The applicant is proposing to construct a 6-story condominium building with two floors of underground parking. The majority of this pazcel is zoned P-1, except for the duplex lot on the east side of the site which is zoned RM-2, even though the corner has never been developed for off- street pazking. The entire parcel is within the Historic Hill Preservation District. The appiicant is in the process of rezoning the entire parcel to RM-2 and the following fmdings and variances are based upon the assumption and condition that the rezoning will be granted. This parcel is located in a mixed use neighborhood that includes multi-family residential, commercial and institutional uses. A multi-family residential structure is a permitted use in an RM-2 zoning district and is a reasonable use for this site. The setbacks and lot coverage proposed are similar to other multi- family residential structures in the azea. The off-street parking proposed at 1.2 spaces per unit, while not up to current standards, is greater than many of the other properties in the area. In addition, the property is neaz a major mass transit route along Selby Avenue. Developing a high quality residential building that meets Historic Hill guidelines and is consistent with the size and style of other buildings in the neighborhood cannot be accomplished under the strict provisions of the code. o� - S'o3 2 3 2. The plight of the land owner is due to circumstances unique to this 4 property, and these circumstances were not created by the land owner. 5 6 The development of this site is complicated by several factors: the need to 7 provide off-street pazking on a relarively small parcel requires 8 underground pazking, the need to design and buiid a structure comparible 9 with the Historic Hiil guidelines and the character of the neighborhood, 10 11 12 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 3 and the need and desire to provide housing units in a wide range of size and afford ability. These are circumstances that were not created by the applicant and effectively prevent the property from being developed without variances. T7xe proposed variance is in keeping with the spirit and intent of the code and is consistent with the health, safety, comfort, morals and welfare of the inhabitants of the City of St. Paul. The proposed development will offer a variety of units ranging from studio apartments at approximately $140,000 through 2-bedroom plus units at $310,000 with some of the units handicap accessible. The Housang Chapter of the Comprehensive Plan calls for a diversity of housing units in size and cost to meet market demand. It also encourages developments of sufficient density to support mass transit. The applicant owns the two adjacent apartment buildings on Western Avenue as well as the gravel surfaced parking lot behind the buildings. At the present time, the parking area is a separately designated parcel. There was some discussion of attaching this parcel to the proposed development, but it would make more sense to use it for parking for the exiting apartment building since they have no off-street pazking at ali. The applicant is proposing to provide access to the trash storage area of the new building through this lot. This will require an easement agreement between the two properties. Although the proposed building will have enough off-street pazking for most occasions, a shared parking agreement between the two existing buildings and the proposed building would provide some overflow parking should the need arise. The pazking agreement could be incorporated into the access easement and would not need to designate any specific number of spaces but be on an"as available" basis. To this end, the parking lot should be paved and striped to current standards. With these conditions, the proposed variances aze in keeping with the spirit and intent of the code and will not affect the heaith or safety of nearby residents. 4. The proposed variance will not impair an adequate supply of Zight and air to adjacent property, nor will it aZter the essential character of the surrounding area or unreasonably diminish established property values within the surrounding area. The top floor of the proposed building will be setback from the lower floars so as to not be visible from street level. This, together with the setbacks proposed for the building, will provide adequate sepazation from Page 2 of 4 o y- go3 2 adjacent properties so that the requested variances will not significantly affect the supply of light or air to those properties. 4 The proposed building will be sunilar in height to the neazby Hill Plaza 5 building and the Commodore Hotel building. The property is within walking distance of nearby shopping and diuing establishments along Selby Avenue and is similaz to other recent pedestrian-oriented developments in the azea Provided that the applicant obtains design approval from the Heritage Preservarion Commission, the proposed development will not change the chazacter of the neighborhood and should be an asset to the area. 5. The variance, ifgranted, would not permit any use that is not permitted under the provisions of the code for the property in the district where the affected Zand is located, nor would it alter or change the zoning district classiftcation of the property. A multi-family residential development is a perxnitted use in an RM-2 zoning district. Provided that the property is rezoned to RM-2, the proposed variances will not change or alter the zoning classification of the property. 6. The request for variance is noz bused primarily on a desire to increase the value or income potential of the parcel of land. The proposed variances are based on a desire to conshuct a building that is consistent with the goals of the Comprehensive Plan and compa6ble with the historic character of this neighborhood. And, Whereas, Pursuant to the provisions of Leg. Code § 64.205, Mark Voerding duly filed an appeal from the determinarion made by the BZA and requested a hearing before the City Council for the purpose of considering the actions taken by the BZA; and Whereas, Acting pursuant to Leg. As part of our analysis, �ie looked at the whether we could attain a reasonable use of the property within the current zunins requirements. We determined that we could build 40 units in a four- story buiiding with two levels of parkin� and 60 stalls. That project woufd lose over $Z.1 million and would not be economically feasibie at our market segment of $200/square foot average sales price. 7'he uniYS would have to sell at over 5�300/square foo[ average sales price for such a building, �vhich would make the marketability and risk profile ofthis project not economically schievable. A simi(ar analysis was performed for a five-story building, and ttie same analysis prevailed, but the loss was lower, although the sale price per square foot H-as still too risky in today's market place and from our bank's perspective in order to secure a loan. Although the economic loss wouid now decrease to approximately $SOO,OOOfor the project, we would now require variances in setback, density, height, lot coverage and parkii�g, similar to the ones we are asking for in this application. Only when we reach a six-story heiaht and 69 units can the owners of this land build the project economicatiy and profitab(y. Additionally, and quite importantly, our work with the HPC, has helped us build a strong consensus with the commissioners that a six story building, with site lines that woutd allow residents to onty see �i>>e of the six stor•ies is the best compromise for both the developer, iand owners and neighborhood. This design feature is important to point out since it witl change the visual site lines of the building, and although we will be asking for a height variance of 76 feet, pedestrians will only see the first five stories or approximately 60 feet of the building. I came to Saint Paul from Kansas City, which has its share of stately apartment buildings along Armour Bouievard and surrounding the Country Club Plaza. They date to a time when apartment living in or near the heart of the city was a signnicant, even preferred, lifestyle option. The building planned for Western and Marshall reminds me very much of these wonderful old buildings. It has the same visual impact; it has a Iot of "curb appeal". So, yes, I am in favor of this plan. Brian has been a good landlord and I trust that he will want this project to be implemented, and the buiiding to be managed, in a quality manner. He's got quite a stake in the neighborhood's success. What about traffic? it will increase. Is it awful now? I don't think so. I walk and cycle these streets a Iot. Dale isn't a good piace to be at times. The brick paving on the shoct stretch of Virginia 6etween Dayton and Marshall might not hold up to the new tra�c. On the other hand, maybe the new neighbors will arrive up Marshall from John Ireland and leave going north on Westem. Or perhaps, like me, they will walk downtown or to the bus stop... or hop on their bike... for Yheir daily commute and their weekend activities. Although the proposed building will have enough off-sh parking for most occasions, a shazed parking a� between the two exisfing buildings and the proposed buildin� would provide some overflow parkin� shoutd the need arise. They had tried to reach outto the Ramsey Aill Associarion, but could not get in contact with them. They have tried to reach out to everyone invoived to deveiop this project, because they believe that it is a win-win situation for the neighborhood. I3e summarized the main points of the six findings of the staff report. They did three studies a density analysis, hei�ht analysis, and a sight line analysis. This is a very dense mixed use neighborhood. With many apartment buildings, duplexes, ten-plexes in the surrounding blocks, as well as an entertainment district, and a dining dish hvo blocks south. AIthough they are asldng for a variance for the fzont setbacks on Marshall, this is not un-similar to other buildings in the area including the apartment building on the comer and they are asking for similaz setbacks in the neighborhood. They aze asking for a 12 to 1 variance in the off-street pazking required for the building. It is lower than 1.5, however, it is greater than what is found in many of the ad}oining areas. Parldng was a big issue with the Sw University Council and at the business meering. While talking to Mr. Hardwick about his recommendations, they thought it made sense for them io create a shazed parldng agreement so that in addition to the 80 underground parking stalls they are creating, that they create a shared pazldng agreement so that they can allow as-is parlang on the adjoining lot, for b ests and residents. Additionally this is very close to a mass-�ansit route, promoting and helping it grow is part of the City's Comprehensive Plan. Looking at the proposal for the building, we are proposing 42 units under $200,000. This is below the average metropolitan cost which is �205,000. We are proposing studio units in the $150,OOOs with parking, one bedrooms in the low $160,OOOs to $180,OOOs with pazking. One bedroom pluses in the low $200,OOOs. The units on the sixth floor will obviously be the highest priced, we are able to leverage that with the rest of the buiIding so thaT we can provide affordable housing throughout. They cannot do any of this without variances to the Zoning Code. A lot of the augmentarion to the building came out of ineeYings with the HPC and were required to get HPC approval of the project. The double-hung windows, stone on the outside of the building, and other requirements aze not their requirements they are the HPC's requirements. Providing the underground parking on a relarively small lot as well as the HPC's requirements are things that they cannot control and changes some of the issues. The Saint Paul Comprehensive Housing Plan looks to two key things. Continuing and expanding the isadirional neighborhoods and to design and add new market demand. This project h to promote both of those things. This will ailow not only first rime home buyers who aze renters in the neighborhood to purchase housing. Nevertheless, it will allow seniors or those close to seniors who want to move and not have any maintenance, but to also buy and stay in the neighborhood. This supports mass-h�ansit, they believe the lower priced studios will attract not only people who do not have cazs, but those who use mass-transit. People can walk down two blocks and catch the bus. The sixth story of the building has been scaled back approximately 2200 squaze feet, and is recessed from the front of the building. Which was suggested by the HPC during the concept reviews, now walking around the building the sixth floor wili not be seen. This helps bring down the massing of the building and works better with what is already in the neighborhood. They aze asldng for RM-2 zoning, so if it is approved that is a nonissue. Conley, they own the buildings adjacent to this building. She presented the plans to all of the tenants in the building, many of whom would like to stay in the area. This vrill give them the opportuniry to purchase. There was opposition present at the hearing. Amy Michael, 587 Dayton Avenue, does not tl�ink Yhat people are in opposirion to the development. The concerns are with all the variances needed for the project. Every aspect of the building is requiring a variance. There is a zoning code and when every aspecY of the projecT needs to be tweaked something is not right. The code says five stories and ttris is pushing up to six stories. Every time we turn azaund someona is pushing, and pushing. Based on £mding number six this witl enhance the neighborhood it will help property values, but the project is ecanomically based. Parldng is an issue but even more important is traffic. There will be a lot more traffic on Western. She lives on Dayton. It is a dense neighborhood, there are many businesses azound, but this is a residential neighborhood. The majoriry of people in the neighborhood are single family homes with children, and families. Although the people and the density aze wanted, it is necessary that the City take caze of the traffic and parldng issues. She had spoken to the traffic manager who claimed that traffic was not a concern, however, he does not live in the neighborhood. He is not out walldng, he is not out dealing with cars, trying to drive across Westem where there aze no stop signs. These aze all factors of a big huge building coming in next door. Christopher Yerkes, 507 Ashland Avenue, stated that he thinks we can all agree that this is a beautiful building, it is incredibly nice. The appiicants have spoken with the HPC and they want to do this and that. The HPC looks at the buiIding they do not look at the variances or setbacks, that is not their concem and they deferred it to the Boazd. One of the findings is that there can be no other reasonable use under the code. This is a huge parcel especially far this neighborhood. The Battle Electnc site is a similar size, maybe a little smaller. Something like that couid be done, build some two-story homes. Downtown on east seventh there aze ail those new buildings, if we want to make something that dense those aze not more than fifty feet. In downtown Minneapolis, nothing north or south of the Hennepin Avenue Bridge is more than fifty feet high. Most of them aze two or ihree stories, but there aze plenty of options that this site can be used for. The room variance is huge, and the variance for the height is huge. The applicants talk about the units being affordable because they are under �20Q000. He could purchase a home under �200,000. There was a house he looked at that was $279,000 and it was 28,000 square feet. Before the applicants said that they did not include parldng in the price of the unit. He believes that for the $180,000 you aze getting 500 some square feet not 1,000, not 2,000 you get a little hunk. They talked about how the pazldng will be accessed on Marshail so it will not affect Dayton. Marshall is one way so you either have to �o down Dayton or Selby. She supports a project on the site and the zoning chanee. These cariances aze way over the top. The building faces �Iarshall, but Mazshall was not in the slides preseated by staff. ?iiarshall is not unlike ihe rest of our community which is lazger than this lot by the way. T'here aze four-story and three-story apartment buildings in the community. There are numerous homes whether they are condos or not. They aze two-and-a-half story homes. The Commodore wiuch is a very lazge building and the other vary large building in our neighborhood which is the old Ana s Hote3. This will be another huge gargantuan building in our couununity that will be totally out of scale and out of character with the rest of our residenrial community. She feels that there is a reason for the zoning code, and she appreciates that there are rimes when the variances are needed. This is going to be one huge building on a residential street made up of two-and-a-half story homes. She requested that the Boazd deny the variances, so they can continue to work with the developer to come up with a plan that can accommodate the developers needs as well as those of the community. Mark Verding, 113 Farrina on Street, about four blocks away from the site. He is not the Director of the Ramsey Hill Association, he is the president of the Associafion and they have not taken a stand on this project, but have referred people to participate in the District 8 Planning Council meetings. At the last meeting people in the neighborhood were opposed three to one, more than three to one were opposed to the project. The issue is not how many people are for or against the project. The issue is whether or not the project complies with the Comprehensive Plan and answers the adopted code. Parking is only one major issue and there is already a shortfall of over two hundred and fifteen pazking spaces in that immediate area. Originally that property was zoned to meet the parldng needs of the businesses in the Selby and Western area, that opportunity will now be gone. Much has been made about the availability of public transportation and the desire to meet the Cities transportation goals. University Avenue is the main h corridor in Saint Paul. The City's own fransportarion oriented development plan calls for a five-story limit on Universiry Avenue and then stepping down as the distance from the Avenue increases. Does it make sense in this neighborhood to allow an additional twenty-five feet on a building especially when the applicant has not demonstrated need nor an inabiliry to cons�uct a smaller building. Four stories would be in keeping with the adjacent properties. Fifty feet is the maacimum permitted under the code. The issue before the Board is not whether these aze aood people, whether or not they aze good developers, the issue is whether or not it meets the intent of the law. Based on the informarion that has been presented today he does not believe that it does and he encourages the Boazd to deny the requested variances. If it would not be permitted on University Avenue it should not be permitted on Marshall Avenue.
