following condition:

The ptat shall show underlying and adjoining plat and right of way information, such as, but not limited to,
the adjonvng street names and right of way swidths, lot and block numbers, and additional names;
25 2. A note on the plat states "DENOTES 1/2 INCH BY 14 INCH I1ZON PIPE MONUMENT THAT WILL
26 BE SET WITHIN ONE YEAR OF THE RECORDING OF THIS PLAT." However, the City

E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2'/: acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land.
§67.406 provides criteria for review of subdivision applications. These criteria are covered
below under "Required Findings."
F. HISTORY/DISCUSSION: in 1978 the property was rezoned from R-4 Single Family
Residentiai to RT-1 Duplex. It has been used for a single house for many years. The
northern edge of the site is a bluff, but the southem portion is relatively flat. The plat places
development on the southern portion and designates the northern portion as bluff
protection.
G. DISTRICT COUNCIL RECOMMENDATION: Support
H. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that ali of the following
findings shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislative Code are complied with. This condition is
met. City staff have reviewed the proposed plat and have determined that ali appiicable
provisions of city codes are met. In addition, the newly-adopted Storm Water Runoff
Control ordinance (Chapter 52) must be compiied with in order to obtain building
permits. That ordinance covers the state requirements and are generalty as restrictive
as watershed organization requirements. There are some technicai changes to the final
plat required by the surveyor including:
a. The plat shail show underiying and adjoining plat and right of way information, such
as, but not limited to, the adjoining street names and right of way swidths, tot and
block numbers, and additional names;
b. A note on the plat states "DENOTES 1/2 INCH BY 14 INCH IRON PIPE MONUMENT
THAT WILL BE SET WITHIN ONE YEAR OF THE RECORDING OF THIS PLAT."
However, the City subdivision ordinance does not ailow for delayed staking.
Therefore, that note will have to be modified to represent this requirement

on the Preliminary Plat:
1. Subdividing the site with such steep slopes and sandy soils needs to be done with great caze,
• especially for slopes greater than 12%. Because of the slopes involved, it is very important
that the principles of the Ramsey County Erosion and Sediment Control Handbook be
followed during constnzction. You may obtain the Handbook by calling 651-488-1476 at the
Rasnsey Soil and Water Conservation District.
Because of the steep slopes north of City View Lane, we do not believe it is advisable to
build on Block l, I.ots 1 and 2. These lots should be eliminated from the plat and the azea
should be incorporated into Outlot A. The final plat should show this azea as one of slope
stabilization using techniques as spelled out in the RSWCD Handbook.
3. 'i'he size oi tiie ium-azound is not sufficient for municipai fire veiucies. Site plan guidelines
(enclosed) show the required specifications.
4_ The site plan shouid show the units as duplexes, in order to conform to the zoning code. The
requirement for a connection between units could be met by constructing a min;mal
connection such as a breezeway between units.
5. Trees should not be disturbed on the north side of the private street, except as is needed for
the turn-azound, pazking bays and slope stabilization.
6. Review the requirements of plats which include listing the Section-Town-Range-Plat in the
pazcel description, as well as the pazcel size in squaze feet.

The Department of Public Works has completed a review of the preliminary and finai
plat of City View Addition and has the following comments
1) The plat should show underlying and adjoining plat and right of way information, such
as, but not limited to the adjoining street names and right of way widths, lot and block
numbers, addition names etc.
2) There's a note on the proposed plat stating "DENOTES 1/2 INCH BY 14 INCH IRON
PIPE MONUMENT THAT WILL BE SET WITHIN ONE YEAR OF THE RECORDING
OF THIS PLAT." Per the city subdivision ordinance, no delayed staking is allowed.
Therefore that note will have to be modified to represent this requirement. The surveyor
wiil have to set and mark the boundaries of the plat, and the interior lots and blocks
before the plat can be approved and recorded. The surveyor must comply with MN
Statute 505.02 subd.l with regards to monumenting and dimensioning his plat.
The surveyor will have to monument the plat with regards to the type and size of the
monumentation in accordance with the City of St Paul subdivision ordinance, Sec
67.600 Required Improvements. it appears the surveyor wiil compiy with this
requirement based on the quotation mentioned in the previous paragraph.
3) The surveyor should contact this office for survey notes that might he�p him in
determining and verifying the plat boundary. Cail Mike Murphy at 651-266-6076.
4) The plat boundary needs to be tied to at least two government land corners as per
the City's subdivision ordinance.
