F. 239339, approved July 5,j 1968, a g�.b7.ic hearing was duly held on Tuesday, July 23, 1g68, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure- located at 878 'Park Street,; Saint Paul, Minnesota; and I WHEREAS, Upon the facts presented at the said hearing con-» sisting; o� photographs, inspection reports and the recommendations of the City Architect, it is found and determined by the City Coun.- cil that according to the records and files in the office of the Registe'r of Deeds, the last record owner of the . above-described propert;y is Shirley N. Bailey, and there is a mortgage of record in favor of Bert A. Bailey and An.nabel Bailey; and further, that Roy R. iR.yan, d�b�a Ryan PTumbing and Heating Company, has a mechanic�s lien against thia property; and that there are no other lien holders o� record; and that it is further determined that the above-described building constitutes a hazardous building withinjthe definition of Minnesota Statutes Section� 463. 15 for the foilowing reasons : (a) The building is standing vacant, partially open, arid is subject to entry by unauthorized persons and to vandalism; � ORM ppRpVE� � un � y ' � ' �prC�rati . COUNCILMEN � Adopted by the Counci� 19— Yeas Nays Carlson Dalglish Approver� 19— Meredith Tn Favor Peterson Sprafka Mayor Tedesco � Against Mr. President, Byrne , � , , - _ �O . � - � 1 � ������� -2- �(b) The exterior of the building is in a dilapidated ��condition and the foundation is deteriorated and needs repair, the siding has deteriorated and should be re- �placed, the cornice is dry-rotted, the entire rear ex- �terior stairway is deteriorated and in a dan.gerous con- dition, the window frames are deteriorated and rotted, �the structural members are rotted, and the four brick ichimn.eys are deteriorated and in danger of crumbling and falling down; I(c) The interior of the building is dilapidated and �the beams in the basement are sagging, there is dry-rot in the bottom of the wood posts supporting the beams , �the foundation is porous , allowing surface water to enter the basement , the 2-by-4 floor joists on the first floor are in need of proper support , the interi�or of the basement is littered with debris , the first floor �and second floor joists have" deflected causing the floors to sag, the window and window sashes are deteriorated, the structural members are dry-rotted, the interior , plaster is loose, hinges are loose from the doors, the attic area has been damaged severely by fire and the rafters and ,roof boards are badly charred, with the � chimn.ey brick falling, which must be repaired above - the roof line; (d) The building in its present condition is un.fit for human habitation and it must be corrected so as to comply with the Saint Paul Building Code and Housing Code; (e) The building constitutes a nuisance and a hazard to the public peace, health, safety and welfare because of its physical damage, dilapidation, abandonment and inadequate maintenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sec- tions 463. 15 through 463. 26, and based upon the foregoing find- ings of the City Council , the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. " , (b) All tif the above defective conditions must be corrected, a certificate of occupancy secured, the wiring, plumbing and heating must be brought up to comply with the Saint Paul Building Code and the Housing Code �requirements, and further, that the owner, within the thirty (30) days imposed herein, • .shall submit a list of intended corrections regarding the structural condition of the building, electrical and heating � systems, together with a schedule for the completion of the .... rehabilitation program and that the owner further apply for _ the necessary permits in the office of the C.ity Architect within. the thirty (30) days imposed herein. 2. � Unless such corrective action is taken to comply with this Order or an answer served upon the City _of Saint Paul and filed in _ the Office of the Clerk of the District� Court of Ramsey County, -� .Minnesota, within twenty (20) days from the date of the service of thisl0rder, a Motion for Summary Enforcement of this Order to . raze an'd _remove the said building will be made to the Ramsey County Dis�xict Court. Byrne, Mayor and Members of the City Council Gentle�en: Re: 878 Park St. The following is a report on the above property, which is a 2-story frarne four unit apartment building with a partial basement. The building is approximately 34 ft. wide and 42 ft. long and 26 ft. high. It is locat�ed about 5 ft. from the south property line and 5 ft. from the sidewalk property line. The building has not been properly secured, and we have been iri communication with Mr. Duane A. Bailey of 318 Topping 5treet on several occasions and have only received a partial s ecuring. EXTERIOR. � � 1. The foundation is in a deteriorated condition and needs repair. 2. The siding is badly deteriorated and should be replaced 3. The cornice has dry rot throughout. 4. The entire rear exterior stairway is in a deteriorated arid dangerous condition due to dry rot. 5. The window frames are deteriorated and have d.ry rot. 6. There are four brick chimneys which are deteriorated and in a dangerous condition. These chimneys have eroded. mortar joints and the bricks are falling and c ruxnbling. 7. The structural members have some dry rot. �ASEMENT. 1. The beams in the basement are sagging. 2. There is dry rot on the bottom of the wood posts that support the beams, and these posts have settled. , , , � i � � ,� a �-� Y , I � Hon. Thomas R. A great deal of debris litters the basement area. 5. There are 2x4 floor joists on the first floor that need proper support. FIR.5T AND SECOND FLOORS L '1'he floor joists have deflected, causing the floors to sag. 2. There is deteriorated floor covering material over the finished floor. 3. There is some weak and deteriorated finished flooring. 4. Windows and window sashes are in a deteriorated condition. 5. Dry rot exists i.n the structural members. 6. There are areas where there is loose plaster. 7. Hinges are loose from the doors. ATTIC. 1. A fire occurred in the attic area and the structural members that were charred were not replaced. The rafters and roof � boards are badly charred. There is evidence of some rotted roof board and it is doubtful that the roof would carry the required 40-1b. live load specified by the St. Paul Building Code. If a rehabilitation schedule is not submitted by the owners, it is the conclusion of the Bureau of Public Buildings that by reason of inadequate maintenance, dilapidation, physical damage and abandonment, the above structure constitutes a hazard to public health, safety and welfare. It is the fur�ther recommendation of the City Architect that the Council concur in this conclusion and refer the matter to the City Attor;iey's office for submi ssion of this condemnation to the District Court. � er trul y s, , � obert L.
