THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Sain� Paul, as amended, be and the same is hereby further a,mended so as to rezone the following described property from "A" Residence District to "C-1" Residence District, to—wit: The North three hundred seventy—five (N. 375) f eet of the northeast quarter (NE 1�4) of the northwest quarter (NW 1�4 of Section two (2) Town.ship twenty—eight (28� , Range twenty—two (22) , except the east thirty (E.30) feet thereof, ,�situate on pxope��y loss��ed south and west of the interase�bion of Burns Avenue and Ruth Street in the City of Saint Paul. Marshall City C]:erk � � Room 386 City Hall ' Dear Sir: ' This is in regards to the petition of Edward D: Clapp to rezone from "A" Residence (low density residential) to "C-1" Residencey.=�(medium density apartments) property located �bu�h�andr.w�st.t�:of-:-the' intersection of Burns Avenue and Ruth Street (see attached lega7. description). The property under � � consideration has an area of 445,000 square feet which is approximately ten and one-third acres. Under the "C-1" Residence zoning category this site ' would allow approximately '270 dwell�ng units. � , This matter was considered by the Board of Zoning at a public hearing held on June 20, 1968. The_Commissioner of Finance has declared the petition sufficient with the owners of 17 of a possible 23 (73.9�) tracts within 100' having signed the petition. The staff reported that a 1966 petition by Clapp-Thomssen to rezone from "A" Residence to "C" Residence a larger tract including the propert.y in question was withdrawn by the petitioners after much diseussion and recommendations by the Zoning and Planning Boards. _ These 1966 discussions resulted in recommendations of denial for the rezoning from "C" Residence by both the Zoning Board and the Planning Board. Existing area zoning consists of "B" Residence and Commercia`�, to the north, "A" Residence and "C" Residence to the east, and "A" �Residence to the south and west. The entire area is presently vacant except for one sing�.e family home on the site i.n question and a residential development to the northeast. The property in question is partially wooded and level. There is a slight rise at the southeast end of the property and a downward slope at the west end. It is rolling land and is generally higher than the land to the west and lower than the properties to the north. The Comprehensive Plan recommends R-2 or low density residential use for the easterly 3/4 of the site in question and steep slope conservation for the westerly portion of the site which consists of a steep slope. It recommends the property north of the site in question be developed as high density residential. It should be noted that in a letter dated June 20, 1968 the Commissioner of Parks, Recreation, and Public Buildings had stated that the Parks Department still concurs with the original recommendation of the Comprehensive P�an their intention of the steep slopes north of Battle Creek Park to Burns Avenue. However, there are no funds to purchase this property at present. Ths matters were referred back to the Zoning Board which on February 17, 1966 approved the rezoning from "A" to Commercial but voted denial of both rszonings from "A" to "C" Residence after several area residents spoke in opposition. One of the points of opposition was that property to the east which was . rezoned four years earlier, had not yet developed. At the t�larch 1966 Planning Board meeting it was reported that Mr. Rohland Thomssen Jr. and Mr. Howard Dahlgren (Clapp Thomssen's Planning Consultant) had discussed with the staff how they could work out a proposal which would secure Zoning Board approval. At that meeting they sought the staff's ' feeling on a very general proposal which would call for "C-1" zoning instead of "C", reduce the total area to be r�zoned, r�aks the westerly 150' a permanent park easement and retain the southerly 200' aa single family residences, for ultimate town-houss development. They had said that as soon as a ne� dPvslopment � proposal was �c'reated they would bring it in for staff discussion. Such a pi�oposal has not been discussed �aith ths "staff since. At the same March 1966 . meeting the Planning Board voted, "that the previous action of ths Planning Board placing this area in a "C" cat�gory on the Land-Use Map be revoked and � the area placed back on the Land-Use Map as "A" Residence"�. . , - - • � � � ' C. Rosemary Schmidt of 1763 Burns Avenue, Mrs. Lantry of 2050 Suburban Avenue, Mr. Boyd,of 2131 Burns Avenue, Mr. Nasseff of 246 Ruth, Mr. Radmacher of 2026 Suburban Avenue, Mr. Marquardt of 2123 Scenic Place, and Mr. Orchard who represented the Oblate Fathers who own the property to the east of the property in question. The Zoning Board received <:t;• two letters in opposition to the rezoning,��one from Mr. John S. Smith 2035 � Suburban Avenue and the other from Mr. Donald E. Johnson of 2051 Suburban Avenue. The pe.titioner proposes that the multiple family development be a transitional area between the commercial development to the north and a contemplated single family development to the south. The petitioner has developed a tentative subdivision layout for single family homes on the property to the south.
