� In the matter of a hazardous building being that '
two-story frame dwelling known an.d described as

Paul and situated upon those premises legally

in the office of the Register of Deeds in and for
; the Coun.ty of Ramsey, State of Minnesota.°' �
. � WHEREAS,� Pursuant to resolution, C. F. 239329, approved '
Jul'y 3; 1968, a public hearing was duly held on Thursday, July 18,
1968, before the Council of the City of Saint Paul, said hearin�
pertaining to the condition of the structure located at 668-6882
East Sixth Street, Saint Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearing;' con-
sisting of photographs, inspect�aon reports and the recommendation
of, the City Architect, it � is found and determined by the City
Coun.cil� th�at according to the records and files in the office
of the Register of Deeds, the last record owner of the above-
described property is Reuben Myhra; that there exists of record
a mechanic' s lien in favor of A. Walter Avoles d�b�a Avoles
' Plumbing and Heating Company; and that there are no other lien
_,._R�holders� of record;. that it is further determined that the above--
described buildin.g,,tionstitut�es a hazardous building witYiin the
definition. of �M��n.ne's'i�ta3 Statutes, Section 463. 15, for the followi�g

' a. The building is standing vacant and is subject
, tolentry by unauthorized persons;
� � b. � The exterior condition of the building is in a
dilapidated state with bricks �falling from the chimney,
the windows are all smashed, the front entrance platform
and joists are rotted, and the concrete steps are in a
broken condition;

� , c. The interior of the building has been vanclalized,
it is littered with debris , the basement supporting posts
are rotted, the mortar between the basement limestones is
eroded. The wall plaster is cracked and falling, and the
floors are sagging;
' d. The building in its present condition is unfit
for hwuan habitation and the building must be corrected
� so as to be in compliance s�ith the St. Paul Building Code
.and Housing Code; .

� e. The building constitutes a nuisance and a �hazard
to the public peace, health, safety and� welfare because
t of its physical damage, dilapidation, abandonment and
�� inadequate maintenance ;
now, therefore, be it
RESOLVED, That in accordance with Minnesota 5tatutes , Sections
463. 15 through 463. 26, and based upon the foregoing findings of•
the City� Council, the Council of the City of Saint Paul does hereby
make thelfollowing Order:
� ORDER
1. � The owners of the above-described building shall make
� -'��"'^'tli�e`savie�"safe and�not'-detrimental to � the -publie �health, safety_.�_� _
and welfare by having the said building razed and the materials
therefro�m removed �rom the premises within thirty (30) days from -
the date of the service •of this Order, or, in the alternative, •
begin to correct the hazardous conditions and correct the hazard-
ous conditions by doing the following:
� a. Remove all paper and other combustible materials
from the building and securely close and keep closed all
I doors , windows or other openings in the buiTding;
�
� b. All of the above defective conditions must be
� corrected and the wiring, plumbing and heating systems
� brought up to comply with the Saint Paul Housin.g Code
, and• the Saint Paul Building Code requirements , and that
th'e- owner submit a list of intended corrections regarding
th�e structural condition of the �bu3lding electrical and
he�ating system, together with a schedule for the comple-
ti�on of the rehabilitation program and that the o��rn.er
apply for the necessary permit in the office of the City
� Architect within the thirty (30) days �mpos;ed herein.

� 2.� Unless such corrective action is taken to comply with thi�s _,
Order or an answer served upon the City of Saint Paul and filed in ,
the office of the Clerk of the District Court of Ramsey County,
Minnesota, within twenty (20) days from the date of the service
of this Order, a •Motion for Sunimary Enforcement of this Order
�t�o raze and remove the said building will be made to the Ramsey
County District Court.

3.� In the event that the building is to be.:razesl by the
City of� Saint Paul pursuant to judgment of the District Court,
all personal property or fixtures which may unreasonably interfere
with the razing and removal of this building shall be removed
within ten (10) days from the entry of judgment; and if not so
removed, the City of Saint Paul shall remove and dispose of such
personal property and figtures as provided by law.
4.� If the City of Saint Paul is compelled to take any cor—
rective action herein, all necessary costs expended by the City
will be' assessed against the above—described real estate and
collected as other taxes;

Paul and situated upon those premises legally
described as West 33. 18 feet o� Lot 25, Block 18,

acoording to the plat thereo� on �ile and of record
in the offiae of the Register o� Deeds in and for
the County of Itamaey, State of Minnesota.�'
WHEREAS� Pursuant to resolution, C. F. 239329, approved
July 3, 1968, a public hearing was duly held on Thursday, July 18,
1968, beYore the Couneil of the City o� Saint Paul, said hearin�
pertaining to the condition o3 the atructure looated at 668-688z
East Sigth Street, Saint Paul, Minnesota; and
S�IIEREAS, IIpon the facts prosented at the eaid hearing, con-
sisting o� photographs, inapeet�on reports and the recommendation
of the City Architect, it is foun.d and determined by the City
Council that according to the records and �iles in the o�fiQe
of the Register of Deeds, the last record owner of the above-
deseribed proparty is Reuben Myhra; that there exiats of record
a mechanic' s lien in �avor o� A. T�Talter Avoles d�b�a Avoles
Plumbing and Heating Company; and that there are no other lien
holdere of reoord; that it ie �urther determined that the above-
described building constitutea a hazardous building within the
definition of Aiin�p�snta Statutes, Section 463. 15, for the followir�g
reaaonst
a. The building ia standing vacant and is sub�ect
to entry by unauthorized persons;
b. �he exterior condition of the building is in a
dilapidated state with briaks falling �rom the chimney,
the windowe are all smashed, the front entra.nce platform
and �oiata are rotted, and the concrete steps are in a
broken condition;

� The interior of the building has been vandalized,

it is littered with debris , the basement supporting posts
are rotted, the mor'tar between the basement limestones is
eroded. The wall plaster is cracked and falling, and the"�
floors are sagging; -

� d. The building in its present condition is unfit

for human habitation and the building must be corrected
� so as to be in compliance with the St.. Paul Building Code
. a�d Housing Code; ,
i e. The building constitutes a nuisance and a hazard
to the public peace, health, safety and� welfare because �
� of its physical damage, dilapidation, abandonmen� and
i�adequate maintenance;
- -now, therefore, be it .
RESOLVED, That in accordance with Minnesota Statutes , Sections
463. 15 ��through 463. 26, and based upon the foregoing findings of•
the City Council, the Council of the City of Saint Paul does hereby
make the following Order:

l. The o��rners o� the above-described building shall make
the same safe and not detrimental to the public health, safety
and �nrelfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service �of this Order, or, in the alternative,
begin to correct the hazardous conditions and correct the hazard-
ous conditions by doing the following: • .
froIa. ftemove all paper and other combustible materials
m the building and securely close and keep closed all
doors , windows or other openings in the buiiding;
. I b. All of the above defective conditions must be
corrected and the wiring, plumbing and heating systems
brought up to comply with the Saint Paul Housing Code
- and the Saint Paul Building Code requirements , and that -
the owner submit a list of intended corrections regarding
the structural condition of the building electrical and
heating system, together with a schedule for the comple- ' '
tion of the rehabilitation program and that the o�lner
apply for the necessary permit in the office of the City
Architect within the thirty (30) days impos.ed herein.
2. i Unless such corrective action is taken to comply with this
Order or� an answer' served upon the City of Saint Paul and filed in
the office of the Clerk of the District Court of Ramsey County,
Minnesota, within twenty (20) days from the date of the service
of this Order, a riotion for Summary Enforcement of this Order
to raze `and remove the said building will be made to the Ramsey
County District Court. .

City of Saint Paul pursuant to �udgment of the District Court,
all personal property or �igtures whiQh may unreasonably interfere
with the razin and removal o� this building shall be removed
within ten (10� days from the entry of judgment; and i� not so
removed, the City of Saint Paul shall remove and diepose oY suoh
pereonal property and figtures as provided by law.

reQtive action herein, all neces$ary costs expended by the City

The above property is classified as a duplex of frame construction
two sto�ies in height and contains a full basement. It is approximately i
26 ft, v�de, 54 ft, long and 26 ft. high. The building is vacant and has ,
been for some time. This department has been in contact with the owners
requesting that it be kept secured. It has been secured for short periods �
and then is broken into and vandalized. Our most recent inspection reveals
that it is now s ecure.

.The owner of record is Reuben Myhra and the legal description of
the property is the West 33. 18 feet of Lot 25, Block 18, Lyman Daytons
Addition to the City of Saint Paul.

Bricks falling from the chimney caused by mortar eroding from
betweeri the bricks, the windows are all smashed, concrete steps are badly
broken up and the front entrance platform and joists are rotted away and
