Silverberg Scrap and Metal Company, 2575 Doswell Avenue ' Pursuant to the reque�s.t of the License Committee I have agai.n made a search of the law with respect to the problems arising out of this matter. It appears that the Supreme Court of the State of Minnesota _ has between 1962 and 1966 decided questions of this natnre in four i.mportaat cases. One dealt with a filling station, two dealt with the erection of apartment buildings, and another with an auto dismantling yard or junk pard. In each case the � Court, through J�stice Thomas Gallagher followed the same basic rule of, law. ' , This problem was also answered by this office in an opinion of Mr. Joseph P. Summers, Corporation Counsel, on July 25, 1968, in a matter involving the Shell Oil Company. These same four cases are mentioned by Mr. Snmmers in his opinion. The basic doctrine of law appears to be that the owner of property which is properly zoned cannot be denied the use of the property for the purpose intended so long as there is no showing that this use of the property will result in a threat to public healtY�, safety, or morals or that it will create a serious traffic problem or the like. ' In Ostrand v. Village of North St. Paul, 147 N.W.2d 571, the Court said: �� �'� � . . • • \ r, License Committee ,2 A�gust 30, 1968 � "HTe are in accord with the oourt' s determination that defendant acted arbitrarily and unlawfully in denying plaintiff'�s application for a permit to con- � struct a multiple-�d�elling structure on his property. His application met all existing standards of the building and zoning ordinances of the village then in effect and appears to hane been rejected principally because of neighborhood opposition. In denying it, the village council did not follow the recommendations of its planning commission or consider the reports of - its police, fire, or health departments to the effect that no potential hazards would follow if an apartment ,• building were constructed on plaintiff' s property. The only other evidence received at the hearing were statements of property owners whose properties were adjacent to plain- tiff' s property to the effect that in their opinions their properties might be devalued if the permit were granted.* * *" (�itations omitted) Earlier in Olsen v. City of Minneapolis, 115 N.SnT.2d 734, the Court saids "* * * here it seems obvious that the city' s ` underlying motine in denying plaintiff the permit was its conclusion that the operation of a gasoline filling statio� in the location described would violate the • 'neighborhood concept' which it sought to insnre. The determination of plaintiff' s rights on such a basis cannot be permitted. It is settled that purely aesthetic considerations do not form a sound basis for nullifying or destroying definite or valuable interests in property without compensation therefor to the owner. * * * One who has acquired property zoned for particular purposes under a comprehensive zoning ordinance should be entitled to � rely thereon as against the arbitrary enactment of amendments thereto which result in the diminution in value or the restriction of his rights and interests in such property. "; and again in the same case: � "* * * In deciding this question, the council does not have authority to denp aspecial permit merely because it may disagree with some preceding council in its deter- mination that classification of plaintiff' s property under • h �f . . The council as now constituted is bound by the comprehensine zoning classification, subject only to the exception that, if there is evidence that a nuisance will result from a com- mercial use in a particular neighborhood, in its discretion it may deny an application for speeial permit� to conduct the business which would constitute a nuisance there. " In the case of the Silverberg operation we find a 13 acre tract, of �hich 5 acres, or approximately 200,000 square feet will be used in the business. Most of the operation will be the salvage of non-ferrous metals which will be conducted inside a new building erected for that purpose. This building is approxi- mately 60� feet from Sighway 280 which is a 6 lane. highway. The " distance from the Silverberg premises to the closest dwelling across the highway is consernatively estimated at several thousand feet. In addition, the applieant has indicated that he intends to blacktop the street in front of his building and to plant shrubs and grass on that portion of his property fronting on Doswell Avenue upon which he has alread constructed a fence. He has agreed that if a license is issued to him for the pur- poses ot engaging i•n scrap metal salvage, he will not at any ti�e ' bny or sell or have on his premises any junked car�a or other vehicles. He does not intend to do any of the burning normally connected with this business ,such as burning off insulation from saTnage wire and burning upholstery and other flammable materials of' junked motor - vehicles. He further agrees to erect additional opaque fencing to a height of 8 feet on all of the property used in connection with his business. There is presently a fence on the property fronti.ng on Doswell Avenue. The building itself will screen the property from that part visible from Highway 280, and he will erect a fence running from the north building line west to the drainage ditch which is the Minneapolis-Saint Pa�l city bonndary line. Tt is our pasition that this - matter should certainly be dealt with in a similar manner, so �hat the council would have the benefit of the recommendation of tlie Board of Zoning, who would, in turn, be able to �receive all pertinent information from those notified of the hearings. The proposed area for the �installation of a �unliyard is locate.d within a heavy industry district, whach permits nearly any kind of business activity except those "where it wauld unre«sonably interfeie with any industrial use of property previously established within the vicinity, or with any i�ermitted use of property in a more r�stricted district " (Sec. °'60.07) . We submit tha� a �unkyard would defi.nitely interfere with ad�aceiit business uses, as well as with surrounding residential property. Under the circumstances we recommend that your body refer the mat�:er ta �the Board of Zoning for a Certificate of Con�ormarice "� pursuant to Section 64.05 , and have the Zoning Board make its . recommendations concerning the suitabili�;y of these premises for a �unkyard. Then those in opposition could demonstrate the oUvious land-use defect in permitting the establisYunent of a �unkyard at the proposed location. ' We vrish to take this opportunil;y to thank you for giving us the right to come before your body on the two occasions when the matter was discussed previously, and we sincerely hope that you will accept our recominendations, and not, as suggested by the Silverberg Company, merely take the position �that the City Council is legally pr�vented frora discharging its cliarter responsibilities to protect its residents from this type of detrimental land-use .
