OTHERS PRESENT: Patrick Fleury, Patom Inc., 995 West 7�' Street, owner and applicant, appeared. Ms. Moermond stated that this is a hearing on the license application for Shamrocks Grill & Pub. IYs a Liquor Outdoor Service Area (Patio) and Restaurant - Extension License. Mr. Fleury had a technical question. Will he need to pay another fee when he re-applies (January 2005) to the Planning Commission? Ms. Rozek and Mr. Hawkins both thought that he would need to. Mr. Hawkins said that in essence, this license is being issued on a trial basis. The same thing was done with fireworks sales a year ago and that law was recently passed. This is an irregular license because it's not on the same contiguous lot. The City wants to make sure that it will work. If stipulations or additional conditions need to be applied, the City will do so. If this license is just up for review in January, another fee will not need to be paid. If this license was issued as a temporary Determination of Similar Use, then another fee will need to be paid. He said that he will check on it and get back to Mr. Fleury. The Office of License, Inspection and Environmental Protection approved this license with the following conditions: 1. Ms. Moermond reported that the City received two (2) letters with concerns. Mr. Lemke was not interested in being presenY at this hearing; and the CiTy was unable to contact Jaunae Brooks by phone, although she did receive a letter indicating there would be this hearing. Mr. Lemke has met with Mr. Fleury about his concerns. Ms. Moermond will recommend approval of this license with the conditions listed to the City Council.
