Befween the City of Saint Paul and Ramsey County
THI5 AGREEMENT, made and entered into this ist day of July, 2004 by and between
the City of Saint Paul, Minnesota, a municipal corporation under the laws of the State of
Minnesota, hereinafter refened to as "Citp," and Ramsey County Conections-Juvenile Service
Center, whose address is 25 W. 7"' St., 5uite E153, St. Paul, MN 55102, hereinafter referred to as
"Provider".
The City and Provider, in consideration of the mutual terms and conditions, promises,
covenants, and payments hereinafter set forth, agree as follows:
SECTION 1: Scope of 5ervices.
A. The City does hereby retain the Provider to perform to perform those tasks as
described in the attached state grant proposai. See attachment A_ The Provider agrees to
implement and operate the project in accordance with the terms of this agreement and with the
terms and conditions of the grant contract proposal(attached). The Provider agrees to operate the
project in a manner consistent with the City's legal requirements and as desctibed in this
agreement. The Provider agrees that it will not carry out activities or use funds in any way that
jeopardizes the City's status. The Provider agrees to provide all information and prepare all
reports, including interim and final reports, required by the grant contract from the State of
Minnesota, with the Ciry's final approval. This contract is contingent upon the city receiving final
grant contracts from the State of Minnesota in the amounts detailed on Attachment A.
B. This grant has been approved by the State of Minnesota Office of Justice for one year.
SECTION 2: Time For Completion.
A. The sezvices rendered by Provider shall be commenced upon execution of the
Agreement and notification by the City to proceed and will be completed in accordance with the
schedule mutually agreed upon with the City but no later than June 30, 2005.
B. Provider shall not proceed with auy task without specific authorization from the Project
Manager designated by the City.
C. In the event there are delays caused by actions of the City or wluch may be reasonably
requested by the Provider which can change the completion date, Provider sha11 request an
extension of time for completion of the pro}ect. The Project Manager will review the request and
may grant to the Provider such extensions of contract time as maybe reasonable.
SECTION 3: Biilings and Payment.
A. That for Provider's faithful performance of this Agreement, the City hereby agrees to
compensate the Provider in the amounts and according to the grant. The grant will reimburse

$32,763 per year for these services. Provider is required to record their match when submitting
their grant expenses for reimbursement. Match for this contract is $3,640.
B. The above amounts shall fully compensate the Provider for ali costs. No claim for
services andlor costs provided by the Provider, not specifically provided for in tius Agreement will
be honored by the City. Tota1 reimbursement for the project shall not exceed $32,763.
C. Provider shall submit an itemized invoice and tasks completed each quarter. Copies of
original invoices for goods and services must be provided. Invoices for supplies, equipment, and
other items purchases must include the vendor name/address, purchaser namefaddress, order date,
items purchased, cost for each item purchased, and total cost. Invoices for
consultantsiprofessional services must include the consultant name/address, name{address of who
the service was provided for, number of hours and cost charged for each day service was
provided, details for service/work done each day and total cost. Invoices for wages and benefits
must include the work completed, employee name, employee title, gross pay, number of hours
worked, pay rate, date paid, employee �vithholdings, and itemized employer benefits paid for each
employee. Upon receipt of the invoice and verification of ihe charges by the Project Manager,
payment shall be made by the City to Provider within thirty (30} days.
D. In the event the Provider fails to comply with any terms or canditions of the Agreement
or to provide in any manner the work or services as agreed to herein, the City reserves the right to
withhold any payment untii the City is satisfied that carrective action has been taken or
completed. This option is in addition to and not in lieu of the City's right to termination as
provided in other sections of this Agreement.
SECTION 4: Project Management.
A. The City requires the Provider to assign specific individuals as principal project
members and to assure that the major work and coordination wi11 remain the responsibility of

B. The City has designated Amy Brown, as the Project Manager for this Agreement, and
the individual to whom a11 communications pertaining to the Agreement shall be addressed. The
Project Manager shall have the authority to transmit instructions and receive information
regarding the grant. Any request for budget or other amendments or changes to the Agreement,
and any interpretation or definition of tbe City's policies and decisions pertinent to the work
covered by this Agreement must be reduced to writing and forwazded to Amy Brown, for final approval
and before any changes or spending can occur. Budget adjustments do not require a contract amendmertt
unless changing the entire amount of the coirtract ar unless they substantially alter the scope of services to

SECTION 5: City Responsibilities.
A. The City agrees to provide the Provider with access to any information from City
documents, staff, and other sources needed by Provider to complete the work described herein.
SECTION 6: Work Products, Records, Dissemination of Information.
A. For purposes of tlus Agreement, the following words and phrases shall haue the
meanings set forth in this section, except where the conte�t clearly indicates that a different
meaning is intended.
"Workproduct" shall mean, any report, recommendation, paper, presentation, drawing,
demonstration, or other materials, whether in written, electronic, or other format that results from
Provider's services under this Agreement.
"Supporting documentation" shall mean any surveys, questionnaires, notes, research,
papers, analyses, whether in written, electronic, or in other form, and other evidences used to
generate any and all work performed and work products generated under this Agreement.
Business records" shall mean any books, documents, papers, account records and other
evidences, whether in written, electroniq or in other form, belonging to Provider and pertaining
to work performed under tlris Agreement.
B. All deliverable work products and supporting documentation that result from the
Provider's services under ttus Agreement sha11 be delivered to the City and shall become the
property af the City after final payment is made to the Provider with no right, title, or interest in
said work products or supponing documentation vesting in Provider.
C. The Provider agrees not to release, transmit, or other wise disseminate any information
associated with or generated as a result of the work performed under this Agreement without
prior knowledge and written consent of the City.
D. In the event of termination, ail work products, whether finished or unfinished, and
supporting documentation prepared by Provider under this Agreement shall be delivered by
Provider to the Citp by the teraunation date and there shall be no further obligation of the City to
Ptovider �cept for payment of amounts due and owing for any authorized work performed and
expenses incurred to the date and time ofternrination.
E. Provider agrees to maintain all business records in such a inanner as will readily
conform to the terms of ttus Agreement and to make such records available at its oflice at all
reasonable times during the Agreement period and for six (6) years from the date of the final
payment under the contract for inspection or audit by the City, the State Auditor, or other duly
authorized representative.

F. Provider agrees to abide strictiy by Chapter 13 of the Miunesota Statutes (Minnesota
Government Data Practice Act) as well as any other applicable federal, state, and local laws or
ordinances, and a11 applicable rules, regulations, and standards established by any agency of such
governmental units which are now or hereafter promulgated insofaz as they relate to the
Provider's performance of the provisions of this Agreement.
SECTION 7: Equal Opportunity Employment.
A. The Provider will not discriminate against any employee or applicant for employment
for work under this Agreement because of race, creed, religion, color, se� se�a1 or affectional
orientation, national origin, ancestry, familial status, age, disability, marital status, or status with
regazd to public assistance and will take affirmative steps to ensure that appiicants are employed
and employees are treated during employment without regard to the same.
This provision shall include, but not be limited to the following: employment, upgrading,
demotion, or transfer; recruitment advertising, layoff or termination; rates of pay or their forms of
compensation; and, selection for training, including apprenticeship.
SECTION 8: Compliance With Applicable Law.
A. Provider agrees to comply with all federal, state, and locai laws or ordinances, and all
applicable rules, regulations, and standards established by any agency of such governmental units,
which are now or hereafter promulgated insofar as they relate to the Provider's performance of
the provisions of this Agreement. It shall be the obligation of the Provider to apply for, pay for,
and obtain all permits andJor licenses required.
SECTION 9: Independent Contractor.
A. It is agreed by the parties ihat, at all rimes and far all purposes within the scope of this
Agreement, the relationslup of the Provider to the City is that of independent contractor and not
that of employee. No statement contained in ttus Agreement shall be construed so as to find
Provider an employee of the City, and Provider shall be entitled to none of the rights, privileges,
or benefits of Saint Paul employees.
SECTION 10. 5ubcontracting.
A. The Provider agrees not to enter into any subcontracts for any of the work
contemplated under tlris Agreement without obtaining prior written approval of the City.
SEC'I'ION 11. Hold Harmless.
That each party will be responsible for their own acts or omissions for their employees,
agents and officials. Notlung in tlris agreement shall constitute a waiver by either party of any
statutory limits or exceptions on liability.
5ECTION 12. Assignment.
A. The City and Provider each binds itself and its successors, legal representatives, and
assigns of such other party, with respect to all covenant of tlus Agreement; and neither the City

nor the Provider will assign or transfer their interest an this Agreement without the written consent
of the other.
SECTION 13. Terminadon.
A. This Ag� will cont3nue in full force and effect until completion of the project as
described herein unless it is ternaivated at an earlier date by either pariy. Either party to tlus
Ageement may termiaated it by giving no less than thirty (30) days written notice of the intent to
termina.te to the other pariy.
B. With Cause. The City reserves the right to suspend or terminate this Agreement if the
Provider violates any of the terms or conditions of this Agreement or does not fulfill, in a timely
and proper mannet, its obligations under this Agreement as determined by the City. In the event
that the City exercises its right to withhold payment or Cerminate under tlus SecCion, it shall
submit written notice to the Provider, specifying the e�ent of such withholding or temunation
under tlus Section, the reasons therefore, and the date upon which such withholding or
termination becomes effective. Upon receipt of such notice, the Provider shall take ali actions
necessary to discontinue further commitments of funds to the extent that they relate to the
suspended or terminated portions of this Agreement.
C. In the event of termination, the City will pay Provider for all service actually, timely,
and faithfuliy rendered up to the receipt of the notice of termination and thereafter until the date
of termination. The Provider will deliver all work products and supporting documentation
developed up to the date of terminauon prior to the City rendering final payment for service.
SECTION 14: Default by Consultant.
In the event Provider fails or negiects to compiy with any term or condition of tlus
Agreement or to provide the services as stated herein, City shall have the right, after written
notice, to cease payment hereunder. Tlus remedy shall be in addition to any other remedies,
including temvnation, available to the City in law or equity. The City shall be entitled to recover
reasonable attorney's fees and costs of collection associated with enforcing its rights hereunder.
SECTION 15: Amendment or Changes to Agreement.
A. City or Provider may request changes that would increase, decrease, or otherwise
modify the Scope of Services. Such changes and method of compensation must be authorized in
writing in advance by the City.
B. Any alterations, amendments, deletions, or waivers of the provisions of this Agreement
shall be valid only when reduced to writing and duly signed by the parties.
C. Modifications or additionai schedules shall not be construed to adversely affect vested
rights or causes of action which ha�e accrued prior to the effective date of such amendment,
modification, or supplement. The term "this AgreemenY' as used herein sha11 be deemed to
include any future amendments, modifications, and additional schedules made in accordance

SECTION 16. Notices.
Except as otherwise stated in tlus Agreement, any notice or demand to be given under this
Agreement shali be delivered in person or deposited in United States Certified Mail, Return
Receipt Requested. Any notices or other communications shall be addressed as follows:

SECTION 17. Waiver.
Any failure of a party to assert any right under this Agreement shall not constitute a
waiver or a termination of that right, this Agreement, or any of tlus Agreement's provisions.
SECTION 18. 5urvival of Obligation.
A. The respective obligations of the City and Provider under these terms and conditions,
wluch by their nature would continue beyond the termination, canceilation, or ea�piration hereof,
shall survive termination, cancellation or e�piraUon hereof.
B. If a court or governmental agency with proper jurisdiction deternunes that this
Agreement, or a provision herein is unlawful, this Agreement or that provision, shall terminate. If
a provision is so terminated but the parties legally, commercially, and practicably can continue ttus
Agreement without the terminated provision the remainder of this Agreement sha11 continue in
effect.
SECTION 19. Interpretation of Agreement, Venue.
A. This Agreement shall be interpreted and construed according to the laws of the State
of Minnesota. All litigation related to this Agreement shall be venued in the District Court of the
County of Ramsey, Second Judicial District, State of Minnesota.
SECTION 20. Force lYIajeure.
Neither the City nor the Provider shaii be held responsible far performance if its performance is
prevented by acts ar events beyond the party's reasonable control including, but not limited to:
severe weather and storms, earthquake or other natural occurrences, strikes and other labor
unrest, power failures electrical power surges or current fluctuations, nucieaz or other civil
military emergences, or acts of legisiative, judicial, executive, or administrative authorities.
SECTION 21. Entire Agreement.
A. It is understood and agreed that this entire Agreement supersedes all oral agreements
and negotiations between the parties relating to the subject matters herein.

Local Plan
Units of Iocal govemment that are eligible to receive JABG funds must estabiish a Coordinated
Enforcement Plan to reducing juvenile crime, developed by the iocal Juvenile Crime
Enforcement Coal'�tion (JCEC).
Coordinated Enforcement Pian for Reducing Juvenile Crime
This pfan developed by the focai JCEC is based on an analysis of tocal juvenile justice system
needs. The analysis determines the most effective uses of funds, witfiin the sixteen JABG
Program Purpose Areas. This analysis is needed in order to achieve the greatest impact on
reducing juvenile delinquency, to improve the juveniie justice system, and to increase
accountability for juvenile offenders.

Local Plan for the City of Saint Paul
There is no sm�le program that meets the numerous needs of ois youth. We beiieve that the
following plan addresses a number of the most significant problems that we face today. While it
will not solve all of our problems, we believe that we wiil be able to show substaurial results.
The plan may be considered in four main areas:
1} Enhanced Ptnbation- Deals with ttte chronic serious youthful offender in order to show that
there aze consequences for our actions and with this pro3ram we can have those consequences
rendered immediately, hopefully emphasizing the fact that a person must take responsibility for
their actions. Ttus project allows us to team up with Ramsey County Probation in order to see
that the actions of these juveniles can be dealt with immediately.
Z} Gang Intervention- Enables juveniles to take a step toward turning theiz life araund. Many
make a mistake at a young age and then do not lrnow what to do to change things. This proe,,ram
assists them in a number of azeas•helping them to become capable, productive and responsible
citizens. We will be working with a non-profit agency in Saint Paul.
3) Truancy and Curfew Sweeps- The purpose here is to assist juveniles to see that they must
attend school and obey the curfew laws. Not only are the juveniles taken o€f the street, they are
taken to a center where an adult will be able to talk with them and find out if there might be other
problems that need to be addressed. �Iere we have the opportunity to team up with other
agencies and Saint Panl Schools in order to work on these two problems.
4) Mentoring- Providing caring adults to at-risk youtt� to mentor and pravide role models has the
greatest potential of assisting these youth. We will provide mentors using police officers
participating with non-profit agencies in Saint Paul with their after school enrichment pmgrams.
The youtl� will come to see the officers as friends and resources, rather than as someone to be
feazed.

Federal law requires that a unit of locat govemment, to be e(igibie to receive a JABG award or
sub-grant, must have impfemented or agreed to implement a policy for testing appropr+ate
categories of juveniles wfthin the juvenile justice system fior use of controlied substances.
The categories of juveniles within the juveniie justice system that are "appropriate° for testing
sha(f be determined by the Chief Executive Officer of the State certifying compiiance or by the
applicant unit of locat govemment. it is expected that appropriate categories will vary among
jurisdictions depending on their needs and resources. States and units of 4ocal government are
encouraged to include drug treatment in their overall pian to reduce jwenile drug use.

All juveniles are tested at the local Juvenile Carrectional Facility. They are atso tested on a
random basis when on probation for controlled substance use.

2pp4 dABG APPLICATION; NARRATIVE
The City of Saint Paul is home to a significant number of minority youth in Minnesota and
overrepresentation of minority youth in the juvenile justice system is significant. Minority groups
representing the lazgest difference when comparing population versus arrests az'e Black, Asian, and
Hispanic, also the three largest minority groups in Saint Paul. Accordin� to the 2004 U.S. Census
gureau, Asians comprise 12.3%, Blacks 11.4%, and Hispanics 7.9% of Saint Paul population (31.6°fo of
Saint Paul's total population). Saint Paul juvenile azrests in 2002 portray a different picture than that of
its population. Asian, Black and Hispanic juveniles tota166% of Saint Paul's 2002 juvenile arrests, an
overrepresentation of more than double the general population for these minorities. Overrepresentation is
significant, the need to intervene in these three minority groups is crucial. A two-tier approach will be
utilized to impact tlris overrepresentarion because Asian youth are not prevalent in the pre-court diversion
services. The first tier will deal with diversion services for Black and Hispazuc youth. The second tier
will provide services for Asian youth in Enhanced Probation.
Annually in St. Paul apprwcimately 500 youth that have been arrested for a first-tune misdemeanor
offense aze provided with pre-court diversion services by St. Paul Youth Services. For youth tk�at
successfully complete this program, only 5% commit an additional offense within the next 6 months.
There are, however, an additiona160-70 youth annually that do not follow through with a referral to
diversion. This is because:
1. Phone numbers are either inaccurate or calls are not returned AND letters aze returned, or
2. Youth and parent do not attend meetings after two appointments aze scheduled.
Data from Ramsey County Juvenile Court and the St. Paul Police Department shows that these 60-70
youth have an average of 4.b police contacts/airests eaoh and that 50°Io are charged in court with an
aciditional offense within the next 12 months. Further data shows that 85% are youth of co3or (compared
with 65% youth of color who participate in diversion) and their median age is 12 (compared with a
median age of 16 for youth who participate in diversion). The purpose of this gant will be ta locate these
60-70 youth and engage them in culturally-specific intervenrion services in order to reduce additional ]aw
enforcement and juvenile justice system contaet.

2004 SABG APPLiCATtON: I3ARRATIVE
The initial challenge in these activities will be to locate the youth and their family in order to engage them
in the diversion process. T'his will be accomplished by having a St. Paul Police officer and case
coordinator assi�ed to receive referrals from St. Paul Youth Services of youth that did not comply with a
referral to diversion. The police officer and case manager will use police and school records to locate the
child and family. They will visit home, school and community locarions is order to accomplish this. The
ne�ct task will be to engage the youth and pazent in the diversion process. The case coordinator and police
officer will provide a team approach tl�at offers families both support and assistance as well as
information about failure to comply. An assessment of the youth and fanuly needs/issues will be
completed and this information wiil be shared at a}oint meeting with the youth and family, case
coordinator and a culturally-specific service provider. At that point a case plan will be developed to
address these needs/issues. Items that can be included in the case plan aze: (1) restorative justice circles,
(2) coinmunity service projects, (3) skill-building activities, (4) leadership development activities, (5)
academic enhancement activities. Culturally-specific service providers will then work with the youth and
parent to implement the plan.
The second tier of this proposal focuses on Asian juveniles currentty a part of the Ramsey County's
Enhanced Probation system. As the Asian population in Saint Paul becomes increasingly significant, the
number of arrests has increased as well. From 1995 to 2002, Asian juvenile arrests have increased 35°l0
(431 to 583). There are currently 36 Asians in enhanced probation, the lazgest number of any race.
Staristics reflect that a small portion of the population comprise a large portion of police contacts. The
average number of contacts in a sample group of 16 Asian male in Enhanced Probation was 8.5. This
proposal's intent is to move the community support aspect of the Enhanced Probation progam from a
referral relationship to a more active partnership. Asian juveniles part of Enhanced Probation will be led
through a similaz restorative justice program, as described above, geared more specifically toward Asian
juveniles and the issues they face. Restorative}ustice circles, community service pro}ects, skill-building
activities, leadership development activities, and academic enhancemeirt activities will be used so that the
youth gain more positive adult guidance and support and will need fewer police contacts and correctional
sanctions to maintain positive, conslructive behavior.
