1 BE IT RESOLVED, that, upon the petition of Maurice Martin and Gregory Dahl, as documented in

that part of the alley in Block 7, Burlington Heights Division No. 2 lying northerly of the
easterly extension of the south line of Lot 21, said Block 7
14 This vacation shall be subject to the terms and condirion of Chapter 13Q codified March 1, 1981, of the
15 Saint Paul Legislative Code as amended, and to the following conditions:

1. That the petitioner's, their successors and assigns shall pay $600.00 as an administrarive fee for
this vacation which is due and payable within 60 days of the effecrive date of this resolution.
2. That a permanent drainage and utility easement shall be retained on, over, under and across the
vacated azea on behalf of the City of Saint Paul, Department of Public Works to preserve the
existing drainage corridor and to reserve the right of the City to install, maintain and operate a
sewer in or upon said easement and to enter upon said easement or any portion thereof at any
time and from time to time, for the purposes of future construction, reconstruction, inspecting,
maintaining or repairing the same or any part thereof. Any development or use of the property
shall be subject to the following conditions:
a. No buildings, shuctures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit norxnal access to utility facilities for maintenance puxposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the

Deparhnent of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the peririoner, its
successors and assigns in the event the City exercises its reserved easement rights.
No change from the existing grade within the easement azea will be pemutted without
written pernussion from the Department of Public Works.
No change in surfacing within the easement azea will be pemutted without written
pemussion from the Department of Public Works.
e. The peririoner, its successors and assigns shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
claims which shall arise from any injuries or damages received or sustained by any break
in any service pipe or connec6on in said reserved easement arising out of or resulting
from any action or negligence of the petitioner, its employees, agents, or business
invitees.

21 4.That the petitioners, their successors and assigns agree to indexnnify, defend and save harmiess the
22 City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter brought as
23 a result of injuries or damages received or sustained by any person, persons or properiy on account of
24 this vacation or pe6tioners' use of this property, including but not limited to, a claim brought because of
25 any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability
26 arising from any violation of any law or regulation made in accordance with the law, whether by the
27 peritioners or any of their agents or employees.

29 S.That the petitioners, their successars and assigns shall, within 60 days of the effective date of this
30 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall,
31 within the period(s) specified in the terms and condirions of this resolurion, comply in all respects with

I am requesting a date of August 4, 2004 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to approve the petition of Maurice
Martin Martin and Gregory Dahl to vacate a portion of Glen Road and a portion of
abutting alley. I have enclosed photocopies of the Green Sheet, the Council Resolution
and a map of the area to be vacated. Please let me know if there is any addirional
information you might need.

Division No. 2.
The purpose of this vacation is to: allow the petitioners to landscape and prevent further erosion.

future use of this proposed vacation. I would like to receive your comments before so I can prepare
a report to the City Council on this matter.

Although the Department of Public Works prefers to retain the public rights-of-way in the
Highwood azea to preserve future corridors for utilities or trails, we have agreed to allow this
vacation to proceed with the following condition:
That a permanent drainage and utility easement shall be retained on, over, under and across the
entire vacated area to protect the existing drainage corridor through this azea and to allow for
future utility installations. The following easement restrictions shall apply:
a. No buildings, shuctures, or trees aze permitted within the easement area nor any temporary
structure, material storage, fixture, or other objects that will prohibit normal drainage flow or
access to utility facilities for maintenance purposes.
b. Improvements in or upon the easement area that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written permission from the Department of Public
Works with the understanding that the restoration and costs of such improvements shall be the
sole responsibility of the petifioner, its successors and assigns, in the event the City exercises its
reserved easement rights.
c. No change from the existing grade is permitted within the easement azea without the written
pernussion from the Department of Public Works.
d. No change in surfacing within the easement area is permitted without the written permission
from the Department of Public Works.
e. That the petitioner, its successors and assigns shall indemnify, defend, and save harmless the
CiTy of Saint Paul, its officers, agents, employees, and servants from a11 suits, actions, or claims
which shall arise from any injuries or damages received or sustained by any break in any service
pipe or connection in said reserved easement, arising out of, or resulting from, any action or
negligence on the part of the petitioner, its employees, agents, or business invitees.
