Hearing was held a'n the matter of the ap�qlication of Shell Oil Co. for permit to install and operate a net�r�fi�lin� station at the northeast corner oi Rice St. and University Ave. . Letter of the Zoning Board was re�.d recommending that the application for construc-�ion pei-mit be delayed� until a I�iaster P1an is developed by the Capital Area Architectural and Planning Commission. ' Tir�.othy Quinn said he represents the owner of the subject properties as t•�ell as the Shell Oil Co. in�this matter and he said he feels tY:e Corporation Counsel might want the matter referred to him as soon as possible if he �*ere in Prir. �u.inn`s position. � He sa.id the Legi;slature, at the last session, passed 2d.S. 15.19 which created tre . Capital Area Architectural and Planning Commission and outlined the areas wY?ere the Commission was to concern itself as bounded by Edmund St., Jackson St., I.S. 9�+ and ° Rice St. and said that this� in effect, created a moratorium of all building in those �,reas, and that� it was also su�gested that the moratorium be extended to private buildings as well as governmental. P�,r. Quinn said that the �lttorney General sub- _ � sequently ruled' that to do this would in effect amount to the state's taking those properties andlsaid the property in question is owned by P�ir. Brand , and that the Council would agree that norma,lly this would be an ideal spot for a Shell station. He said that the le�ter of the Zoning Board requests the City to do ��rhat the state would not do,. �rhich is in effect to declare a moratorium on private building, and said that this� would deprive the o:•mer of the property of a chance of developing it or being able �to sell for a long period of time and th�.t this is in effect a taking of the proper 'ies. He said 2�Ir. Brand is getting old and that in the interests of the Brand family,�he would like to see the properties on a lon�-term and would think that if there� is any kind of unreasonable delay, the o,•mer would be required to put the matter into litigation. A'�. Quinn said he feels the Corporation Counsel would agree that it would be unfair to de].ay 'this just bec�.use of a letter of recommendation. Als indicated in the attached file this parcel is in- cluded in the boundaries of the Capitol Approach area as es- tablished by the sg67 Legislature . The City is in receipt of a letter of Rollin H. Crawford, Executive Secretary of the Capitol Approach Architectural an d Planning Commission request- ing, in relevant part,� that the permit for Shell Oil , as well as permits for other "substantial external physical alteration of land or buildings within the proscribed �ic7 bounds of the Capitol Area" be withheld until the Commission sh all establish . a mastei plan for the area. The subject property is correctly zoned for filling station� use , but St. Paul Legislative Code , Sec. 65. 05 (f) requires a Council hearing prior to the granting of a building permit for such a station. Such a permit has come to be known as a '�special use permit . �� An application for a special use ' permit 'stands in a different legal situation from an applica- tion for a rezoning. A rezoning involves the legislative judgmerit of the Council, whereas the granting of a special use peimit is in the nature of an administrative decision. �Under Min.nesota law, a special use permit must be ' granted for a use permitted by the zoning classification of the subject property unless it is shown that the granting of the �permit will jeopardize the public health, safety, or welfare . July 25, �.g68 In �the present case , it is not urged by the Capitol Approach Architectural and Planning Commission nor the City Planning Board that the construction of a station in this lo- cation will create a hazard to the public health or safety. The Council is asked to deny the permit because the Commission has not as yet developed a comprehensive plan for the Approach area. I If such a comprehensive plan were adopted, the effectua- tion of its provisions with respect t�o use of privately owned lands would depend upon amendments by the Council to the St. Paul zoning ordinance , or upon acquisition of such lands through the Commission by gift; purchase , or eminent domain. Neither the stat�ute creating the Commission, Eg. Sess . L. 1g67 , Ch. 13, � 13;, nor Laws 1945 , Ch. 315, also applicable thereto, appears �to confer on the Commission any power to zone private property for land use within the Approach area. The Commission, essentially, is requesting the Council to adopt a "hold order" with respect to the Shell application, and other applications �or commercial construction in the Approac;h. area. IIn Alexander v. City of Minneapolis , su�ra, the Supreme Court of Minnesota ordered issuance of an apartment building permit which had been applied for only one month before a new zoning ordinance was adopted forbidding the use for which the permit� was sought. The permit had been originally denied by the ci�ty by reason of a hold order which had been in effect for nine years . In its opinion the Court noted that in other jurisdic- tions stopgap ordinances designed to suspend issuance of building permits for brie� periods of time had been upheld, but indicated th at as far as Minnesota is concerned, there is no' authority for a city to adopt such a policy by resolu- tion.' "In fact, ""the Court said, "even if such 'hold order '' had been adopted as an ordinance, its validity would be questionable, " 125 N.W. 2d 583, 586 (Emphasis added. ) IIn Ostrand v. Village of North St. Paul, su�ra, the North St. Paul Village ouncil had " rozen',"' y ordinance, the �issuance of building permits in certain areas of the villtage pending adoption of a new zoning code . Pursuant to thel"freeze , " the council denied plaintiff' s application for a permit to construct an apartment house in an area zoned for, such use , and less than two months later adopted a compre- hensive zoning ordinance permitting only single-family residence Mayor and Council 3. July 25, 1968 use of plaintiff ' s property. The Court invalidated the new zoning ordinance as it applied to plaintiff' s property and directed issuance of a building permit. In� both Alegander and Ostrand it was the Court ' s opinion that to deny a building permit application which meets all the requirements of ordinances in effect at the time of a�plication, solely because of a contemplated future change iri the use district classification of the property, is a taking of property without due process of law. I;'t is my opinion that it would be unconstitutional to deny �a special use permit to Shell Oil in the instant case sol'ely to prevent development of the property until adoptiori, at some indefinite time in the future, of a compre- hensivelplan for the Capitol Approach area. If the Traffic Engineer, Bureau of Health, Bureau of Fire , or other responsible gov�rnmental agency indicates that construction of the station on this land will adversely affect Ithe public safety, health, or welfare, and presents substantial evidence in support of such claim, a fact ques- tion would be presented which could support a decision not to grant the permit. , This question is not presented to us and tha.s opinion has no application to such a situation. This property is further described as Lots 1, 2, 3, Block 1, Whitney's Subdivision, Brewster's Addition. This matter was considered by the Board of Zoning at a public hearing on May 16, 196�8. The staff reported that the �affic Engineer had approved the plan and ttiat the Comprehensive Plan recommends commercial development for the site arid the immediate area. The plan meets the design standards for this type of facility. However, the property is within the areal jurisda�ction of the Capita�l Area Architectural and Planning Commission. The Commission, on May 6, 196'8, adopted a motion suggesting that the proposed structure of the Shell Oi1lCompany station and any other substantial external physical alteration of land or buildings within the prescri.bed bounds of the Capital Area be deferred until such time as the Master Plan for the area is completed and requested that a letter be sent to the Council suggesting that this ' matter be deferred until such a Master Plan is de.veloped. Due to your change of position, the resulting coverage in the S�. Paul Dispatch and your honest voicing of an opinion which met with a rather inane reprimand� I feel you will continue to be in� volved in this par,ticular controversy. I trust that you will convey to the other members of the city counci,l, Attorney Summe.rs and the mayor this individual opinion� both with this letter and through your continued efforts which I support. I would like to c�mmend first Commissioner Car�:son for his foresight and his interest in the welfare of the city� the Cap#tal area being of concern at the present time. � _ I would like to thank you for the time and ener,�gy to evaluate your decisions and actior�s; and for the honesty expressed in admitting an error and trying to rectify the error. The main purposejof this letter is to call attention to a few rather gross weaknesses in the governmental structure which were revealed in this incident and to reanmmend that the Council take� action to change or alter existing rules, laws or procedures. ( I will have to assume t'hat the editorial by Don Boxmeyer in the Tuesday 20 August Dispatch was a truthful reporting of the case.) , I seriously que{stion have any legal document that is as omnipotent as Attorney Summers states the city��s Legal Ledger is. His quote was�to the effect that a reconsideration of the special use permit could not legally effect the earlier action� since such action had been duly published in the Legal Ledger. This clumsy method of submitting action, then having to procedurally rescind the action appears to be rather slow, ex� pensive and in�this case embarrassing in process. � 1 I am one who i's hoping that an embarrassment to the Coundcil will occur and the action will be rescinded because the Counail was led to a very mundane and physical inter- � pretation of t,he ruling by Attorney Summers� who states that a special permit cannot be denied "unlfess it were shown that the developement would adversely affect public safety, healtFi or welfare"'. I feel Attorney Summers construed the ruling only from the vewpoint of physical or bodily safety and health and excluded "�velfare"' from any consid•• eration. I ain certain that "welfare"' or "well being�" could and should include not only our physical �iNell being but also that part of eqch of us that appreciates and responds to the aesthe�tic contributions and pleasures of a city. To define this aesthetic� emotional , mental and spiritual wetl being is more tlifficultr� but none the less� valid. It is the consideration of the individual in the co11e ctive population of the city. It is this aspect of "well being"! that will instill a city with pride, self respect, spirit and concern with one another. � �� a� 1� I The parallel is elsily drawn with slums and run��down ghettos. The physical body is not ' overly endangered1in either case, but the self-respect and spiritual well being of the individual, hen�ejthe city, is endangered. The point is clear, I feel , if the ruling were interpreted to include man, the whole man. Undoubtedty the government of this city is aware of this facit of well being-why else woutd there be a Department of Parks� - Recreation and Public Buildings. � ;- - The last and mostjfrightening aspect of the Shell Oil controversy was the placating at- titude expressed by Commissioner Dalglish, in regard to the le gislature. To even imply censor'ship of another commissioner, pacifying legislatures or self-conscious Council. action certainly inake personal integrity as well as the integrity of the Council suspe ct. I would have felt� more confident with the Council if you had not retracted your stq�e- me�ts (at least not the 100% that was quoted) or if the four who were led by Attorney Summers had been �heard from in some small way. It is easy of course to be the second guesser. I have ;been that. That is what I am supposed to be.� � I rely on the Council to serve �t. Paul and each St. Paulite favorably. I trust that this service can �be done as easily, thoughtfully and honestly as possible. The Shell Oi1 Special Use, Permit incident proved that there are many needless hurdles in the way of easy, thougF�ul and honest service.
